THE ANTI-MONEY Laundering Council (AMLC) told covered entities to urgently follow freeze order processes, as the Philippines needs to show tangible progress in effectively implementing tighter laws on anti-money laundering and counter-terrorism financing (AML/CTF) to be able to exit the Financial Action Task Force’s (FATF) “gray list.”

The AMLC advisory comes over a week since the country was added to jurisdictions placed under the FATF’s increased monitoring, specifically the implementation of AML/CTF measures.

AMLC Executive Director Mel Georgie B. Racela said urgent compliance to freeze orders will be closely monitored by the FATF.

“Covered persons’ mandate to urgently implement freeze orders as required in the 2018 Implementing Rules and Regulations of the Anti-Money Laundering Act of 2001, is a key component in ensuring that the Philippines sufficiently addresses the International Co-operation Review Group (ICRG) action plan items, particularly those relative to money laundering and counter-terrorism financing investigations; and targeted financial sanctions that would effectively deny funds to designated terrorists,” Mr. Racela said in a Viber message on Sunday.

The AMLC told covered persons to strictly observe the period for filing of returns and to consider the start of the 20-day effectivity of freeze orders from the time the accounts are actually frozen.

According to the AMLC advisory, some covered persons only implement freeze orders a few days or weeks before the expiry of the period prescribed by the court.

The AMLC said some covered persons only submit returns for related accounts when the six-month effectivity of a freeze order is almost at its expiry.

Based on implementing rules and regulations, written returns with pertinent details on an account should be submitted to the AMLC and the Court of Appeals (CA) within 24 hours since the account was frozen.

A freeze order covers a main account, which the AMLC and CA determined there is probable cause that it is related to money laundering and terrorist financing. On the other hand, related or materially linked accounts are determined by covered persons in compliance with the freeze order.

Mr. Racela said there could be serious repercussions from the delayed implementation of freeze orders against designated persons and suspected money launderers.

“If freeze orders are not immediately implemented, the accounts not frozen can be disposed of by the owner, thwarting the AMLC’s efforts in building its case and eventually filing civil forfeiture proceedings and/or prosecuting the owner. Worse, the money in the accounts can be further used in the commission of unlawful activities and/or money laundering,” Mr. Racela said.

The late implementation of a freeze order as well as delayed submission or non-filing of returns are considered as money laundering offenses that could result in penalties for uncooperative covered persons, the AMLC said.

The agency also stressed that failure to immediately freeze accounts upon receipt of a freeze order is considered a grave violation under Republic Act 9160 or the Anti-Money Laundering Act of 2001 (AMLA), as amended.

The late implementation of a freeze order and the subsequent delay in the filing of returns are also considered money laundering offenses that could be punishable with imprisonment of four to seven years and a fine of not less than P1.5 million, the AMLC said. Covered persons that fail to comply may face penalties from P25,000 to P500,000 per violation, it added.

In case the delayed implementation of a freeze order involving accounts in relation to the Terrorism Financing Prevention and Suppression Act of 2012 and the Anti-Terrorism Act of 2020, the action could be considered as dealing directly or indirectly with the designated persons. AMLC said this could be punishable with reclusion temporal in its maximum period of 20 years to reclusion perpetua (up to forty years) and a fine of P500,000 to not more than P1 million.

Meanwhile, submitting late written returns or incomplete information related to a freeze order are considered as lighter offenses, the AMLC said. A complete written return should include the account number; names of account holder/s; amount in an account at the time it was frozen; all relevant information pertaining to the nature of an account or property; any information on related accounts or property related to the frozen asset, and the time when a freeze order took effect.

Under the Republic Act 11521 which further tightened the AMLA, covered persons were expanded to include Philippine offshore gaming operators and service provides as well as real estate brokers and developers.

In January, the Bangko Sentral ng Pilipinas (BSP) ordered lenders to submit their reports on accounts that have links to the Communist Party of the Philippines (CPP), the New People’s Army (NPA), and Islamic extremist groups following freeze orders issued by the AMLC.

To recall, Republic Act 11521 was enacted into law on Jan. 29, only days ahead of the Feb. 1 deadline set by the FATF for the country to show effective implementation of tighter AML/CFT laws. Republic Act 11479 or the controversial Anti-Terrorism Act of 2020 took effect in July 2020.

BSP Governor and AMLC Chairman Benjamin E. Diokno is hopeful that the country will be able to show its progress and leave the gray list on or before January 2023.

An alleged notorious member of the Special Partisan Unit (Sparu) of the New People’s Army (NPA) was killed in an encounter with the military in Sitio Pitik-Pitik, Barangay Luz, Guihulngan City, Negros Oriental Sunday, July 4.

The Army identified the fatality as Randy Tapales, who was reportedly linked to various killings in Guihulngan City, including the fatal ambush on Corporal Mark Anthony Quiocson in Barangay Luz on July 1, 2020; Civilian Active Auxiliary (CAA) Mico Dinoy, who was also killed in Barangay Luz last Jan. 28; and two civilian swine traders, Jemer Pondador and Romeo Dunggoan, who were killed in Barangay Magsaysay last July 21, 2020.

Tapales also had two murder cases based on the records of the Guihulngan City Police Station, according to the Army.

Troops of the 62nd Infantry Battalion (IB) encountered last Sunday at least five unidentified armed men believed to be members of the Sparu and SYP Platoon, Central Negros 1, Komiteng Rehiyon-Negros Cebu Bohol Siquijor (KR-NCBS), through the strong information network in Guihulngan City against the NPA.

The firefight lasted for five minutes which resulted to the death of one rebel and recovery of several firearms and a hand grenade.


No casualties were reported on the government side.

Lt. Col. Melvin Flores, 62nd IB commander, expressed his sincerest sympathies and condolences to the family of the slain rebel.

“Another life was wasted because of the NPAs’ deception and lies. However, justice was also served to the families who were victims of this communist terrorist hitman,” Flores said.

It was the worst air disaster in Philippine military history.

At least 49 army enlisted men, fresh from a training school and assigned to their first combat duty in Sulu, died when their C-130 Hercules military transport plane went down in flames before it could land at the Jolo Airport.

For most of these soldiers, it was likely their first time to be on a four-engine turbo-prop C-130H, the workhorse of the Philippine Air Force. At least 47 of them survived the crash.

This is the third time that a Lockheed C-130 aircraft has crashed since the 1990s, when the Philippine Air Force started using the plane for logistics run, rapid troop deployment, and humanitarian assistance and disaster relief operations.

When a C-130 crashed in August 1993 in Camarines Sur, it was carrying relief goods for typhoon victims. Thirty people died in the accident.

In 2008, a total of 11 people died when another C-130 went down minutes after it took off from an airport in Davao City.

Durable, flexible

Military pilots say the C-130 aircraft is one of the safest military planes because it has the capability to glide and will not drop from the sky.

The aircraft is suitable to land in any airfield, even in a short and unpaved runway, such as the 1.2-km at Pagasa Island in the Spratly Islands. In the case of the Jolo Airport, this was expanded more than a decade ago – with help from the United States – from about 2,000 meters to 3.8 km.

There were speculations that the C-130 had overshot the runway and was attempting to pull up for another attempt to land when it ran out of power. Others were saying the aircraft’s brakes and reverse track did not function after it touched down on the runway.

The Philippine Air Force will examine all available data from the plane’s blackbox to determine if the crash was caused by mechanical defects or human error.

