Andrea Rosal, the daughter of the late communist rebel spokesman Gregorio “Ka Roger” Rosal, has been cleared by Pasig trial court of kidnapping with murder charges filed against her, her lawyer said Thursday.

Edre Olalia, who is also secretary general of the National Union of People’s Lawyers, said Pasig Regional Trial Court Branch 266 found no evidence linking Rosal to the 2007 incident for which she had been charged.

However, Olaila said Rosal will remain detained at the Taguig city jail for a pending murder case in Mauban, Quezon province.

"With measured vindication, we welcome and are pleased with the dismissal of the kidnapping charges pending in the Pasig court against Andrea Rosal even as we await the same resolution for dismissal of murder charges in a Mauban, Quezon court," Olalia said.

Rosal, then eight months pregnant, was arrested on March 27 by National Bureau of Investigation and military agents in Caloocan City.

Her case became a cause célèbre when, despite her condition she was detained in Camp Bagong Diwa in a cramped cell where she had to sleep on the floor and allegedly deprived of proper medical care.

Rosal and her supporters said the dismal conditions of her condition contributed to the death of her newborn daughter, Diona Andrea, on May 18.

"How tragic to have Andrea arrested, detained and have lost a baby daughter over false, trumped up and malicious charges which the Pasig correctly court struck down with prejudice," Olalia said.

Olalia said they would continue to exhaust all legal means to help Rosal “prove her innocence and seek accountability from all those who perpetuate rank injustice especially against the lowly and the underdog."