Experienced pilots

But the two pilots on board, both with ranks of major, were very experienced aviators with probably hundreds of flying hours in a C130 plane.

Military spokesman Major General Edgard Arevalo appealed to the public to avoid speculating on what happened. “This exacerbates rather than helps in the current situation,” he told a news conference on Monday, July 5, a day after the crash. “The public can be assured the armed forces will be transparent in the conduct of the investigation. At this point, we have to wait for the result of the investigation.”

The Philippines has only five C-130 aircraft. Only two are flying and three are undergoing preventive maintenance.

A brand-new C-130 aircraft costs more than $150 million, but the plane that crashed was acquired this year by the Philippines from the United States for about P1.54 billion or roughly $32 million.

The money went to avionics, other equipment, and instruments that were removed by the United States when it transferred the aircraft to the Philippines under a Foreign Military Financing grant. The plane was given for free under a hot transfer program, meaning the aircraft was still being used by the United States.

Sunday’s air accident has exposed the air force's patchy safety record.

Just a month ago, a brand-new Polish Sikorsky Black Hawk combat utility helicopter crashed during a night training flight north of the capital, killing all six people.

Arevalo conceded the crash will definitely have an impact on its operations. The C-130 planes are not only ferrying troops and military supplies but they were transporting medical equipment and supplies during the coronavirus pandemic. It had also flown personal protective equipment bought from China.

It is now uncertain how the Philippines will proceed with its first-ever air-to-air four-day exercise with the Japanese Air Self Defense Forces in Clark.

Japan is sending a C-130 aircraft to show Filipino pilots how to load and unload cargo as well as air drop relief goods in a disaster area.

The recent aircraft accident in Sulu, which killed at least 52 individuals, left the military with no C-130 plane to use for its operations.

Armed Forces of the Philippines (AFP) spokesperson Major General Edgard Arevalo said the military temporarily prohibited its remaining C-130 planes from flying, following standard protocol.


“The standard operating procedure every time that an accident happens among our aircraft, the standing operating procedure is to ground the fleet of that aircraft until the investigation that has been conducted is concluded,” Arevalo said in a press conference on Monday, July 5.

“So in this case, we have another C-130 that is flying that will be grounded,” the AFP spokesperson added.

On Sunday, July 4, the C-130 Hercules plane crashed in Patikul town and killed at least 52 people, including 49 military personnel.

According to Arevalo, the military has five C-130 planes in total, including the one that crashed. Another C-130, which is in flying condition, will be grounded. Two others are currently under maintenance in Portugal. The fifth plane – recently purchased – has yet to arrive.

The AFP also previously grounded its Black Hawk choppers after the Black Hawk chopper crash in Tarlac on June 23, which killed six people. Nine other units of Black Hawk chopper were temporarily barred from flying.

Disaster response

The grounding of the C-130 came amid the restiveness of Taal Volcano. The military gave assurances that there will be other aircraft that can be used for disaster response.

“It may be able to affect us but again, contingency measures are there. We have navy ships, navy aircraft to help and assist in the delivery of these basic goods and services,” Arevalo said.

The C-130 planes were purchased by the defense department to enhance the country’s capability in heavy airlift missions. It was meant to enhance the military’s movements during territorial defense efforts and disaster response operations.

The 303rd Infantry Brigade of the Philippine Army marked its 35th founding anniversary on July 3 at Camp Gerona in Brgy. Minoyan, Murcia, Negros Occidental, by recognizing its outstanding soldiers and holding other activities.

Newly-promoted Brig. Gen. Inocencio Pasaporte, who led the celebration, lauded the collective performance of the 303IB soldiers that led to the accomplishment of its mandated tasks.

“Thus, it is just timely and right to give due credit for all of their sacrifices and their dedication to duty,” Pasaporte said as he conferred Military Merit Medals on recipient soldiers during the program that also observed strict health protocols.

The celebration was also highlighted by a mass, wreath-laying ceremony, and blessing of vehicles and equipment.

“Let us always work together for the greater aspiration of peace and development for the Filipino nation, especially in support of our unit’s mission accomplishment,” Pasaporte said.

Major General Romeo Brawner, Jr., the new commander of the 4th Infantry Division, and his family boarded the ill-fated C-130 plane before it crashed in Patikul, Sulu on Sunday.

“”Pangalawang buhay ko na ito (This is my second life). Yesterday, July 4 , my family and I rode on the same C-130 that crashed in Jolo,” he told reporters during the turnover of command at Camp Edilberto Evangelista here Monday.

Brawner replaced Major General Andres Centeno, who was appointed commander of the Philippine Army. Brawner vowed to sustain the fight against the communist rebels and other threat groups in the region.

Brawner said he and his family boarded the C-130 plane from Villamor Air Base in Pasay City, and disembarked at the Lumbia Airport here.

From Lumbia Airport, the C-130 aircraft with tail number 5125, proceeded to the Laguindingan Airport to fetch the soldiers assigned to the 11th Infantry Division in Sulu, he said.

The ill-fated C-130 plane crashed at 11:15 a.m. Sunday in Patikul town, killing 50 people, 47 of them military personnel and three civilians, according to the Department of National Defense on Monday morning.

Brawner said they offered mass and lit candles for the soldiers who perished in the crash.

He also expressed their sympathies to the families that the soldiers left behind.

Brawner said that President Rodrigo Roa Duterte was due to arrive in Zamboanga City at 3:00 p.m. Monday to visit the wounded troops brought in the city.

Brawner said there is no definite plan yet on how to transport the remains of the soldiers who died in the crash.

He said the AFP was still in the process of identifying the cadavers.

Zia Alonto Adiong, a Member of Parliament of the Bangsamoro Autonomous Region in Muslim Mindanao, said that Brawner has proven his worth and gallantry during the Marawi siege in 2017.

“General Brawner is both a soldier and a gentleman. He is brilliant and articulate,” Adiong said.

“He’s a good choice, probably the best choice to assume the post,” the official added.

Governor Mamintal Adiong Jr., of Lanao del Sur said that with Brawner leading the 4th Infantry Division, “we are assured that its residents and that of nearby provinces, which include Lanao del Sur, are safe.”

The governor noted that Brawner attended to the concerns of his constituents, such as the internally displaced persons, when the rehabilitation of war-torn Marawi started.

Brawner used to be the spokesperson and deputy commander of the military task force Ranao fighting the ISIS-aligned militants who attacked Marawi City in 2017.

He later took over the command of the 103rd Infantry Brigade based in Marawi as the military launched operations to flush out the remaining militants.

It said 49 soldiers and four civilians were also wounded when the C-130 cargo plane crashed Sunday after it overshot the runway in the capital town of Jolo. The plane was transporting soldiers from Cagayan de Oro City in northern Mindanao.

The military is investigating the fiery crash, adding all passengers and crew of the ill-fated aircraft had been accounted for.

Philippine military chief General Cirilito Sobejana said the C-130 aircraft missed the runway and failed to gain altitude and crashed in Patikul's Bangkal village.

Photos of the crash quickly went viral on social media with several pictures showing the two soldiers lying on the grass near the wreckage. The crash site is surrounded by small trees and a bamboo fence indicating it is a civilian area.

One photo shows two an army lieutenant, his head bloodied and another soldier nearby being assisted by unidentified men, probably soldiers too, who were on the scene. And another photo shows the burning wreckage of the aircraft – its tail number 5125 is visible even as black and white smoke billowed from the plane. Uniformed soldiers were also on the scene trying to help put out the fire.

According to a report of MaxDefense Philippines, the transport plane was the former MC-130 Combat Spear aircraft of the US Special Operations Command. The aircraft, it said, was purchased under Horizon 2 phase using Philippine funding and U.S. military assistance grant.

The crash came four days after a Philippine Air Force S-701 Black Hawk helicopter crashed during night flight training in the town of Capas in Tarlac province in central Luzon, killing all six airmen aboard.

The downed Polish-built chopper was under the 205th Tactical Helicopter Wing based at Clark Air Base. The cause of the crash is still being investigated.

The helicopters are manufactured by PZL Mielec, a subsidiary of Lockheed Martin, which had also previously acquired Sikorsky, the original manufacturer of the Black Hawk.

The Philippines acquired the helicopters under a government-to-government deal with Poland, signing a contract worth $241 million in 2019. The Black Hawks are being bought under the U.S. ally’s five-year Horizon 2 modernization program, which will run from 2018-2022. (Mindanao Examiner)

Nine alleged members of the Abu Sayyaf terrorist group surrendered to authorities in Talipao town, Sulu, the Philippine military said Monday.

The Joint Task Force Sulu said in a statement the bandits turned themselves in at the Philippine Army's 1101st Infantry Brigade Headquarters,
with two M-16 rifles, two Garand rifles, and a caliber .38 pistol.


According to 2nd Special Forces Battalion commander Lt. Col. Jooney Jay Businos, one of those who surrendered is a deaf-mute who joined the terrorist group when he was a teenager.

He was 32-years-old when he gave himself up after being under ASG leader Radulan Sahiron's group, Businos said.

Maj. Gen. William Gonzales, commander of the 11th Infantry Division, said those who yielded will undergo long-term rehabilitation and enroll in livelihood programs.

Last March, 14 Abu Sayyaf Group members also surrendered with their firearms to the military in Sulu.

New People’s Army (NPA) – Negros Island spokesperson Ka Juanito Magbanua said in a video released on social media yesterday, June 29, that the NPA as the genuine people’s army fights against the US-Duterte regime’s National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) which aims to destroy the revolutionary movement in the entire country within President Duterte’s term.

“The people cherish the NPA because it fights for the interests mainly of the peasants and workers. In terms of land, how the peasants can own land through free land distribution,” said Magbanua.

According to Magbanua, the NPA also helps in improving economic conditions of farmers by actually participating in farming and maintaining peace and order by solving contradictions between the people. Also part of the NPA’s tasks is to launch medical missions and treat illnesses through herbal medicine and acupuncture.

Magbanua also claimed that the efforts of the Duterte regime to destroy their mass base caused considerable devastation to farmers especially the indigenous peoples (tumandoks) in the countryside who are victims of human rights violations.

“During the pandemic, they need help in their economic situation; but instead, usually in combat operations, they experience bombings and abuse of human rights,’ he said.

The Apolinario Gatmaitan Command video explained the difference between the NPA and the Armed Forces of the Philippines.

It said the NPA’s difference from the AFP is that the AFP receive regular salaries from government coffers, people’s taxes but in return they do not serve rather inflict harm on the people. Meanwhile, the NPA does everything to improve the living conditions of the people, their health, literacy and their security.

Magbanua elucidated that particularly in Negros, the five guerrilla fronts continue to expand [its territory] and deepen its link to the masses.

“It cannot be denied that the enemy’s combat operations have caused harm here in Negros but this does not mean that they have decimated two guerrilla fronts in Negros. The truth is, as I already mentioned, the support of the people for armed struggle continues to broaden and deepen,” he said.

He added that the Apolinario Gatmaitan Command, with the wholehearted support of the people, will confidently continue to develop, expand and strengthen the five guerrilla fronts in Negros and possibly establish more.

Magbanua also mentioned the victims of red-tagging by government agencies, most recently the officials leading the NTF-ELCAC.

“Due to serious abuse of human rights not only here in the countryside but also in the cities and town centers, there have been an increasing number of victims of red-tagging. Red-tagging is linked to harassments up to killings,” he said.

“All those who aspire to go to the countryside to help in strengthening and building of the mass base, increasing the red fighters and launching anti-feudal campaigns. Your talents are needed in the armed struggle until we achieve victory,” he ended.

Ipinakikita ng mga datos na ito na sistematikong tinatarget ng mga armadong pwersa ng estado ang mga sibilyan. Ang ganitong mga paninibasib sa mga sibilyan at sa kanilang mga komunidad ay maruming taktikang ginagamit ng rehimeng Duterte at ng National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) sa balangkas ng kanilang madugong gerang kontra-insurhensya.

Taliwas sa internasyunal na batas ng digma na dapat ay nagliligtas sa mga taong di tuwirang kalahok sa armadong tunggalian, tinatarget ng AFP ang mga sibilyang komunidad na kanilang kinukubkob at inookupa, kaakibat ng inilulunsad nitong mga operasyong militar laban sa Bagong Hukbong Bayan (BHB). Ipinapataw sa mga baryong ito ang batas militar kung saan ipinatutupad ang mga paghihigpit, walang mandamyentong panghahalughog, paninindak sa mga tao at pagkontrol sa kilos, kabuhayan at komersyo ng mga residente. Ang mga erya na nakapagtala ng pinakamatataas na mga kaso ng operasyong militar ang nakapagtala rin ng pinakamatataas na mga kaso ng mga paglabag sa karapatang-tao sa parehong panahon.

Nais ipabatid ng AB sa mga mambabasa na marami pang kaso sa kanayunan ang hindi naiulat dulot ng tindi ng mga operasyong militar laluna sa Mindanao.
Pagpaslang, bigong pagpaslang, tortyur, at pagdukot

Hindi bababa sa 60 sibilyan ang naging mga biktima ng pampulitikang pamamaslang sa buong bansa ngayong unang hati ng taon. Mas marami ang pinaslang ngayong taon kumpara sa bilang ng mga biktima sa parehong panahon noong 2020 (46). Kalakhan ng pinaslang (33) ay mga magsasaka. Tatlo sa mga biktima ay mga menor de edad. Kalakhan sa mga biktima ay pinalabas ng mga pwersa ng estado na “nanlaban” at namatay sa mga “engkwentro.”

Gaya sa nakaraang taon, ang rehiyon ng Bicol ang nakapagtala ng pinakamataas na bilang ng mga pinaslang (18), kasunod ang Southern Tagalog (13) at Negros Island (12). Ang unang dalawang rehiyon ay saklaw ng mga operasyon ng Southern Luzon Command (Solcom) na pinamumunuan ng tagapagsalita ng NTF-ELCAC at notoryus na red-tagger na si Lt. Gen. Antonio Parlade, Jr. Ang Bicol at Negros ay parehong saklaw ng Memorandum Order 32 na inilabas ni Duterte noong 2018 na direktang nagdeploy ng dagdag na mga batalyon sa naturang mga lugar. Sa mga prubinsya, pinakamarami ang pamamaslang sa Negros Occidental (7), kasunod ng Rizal at Camarines Norte (tig-6).

Nakapagtala ang AB ng limang masaker sa parehong panahon. Pinakahuli rito ang pagmasaker ng 3rd Special Forces Battalion sa Barangay Diatagon, Lianga, Surigao del Sur sa tatlong Lumad, kabilang ang isang menor de edad noong Hunyo 8. Pinaniniwalaang tinortyur ang mga biktima bago pinaslang, habang dalawa sa kanila ay pinaniniwalaang ginahasa. Isang linggo bago nito, minasaker din ng mga elemento ng 2nd IB at pulisya ang tatlong magsasaka sa Barangay Anas, Masbate City.

Naganap din noong Marso 7 ang tinaguriang “Bloody Sunday” kung saan siyam na aktibista ang magkakahiwalay na pinaslang sa Cavite, Batangas at Rizal. Noong Mayo 28, nilikida ng mga pwersa ng estado ang dalawang konsultant ng National Democratic Front of the Philippines (NDFP) sa Visayas na sina Fr. Rustico Tan at Reynaldo Bocala. Labag ito sa Joint Agreement on Safety and Immunity Guarantees (JASIG).

Limang indibidwal ang naiulat na dinukot ng mga pwersa ng estado at hindi pa rin inililitaw sa kasalukuyan. Kabilang sa kanila ang kabataang aktibista na si Kemuel Ian Cometa na dinukot ng pulisya sa Barangay Macabling, Sta. Rosa City, Laguna noong Mayo 21, kasabay ng pagmasaker sa tatlong iba pang aktibista.

Dagdag pa rito, nakapagtala rin ang AB ng tatlong biktima ng bigong pagpaslang at limang biktima ng tortyur. Kabilang sa mga biktima si Angelo Karlo Guillen, kabilang sa mga abugado ng mga petisyuner kontra ATL, na sinaksak sa ulo noong Marso 3 sa Iloilo City. Abugado rin siya ng siyam na Tumandok na minasaker, at 16 na iba pang inaresto sa Capiz at Iloilo noong huling araw ng 2020.



Pag-aresto at detensyon

Umabot sa 201 kaso ng arbitraryong pag-aresto at detensyon ang naitala ng AB sa unang hati ng taon. Pinakamarami ang inaresto noong Marso (78 biktima), at pinakamarami ay mula sa sektor ng magsasaka (74), kasunod ng pambansang minorya (73). Pinakamataas ang bilang ng biktima (80) sa Southern Tagalog. Hindi bababa sa 63 indibidwal ang inaresto sa Rizal pa lamang. Kabilang sa kanila ang nasa 60 Dumagat na inakusahang kasapi ng BHB at arbitraryong inaresto sa Rodriguez at Antipolo City noong Marso 14 at at Abril 13.

Nakapagtala rin ang AB ng hindi bababa sa walong insidente ng maramihang pag-aresto sa parehong panahon. Pinakahuli rito ang pag-aresto ng mga elemento ng 22nd IB sa siyam na kasapi ng pamilyang Mapula at apat na iba pang indibidwal sa Bulan, Sorsogon noong Hunyo 28. Anim sa kanila ang menor de edad. Pinakabata sa mga biktima si Althea Mapula, 2 taong gulang, na inaresto kasama ng lima pang bata.

Sa kabuuan, hindi bababa sa 28 menor de edad ang inaresto sa naturang panahon. Kabilang sa kanila ang 19 na na estudyanteng Lumad na inaresto sa kanilang paaralang bakwit sa Barangay Talamban, Cebu City noong Pebrero 15 kasama ng pitong guro at kanilang mga tagasuporta. Kabilang naman sa mga gurong inaresto si Chad Booc na isa sa mga petisyuner laban sa ATL.

Dagdag pa rito, nakapagtala ang AB ng 15 kaso ng pagbabanta, panggigipit at intimidasyon. Hindi pa kasama rito ang mga indibidwal na ni-red-tag ng NTF-ELCAC at mga kasapi ng mga progresibong organisasyong patuloy na ginigipit ng mga armadong pwersa ng estado.

Atake sa mga komunidad

Mula Enero, nakapagtala ang AB ng iba’t ibang tipo ng mga atakeng militar sa hindi bababa sa 610 barangay ng 321 bayan sa 65 prubinsya. Pinakamarami ang apektadong barangay sa North Central Mindanao (80), kasunod ang Southern Tagalog (74 barangay) at Eastern Visayas (58).

Hindi bababa sa 32 barangay ang apektado sa walang patumanggang pambobomba, at 27 barangay naman ang sinaklaw ng pag-istraping ng militar sa naturang panahon. Kabilang dito ang 21 barangay sa lalawigan ng Quezon na sinaklaw ng pambobomba at pag-istraping ng militar noong Pebrero. Apat na barangay din ang naiulat na kinanyon ng militar.

Pinakahuli sa mga pag-atakeng ito ang pambobomba at pag-istraping ng militar sa magubat na bahagi ng Barangay Kasapa II, La Paz, Agusan del Sur noong Abril 6, malapit sa sakahan at komunidad ng mga residente. Anim na bomba ang ihinulog ng militar sa lugar gamit ang dalawang FA-50 fighter jet. Tatlong beses ding kinanyon ng militar ang naturang barangay noong Pebrero.

Ang walang patumanggang mga atake at ang okupasyong militar sa mga baryo ay nagresulta sa pagbabakwit ng hindi bababa sa 16,232 residente mula sa kanilang mga komunidad sa iba’t ibang panig ng bansa. Kalakhan ng mga bakwit ay mula sa Southern Tagalog (nasa 15,000).

Sa natitirang oras sa poder, tinatangka ni Duterte na lubusin ang tunay na esensya ng kanyang whole of nation approach – ang piliting ipaloob ang buong sibilyang burukrasya at populasyon sa militaristang paghahari. Ngunit, walang puwang ang pasistang pagkahumaling ng rehimeng US-Duterte sa harap ng patuloy na pagtugon ng mga lokal na yunit ng gubyerno sa walang prenong paghagupit ng pandemya, kalamidad at sakuna. Laluna’t iniwan sila sa ere ng kanilang pabayang punong ehekutibo. Hindi pamimigay ng baril at pang-uudyok ng karahasan laban sa maralita, kundi makabuluhang ayuda at suporta ang ipinapanawagan ngayon ng mamamayan, higit yaong mga naapektuhan ng panibagong pag-alburuto ng bulkang Taal.

Inuulan ngayon ng batikos ang rehimeng US-Duterte sa pagsangkalan nito ng kampanyang kontrainsurhensya upang desperadong bigyang-matwid ang pakanang pag-aarmas sa mga sibilyan. Partikular na pinalitaw ng hindi nag-iisip na si DILG Sec. Eduardo Año ang posibilidad na gawing mala-CAFGU ang mga upisyal at tanod ng barangay bilang dagdag pasistang pwersa laban sa rebolusyonaryong kilusan at demokratikong kilusang masa.

Mahigpit itong tinututulan ng publiko kabilang ang mga lokal na yunit ng gubyerno. Hindi nila masikmurang lumahok sa marahas na pasistang kulturang sila mismo ang binibiktima. Hindi sila papayag na maging armadong galamay na magsisilbi lamang sa desperadong pananatili ng tirano sa kapangyarihan. Alam nilang daragdagan lamang ng whole-of-nation na pasismo ni Duterte ang kanyang mga krimen laban sa sangkatauhan.

Lalo lamang ilinalantad ng naturang pakana ang papabigong gera kontra-mamamayan at pangungunyapit ni Duterte sa poder. Dahil bigo siyang madurog kapwa ang demokratiko at rebolusyonaryong pakikibaka ng mamamayan, sukdulan na lamang na tangkaing gawing mga bulag na instrumento ng pasismo at terorismo ng estado ang buong sibilyang populasyon..

Nananawagan ang NDF-Bikol sa mamamayan ng rehiyon at ng buong bansa na sa harap ng sumasahol pang mga kundisyon ng pang-aapi at pagsasamantala, panghawakan ang pagkakaisa at paglaban bilang kanilang natatanging armas. At walang ibang dapat tutukan nito kundi ang rehimeng US-Duterte. Dapat singilin ang rehimen sa ibayo nitong pagbaon sa mamamayan sa kumunoy ng krisis. Dapat itong panagutin sa patung-patong nitong pasista at mga teroristang krimen. Dapat itong pabagsakin.

Ang mga CAFGU o CAA nga gigastuhan ang training sa buhis sa katawhan gigamit ni Cong. Pichay isip mga personal nga security sa kompanya sa iyang brother-in-law nga si Paolo Lopez;

Gigamit ang RMG-PNP, nga usa ka ispesyal nga pwersa sa kapulisan, isip gwardya sa kompanya sa pamilya sa usa ka congressman;

Sinuhulan ug nagsilbi sa personal nga interes sa mga politiko ang AFP.

State terrorism under the Duterte tyranny continues to intensify under the wrongly named Anti-Terrorism Law, enacted exactly a year ago today. Duterte’s police and military forces have carried out heightened systematic attacks against civilians as part of his desperate war to suppress the people’s democratic resistance and his scheme to perpetuate himself in power.

The CPP is one with the broad democratic forces of the Filipino people in demanding the repeal of the draconian ATL.

In wielding the ATL, Duterte and his fascist thugs are proving that the widely questioned law is anti-democratic and violates fundamental civil and political rights. The designation of the Party and the New People’s Army (NPA) as “terrorists” was done on the whims of Duterte’s lieutenants on questionable legal grounds.

In designating the CPP and NPA, the real aim of Duterte’s fascist thugs is to use the law and its severe penalties against the legal democratic forces and political opposition who are being red-tagged or accused of consorting with the revolutionary forces.

On the basis of the designation of the CPP/NPA, a number of consultants of the National Democratic Front of the Philippines (NDFP) active in peace negotiations were treacherously designated as “terrorists” by accusing them of being leaders of the CPP. If Duterte will have his way, it is only a matter of time that the ATL will be used against all his critics and rivals.

Emboldened by the ATL, security forces of the reactionary regime have gone on a sustained rampage of extrajudicial killings and massacres across the country targeting primarily peasant and worker mass leaders and activists, as well as peace consultants, human rights advocates and lawyers. Hundreds more have been subjected to unlawful arrests, abductions, harassment, forced “surrenders,” conscription and other forms of abuses by police and military forces.

Most of the victims of violations of human rights have been invariably tagged as supporters of the NPA by the Philippine National Police (PNP) and Armed Forces of the Philippines (AFP) to justify the spate of killings and abuses.

The state terrorist drive of the Duterte regime is in direct violation of prevailing international rules of war which stipulates the protection of the rights of civilians not taking part in armed hostilities. The regime’s attacks against civilians constitute grave war crimes.

Hugtanong gikondena sa Bagong Hukbong Bayan sa North Eastern Mindanao Region (BHB-NEMR) ang pagmasaker sa 3 ka sibilyang Lumad nga gihimo sa mga tropa sa 3 rdSpecial Forces Battalion (SFB) ug ang pagtabon sa maong krimen.

Niadtong Hunyo 15, 2021, gipaarakan og pamusil ang 3 ka sibilyang Lumad sa nag-operisyon nga mga tropa sa 3 rdSFB didto sa Sitio Decoy, Brgy. Lianga, Surigao del Sur. Ang mga biktima nga sila si Willy Rodriguez, Lenie Rivas ug ang iyang 12 anyos nga igsoon nga si Angel Rivas pulos mga sibilyan ug lumulopyo sa Sitio Manluy-a, Diatagon. Padulong ang 3 sa sentro sa komunidad aron mopalit og dugang pagkaon nga dalhon balik sa ilang kaubanan nga padayong naghag-otog abaka sa dihang gimasaker sila sa mga sundalo.

Ang pagmasaker sa mga sibilyan ug pagtanom og armas aron ipakita nga nisukol, Standard Operating Procedure (SOP) o nabatasan na sa AFP ug PNP ilabina ubos ni Duterte. Ingon ani kamangtas ang mga sundalo: bisan nakaila sila nga mga sibilyan ang mga biktima naka ako sila pagdeklara nganisukol nga mga NPA kini, ngilngig nga gipanamastamasan ang mga patay’ng lawas, giposing ug gitamnan og armas. Nakaila ang mga sundalo sa 3 rdSFB tungod dugay na nagkampo ang militar sa Manluy-a ug nag-establisar sila og detatsment. Gihasi ug gibaharan sa mga tropa sa 3rd SFB ang mga ginikanan ug paryente, apil na ang mga taga-komunidad batok sa paghatag og pamahayag kabahin sa panghitabo ngadto sa mga nag-imbestiga o sa media. Nagtukmod kini sa mga lumulupyo nga mobakwit na usab tungod sa kahadlok.

Namakak na usab ang AFP. Hunyo 21, 2021 nag-presscon ang militar og mga datu sa NCIP uban si NTF-ELCAC Usec Lorraine Badoy ug kadagkuan sa AFP ug NTF-ELCAC apil na si NTF-ELCAC Chair Gen. Esperon didto sa Butuan City. Dakung bakak ang gisaysay nga panghitabo ni Colonel Benedict Harvey Gernale, Commanding Officer sa 3rd Special Forces Battalion, Philippine Army. Samtang ang mga datu sa NCIP gipangunahan ni Rico Maca niingon nga respetohon kuno ang tradisyon sa Lumad nga husayon sa ilang kaugalingon ang maong panghitabo.

Gigamit ang mga Lumad pinaagi sa NCIP aron tabunan ang gihimong masaker sa 3rd SFB. Hunyo 23, 2021, kakunsabo ang mga tinudlo ngaLumad lider sa NCIP nagpahigayon og peke nga kalihukan sila didto sa Kansilad Resort sa Lianga, Surigao del Sur sa “paghusay” tali sa ginikanan sa mga biktima ug militar, naghimohimo og ritwal nga ilang ginganlan og Dungaan/Husoynga subay kuno sa Manobo Customary Laws ug gihatagan og kwarta bugti sa kamatayon sa 3 nga ilang brutal nga gipatay. Angayan lamang nga hatagan ang mga ginikanan og indemnipikasyon ug angayan lamang nga dawaton nila ang maong kantidad. Apan wala kini magpasabot nga dawaton ang bakak sa militar nga NPA ang ilang mga anak. Mapakahigmata unta kini sa mga lider Lumad nga tinudlo sa NCIP nga gigamit lamang gyud sila sa militar batok sa ilang isig-ka-lumad.

Matabunan man sa AFP ug NTF-ELCAC ang masaker sa nasudnong balita apan sa mga komunidad nga gigikanan sa mga biktima ug mga kasikbit nga lugar, ang kamatuoran magpabilin: gimasaker nila ang mga sibilyan ug ila kining gitabunan.

Dili na kini bag-o nga binuhatan sa AFP.

Mahinumduman nga niadtong Septembre 1, 2015 gimasaker sa paramilitar nga Magahat-Bagani ang 2 ka lider Lumad nga sila Dionel Campos ug Jovillo Sinzo ug magtutudlo nga si Emerito Samarca atubang sa gatusan ka mga lumulopyo. Niadtong November 28, 2020 gipusil patay usab nila ang walay armas ug dili makasukol nga si Ka Rheb didto sa bukid sa Marihatag ug giposing ang patay’ng lawas nga naghawid og pusil aron ipakita nga nisukol. The National Democratic Front (NDF) – Negros in a statement strongly opposed and denounced Duterte’s proposal of arming civilian groups in aid of police operations, a call the President stated during the launch of the Philippine National Police’s (PNP) Global Coalition of Lingkod Bayan Advocacy support groups and force multipliers last June 25.

“Arming government force multipliers is a clear admission of Duterte, the PNP and the Armed Forces of the Philippines’ (AFP) incompetence in solving criminality perpetrated by their own state forces. Arming them does not address the root cause of criminality but will further aggravate the human rights situation in the Philippines,” said Ka Bayani Obrero, NDF-Negros spokesperson.

Obrero also said that since Duterte came into power, thousands of Filipinos have been illegally arrested, abducted, and worst, killed without a single one seriously investigated and given justice.

Here in Negros, numerous cases of extrajudicial killings, arbitrary arrests and detention of activists, critics and ordinary civilians have been reported with the police and military’s routinary “nanlaban” narrative.

NDF-Negros stated that Duterte will certainly weaponize these so-called civilian volunteers against critics of his murderous and rotten regime.

“In this time of pandemic, what the people need right now is a concrete and comprehensive solution to the country’s worsening health crisis. The Duterte regime should prioritize more on free mass testing, pro-active contact tracing, faster vaccine roll out and financial aid for our people,” Obrero added.

Obrero further said that if Duterte is sincere in his intention to ensure the welfare and protection of civilians, he must put an end to his bloody war on drugs and “counter-insurgency” campaign immediately.

“We call on all human rights advocates, communities, victims and families affected by military and police operations, church people and all freedom-loving Negrosanons to collectively oppose and denounce another of Duterte and the PNP’s outright militarist attempt to infringe human rights and fundamental freedoms. Strengthen the broad people’s movement and make Duterte accountable for all his crimes against the Filipino people,” Obrero ended.###

State terrorism under the Duterte tyranny continues to intensify under the wrongly named Anti-Terrorism Law, enacted exactly a year ago today. Duterte’s police and military forces have carried out heightened systematic attacks against civilians as part of his desperate war to suppress the people’s democratic resistance and his scheme to perpetuate himself in power.

The CPP is one with the broad democratic forces of the Filipino people in demanding the repeal of the draconian ATL.

In wielding the ATL, Duterte and his fascist thugs are proving that the widely questioned law is anti-democratic and violates fundamental civil and political rights. The designation of the Party and the New People’s Army (NPA) as “terrorists” was done on the whims of Duterte’s lieutenants on questionable legal grounds.

In designating the CPP and NPA, the real aim of Duterte’s fascist thugs is to use the law and its severe penalties against the legal democratic forces and political opposition who are being red-tagged or accused of consorting with the revolutionary forces.

On the basis of the designation of the CPP-NPA, a number of consultants of the National Democratic Front of the Philippines (NDFP) active in peace negotiations were treacherously designated as “terrorists” by accusing them of being leaders of the CPP. If Duterte will have his way, it is only a matter of time that the ATL will be used against all his critics and rivals.

Emboldened by the ATL, security forces of the reactionary regime have gone on a sustained rampage of extrajudicial killings and massacres across the country targeting primarily peasant and worker mass leaders and activists, as well as peace consultants, human rights advocates and lawyers. Hundreds more have been subjected to unlawful arrests, abductions, harassment, forced “surrenders,” conscription and other forms of abuses by police and military forces.

Most of the victims of violations of human rights have been invariably tagged as supporters of the NPA by the Philippine National Police (PNP) and Armed Forces of the Philippines (AFP) to justify the spate of killings and abuses.

The state terrorist drive of the Duterte regime is in direct violation of prevailing international rules of war which stipulates the protection of the rights of civilians not taking part in armed hostilities. The regime’s attacks against civilians constitute grave war crimes.

July 5, 2021With the rest of his time in power, Duterte is trying to perfect the true essence of his whole of nation approach-to force the entire civilian bureaucracy and population into militarist rule. But, there is no room for the fascist obsession of the US-Duterte regime in the face of the continued response of local government units to the relentless onslaught of pandemics, disasters and catastrophes. Especially since their careless chief executive left them on the air. It is not the distribution of guns and the incitement of violence against the poor, but the people are now calling for significant help and support, especially those affected by the new eruption of the Taal volcano.

The US-Duterte regime is now under fire for using a counterinsurgency campaign to desperately justify its plan to arm civilians. Particularly triggered by the thoughtless DILG Sec. Eduardo Año the possibility of turning barangay officials and guards into CAFGU-like as an additional fascist force against the revolutionary movement and the democratic mass movement.

It is strongly opposed by the public including local government units. They do not hesitate to participate in the violent fascist culture that they themselves are victims of. They will not allow themselves to be armed tentacles that will only serve the tyrant’s desperate stay in power. They know that Duterte’s whole-of-nation fascism will only increase his crimes against humanity.

Such a scheme only exposes Duterte’s failed war against the people and his clinging to power. Because he failed to crush both the democratic and revolutionary struggle of the people, it is an extreme attempt to turn the entire civilian population into blind instruments of fascism and state terrorism.

The NDF-Bicol calls on the people of the region and the entire country to, in the face of worsening conditions of oppression and exploitation, hold on to unity and resistance as their unique weapon. And it should focus on nothing else but the US-Duterte regime. The regime must be held accountable for further harassing the people in the wake of the crisis. It must be held accountable for its multiple fascist and terrorist crimes. It must be overthrown.

NDF: Changes of Position and Attitude Towards the GRP-NDFP Negotiations and Me

Since becoming president in 2016, Duterte has manifested three different positions and attitudes towards the GRP-NDFP peace negotiations and towards me.

First, he claimed in 2016 to be “Left” and socialist, interested in the resumption in peace negotiations with the NDFP and willing to talk with me in Manila. I told him that we could meet in a third country and that I could return to the Philippines after the peace negotiations succeeded in producing the comprehensive agreements on social and economic reforms and on political and constitutional reforms.

I was wary that my premature return to Manila would prejudice the holding of the peace negotiations in a foreign neutral venue as mandated by The Hague Joint Declaration of 1992. Duterte agreed to let the peace negotiations proceed abroad. These went through four rounds from August 2016 to April 2017. Significant progress was made in the negotiation and drafting of the Comprehensive Agreement on Social and Economic Reforms.

But the fifth round of formal talks in May 2017 was aborted by the GRP side on the pretext that the NDFP could not immediately require the CPP to withdraw its call for the intensification of struggle against Duterte’s proclamation of Mindanao-wide martial law targetting not only the Maute group but even the CPP and NPA. The solution was simply for Duterte to issue a supplement to his proclamation to clarify that this did not target the CPP and NPA. But he did not do so.

Then in the second half of 2017, it became increasingly clear that Duterte had a change of position and attitude. He was no longer interested in peace negotiations with the NDFP and was single-mindedly for an all-out war against the CPP and NPA to comply with Trump’s order and to aim for fascist dictatorship. He issued Proclamation 360 terminating the peace negotiations on November 23, 2017 and Proclamation 374 designating the CPP and NPA as “terrorist” organizations on December 5, 2017. From then on, he was boasting that he could destroy the CPP and NPA before the end of 2018 or the middle of 2019.

He kept on ranting that the NDFP or I had no control or influence over the CPP and NPA and that the peace negoltiations had to be “localized” in the Philippines under the auspices and control of his own Office of Presidential Adviser on Peace Process. It became clear that General Galvez and the national security cluster had designed a scheme of “localized” peace talks for the purpose of psywar, intelligence and surveillance, faking surrenders of CPP and NPA personnel and engaging in extrajudicial killings and pocketing tax money under the pretexts of E-CLIP and “community support program”.

It must be pointed out that Duterte and his political and military running dogs are absolutely correct when they say that the NDFP Negotiating Panel and I, merely the Chief Political Consultant, do not have the power to issue orders to the CPP and the NPA. The collective leading organs of the NDFP, CPP and NPA are indeed all in the Philippines. On behalf of all the NDFP allied organizations, the NDFP National Council has duly authorized the NDFP Negotiating Panel to negotiate with the GRP Negotiating Panel.

Duterte and his running dogs are therefore mendacious and malicious in taking the position and attitude and ranting that I make decisions and give orders to the CPP and NPA and that I am a “terrorist” who should be deported by the Dutch government to the Philippines for punishment by the Duterte regime under its draconian law of state terrorism. In fact Duterte and his fellow butchers are the ones liable for extrajudicial killings of more than 33, 000 people before the International Criminal Court based in The Hague.

No amount of terrorist-tagging and lying by Duterte and his fellow butchers against me can deflect attention from their campaigns of mass murder in the Philippines in the bogus war on illegal drugs as well as in their counterrevolutionary actions of murdering mere rebel suspects, social activists, human rights defenders, peace advocates and NDFP peace consultants. It is utterly perverse of the Duterte regime to expect that the revolutionaries can be lured into peace negotiations in the Philippines after the murder of the NDFP consultants: Randy Felix Malayao, Randall Echanis, Julius Giron, the Topacio couple, the Cabanatan couple and Reynaldo Bocala.

Duterte and his fellow butchers have been staging small pickets before the Dutch embassy and making statements to the effect that if I were to be deported to the Philippines for punishment there would be no one else to demand that the peace negotiations be held in a foreign neutral venue and that the peace negotiations would be held in the Philippines under the auspices and control of Duterte, the OPAPP and the NTF-ELCAC.

I assure these fascists that the CPP, NPA and NDFP have enough brains to think that even peace negotiations in a foreign neutral venue have become too risky and costly for the NDFP after the murder of so many NDFP peace consultants. There is the need for certain new guarantees to ensure the safety and immunity of NDFP negotiators, consultants and staff if ever peace negotiations would be held in cooperation with an administration, which is not as treacherous and murderous as the Duterte regime.

Finally, I wish to point out that Duterte and his fellow butchers are not only criminally brutal but also utterly stupid. They conveniently forget that I am a recognized political refugee under the absolute protection of Article 3 of the European Convention on Human Rights and the principle of nonrefoulement in the Refugee Convention. They also forget that in 2009 I won my cases against the EU terrorist-listing before the European Court of Justice and against the false murder charges instigated by the Arroyo regime before the Dutch courts. It is totally stupid and preposterous that Duterte and his fellow butchers are asking the Dutch government to violate my rights under Dutch and international law.###

It is the shared history and abiding commitment to democracy that define and anchor the relationship between the Philippines and the United States (US), according to President Rodrigo Duterte.

Duterte made this statement to commemorate the 75th anniversaries of the inauguration of the Third Philippine Republic and the Philippines-US Diplomatic Relations.

In these two historical events, Duterte said the Philippines was able to regain its independence.

“By doing so, we reclaimed our inherent right to an independent state and to forge relations with other countries on the basis of sovereign equality and respect,” he said in his speech on Monday.

Duterte acknowledged that ties between the Filipino and American peoples are “deep as they are storied.”

“It is no secret that the United States occupied the Philippines not long after we won independence from Spain through a valiant struggle,” he said.

He admitted that the ensuing Philippine-American War wrought so much “pain and destruction” from which the nation has yet to fully heal.

The Filipino leader, however, also pointed out that the Philippines fought with America to free the world from fascism and oppression during the World War II.

“In a war we neither wanted nor asked for, we fought shoulder to shoulder with America for freedom and dignity. Together, we won alongside the free world,” he said.

Despite differences, he said the Philippines and US have a “common stake” in a peaceful and prosperous Asia-Pacific region which makes their longstanding alliance relevant in the face of a changing world.

“Our strong people-to-people ties ensure that bilateral cooperation remains vibrant and responsive to the needs and aspirations of our societies,” he said.

He, meanwhile, urged the public to seize the opportunity to renew the enduring Philippine-US friendship and value their robust alliance that serves “shared interest.”

The inauguration of the Third Republic marked the fulfillment of the long struggle for independence that began with the Philippine Revolution on August 23, 1896 and which was formalized on June 12, 1898 with the proclamation of Philippine Independence at Kawit, Cavite.

On Sunday, the National Historical Commission of the Philippines, in coordination with the Department of Foreign Affairs, United States Embassy and other government agencies led the commemoration of the 75th anniversaries of the Inauguration of the Third Philippine Republic and Philippine-US diplomatic relations at the Independence Flag Pole in Rizal Park.

President Rodrigo Duterte will visit soldiers who were injured in the Philippine Air Force (PAF) C-130 plane crash that killed 47 soldiers and three civilians in Sulu, Malacañang said on Monday.

“If plans push through po, mukhang daraan po ang ating Presidente sa Zamboanga to visit some of those na nasa ospital po (it looks like the President will drop by Zamboanga to visit some of those in the hospital),” Presidential Spokesperson Harry Roque said in a Palace press briefing.

Roque said the President extends his condolences to the families of those killed in the plane crash in Patikul, Sulu.

“Nagpapaabot po ng pakikiramay si Presidente Rodrigo Roa Duterte sa pamilya ng mga nasawi ng bumagsak na C-130 sa Sulu. Nagluluksa, hindi lamang ang Sandatahang Lakas ng Pilipinas, ngunit ang buong bansa sa malungkot na pangyayaring ito (President Rodrigo Roa Duterte extends his condolences to the family of those killed in the C-130 plane crash in Sulu. Not only the Armed Forces, but the whole country is mourning in this sad incident),” he said.

He said Duterte also hopes for the speedy recovery of those who were injured in the accident.

“Nananalangin po kami na yakapin ng Panginoon ang mga nagdadalamhating pamilya para maibsan kahit paano ang kanilang nararamdaman at nawa’y mabigyan sila ng lakas para malagpasan ang pagsubok na ito. Samantalang, pinagdarasal din natin ang mabilis na paggaling ng mga survivors, (We pray that the Lord embraces the grieving families to alleviate their grief and give them the strength to overcome this ordeal. While we also pray for the speedy recovery of the survivors),” he added.

The PAF C-130 plane that figured in the accident was one of the two aircraft purchased from the United States (US) last January.

Asked if Duterte ever expressed anger over the US for providing the Philippines with supposed second-hand equipment, Roque said he has yet to pass judgment pending results of the investigation.

“So far po, matinding kalungkutan dahil dun sa mga naging biktima. Wala pa namang mga ganyang pananalita akong naririnig galing kay Presidente (he has only expressed extreme sadness over the victims. He has not released statements like that as of this moment),” he said.

Armed Forces chief of staff Gen. Cirilito Sobejana said Duterte would be briefed further on the C-130 crash upon his arrival.

Sobejana said the remains of soldiers who perished in the crash are on their way to Zamboanga City onboard a Navy vessel before they will be transported to Northern Mindanao where most of the fatalities came from.

“I sympathize to the highest level to the families of those of perished,” Sobejana told Radio DXMS in Cotabato City in an interview Monday morning.

He assured that the government is attending to the needs of all who were injured in the mishap, one of the worst in Philippine military history.

“We have our team of investigators, we are in the thick of our investigation to determine what really happened. Let us wait for the probe to be completed so we can give accurate information,” Sobejana said even as he appealed to the public to refrain from speculating about the cause of the crash.

Sobejana said the three civilians who died in the incident were on the ground when the C-130 Hercules cargo plane crashed and exploded near their homes in Sitio Amman, Barangay Bangkal, Patikul. Four other civilians were injured.

Defense Secretary Delfin Lorenzana earlier said an investigation on the mishap is currently ongoing.

This accident happened less than two weeks after an S-70i Black Hawk Utility helicopter crashed in Capas, Tarlac during a night flight training, killing six people on board.

Meanwhile, Roque said the recent mishap should provide “an impetus for further modernization” in the AFP.

“Malungkot ang mga pangyayaring ito (This is a sad incident), but rather than deterring us, we will proceed full-speed ahead in modernizing the Armed Forces within our limited resources. Dahil alam naman natin na (Because we know that) we need a viable Armed Forces to defend particularly our territorial sovereignty,” he said.

The investigating team of the Philippine Air Force (PAF) is now at the crash site in Patikul town, Sulu to start its investigation on the ill-fated C-130H "Hercules" cargo aircraft which claimed the lives of at least 47 military personnel and three civilians last Sunday.

"As of now, the investigating team has already arrived in the area to conduct its own investigation. It would have arrived last night but due to the absence of running lights in Sulu, their trip was rescheduled early this morning," Armed Forces of the Philippines (AFP) spokesperson Marine Maj. Gen. Edgard Arevalo said in an online press conference Monday.

Arevalo said the AFP is determined to find out what really transpired in Sunday's tragic incident. According to available information, the aircraft followed the specified protocols regarding "approach speed (and) the landing spot".

"What is yet to be determined is what caused the aircraft to (go out of) the runway. This is going to be determined by a select group of tested pilots who will be the ones to assist in the conduct of the investigation," he added.

Arevalo assured the public that the AFP will be very transparent in the conduct of the investigation as the military is interested in determining what really happened and will use all inputs gathered in the course of the investigation to prevent such incident from happening again.

"Just like you, we are very much and keenly interested (in) determining what happened because all that we can do, all that (is) humanly possible for us to ensure that will not happen (again)," he said.

The AFP spokesperson also appealed to the public to avoid speculations or spreading news that are unverified regarding the incident because this would not help the current situation.

"Likewise, we would like to inform you that apart from the eyewitnesses accounts and data that the control tower in Sulu might have in their possession, we are also going to look for the black box or the flight data recorder which we are fortunate that this C-130 has so we have already cordoned the area to ensure the integrity of the pieces of evidence and other materials, all objects that could help us determine what transpired exactly in this particular tragic incident," he added.

Other aspects of the investigation include looking at the facility, equipment, weather and skill of the pilots.

"All these will have to be taken into consideration and I would not want to venture on any of those yet until and unless the investigation (has) been out," the AFP spokesperson said.

Arevalo said the C-130 involved in the mishap is in tip-top shape even if it is not brand-new.

"It's not brand-new but it's in very good condition. As a matter of fact, when it was delivered to the AFP it (had) more than 11,000 flying hours remaining and when this accident happened it still had around 11,000 flying hours remaining before the next maintenance of this aircraft," he added.

Also, Arevalo said there is no truth to rumors that the aircraft is defective, adding that all its pilots are all rated, seasoned, and experienced in flying the C-130.

He said the C-130 is one of the sturdiest, strongest aircraft in the country's inventory.

Arevalo said the AFP is willing to share the results of the investigation provided it will not affect national security.

"We assure our people that we are transparent indeed and the result of the investigation are available when completed, it's just that not all results of (the) investigation are for public consumption, but if there are specific issues that they would like to know with regard to a particular incident and that will not affect national security we are very willing to share that to the public," he added.

The aircraft was one of the two C-130H acquired through a grant from the US government that arrived in the country last January 29. It was formally welcomed to the PAF fleet during a ceremony at the Villamor Air Base, Pasay City on February 18.

The C-130 is a four-engine turboprop military transport aircraft designed and built originally by Lockheed, now Lockheed Martin. Capable of using unprepared runways for takeoffs and landings, the C-130 was originally designed as a troop, medical evacuation, and cargo transport aircraft.

Arevalo said they are still yet to release the names of the survivors as not all the families of the fallen soldiers have been informed about the fate of their loved ones.

"We have not yet completed the necessary information or giving of information to the relatives of those who were deceased, it takes a process for us to (give this) information," he added.

This includes having priests or ministers in the scene so that they can explain the incident or circumstances, a medical practitioner preferably a doctor along with a close relative who can look or check the condition of the family member who will receive the said news.

"But we are assuring them that they are going to receive the necessary support and assistance that they deserve and also we are going to give the benefits that are due our soldiers because they died in line of duty," Arevalo said.

He added that AFP chief Gen. Cirilito Sobejana has also given instructions to make sure that the fastest and most efficient way is utilized in identifying the victims so that their families can be informed immediately.

Arevalo said that Sobejana will be proceeding to Sulu in "due time".

As this developed, AFP public affairs office chief Navy Capt. Jonathan Zata, in a message to reporters, said Sobejana has approved and directed all military camps to lower their flags to half mast for six days starting Monday.

"For those camps with the wake of fatalities, (this) will continue until the internment," he added.

Aside from the 47 military personnel killed in the crash, three other civilians also died in the C-130 mishap, bringing the death toll to 50.

Some 49 military personnel and four civilians are undergoing treatment for injuries sustained in the crash in various hospitals in Sulu and Zamboanga City.

Around 96 people are recorded in the C-130's flight manifest, including three pilots and five aircrews.

"If there (is) any need for higher level medical treatment, attention or facilities that are necessary to treat our wounded soldiers, the AFP is willing to bring them to Manila," Arevalo said.

The AFP spokesperson also thanked airline companies like Philippine Air Lines for expressing its intentions to help in the medical evacuation of the wounded personnel.

"And of course, Air Asia which is an auxiliary reserve training unit of the PAF who also expressed a willingness to help in the medical evacuation," he added.

Arevalo also said that all air, sea, and land transportation assets of the AFP are focused on the ongoing retrieval operations.

Following the crash, the AFP spokesperson said all remaining C-130s in the PAF fleet will be grounded.

Prior to the accident, the PAF had four C-130s in its fleet, including the one that crashed and two undergoing maintenance.

Meanwhile, Philippine National Police (PNP) chief Gen. Guillermo Eleazar on Monday said he has directed the director of Police Regional Office Bangsamoro Autonomous Region to coordinate with local military units responding to the scene so that they can deploy assets that can help in the ongoing retrieval operations.

Also, he added the PNP is ready to extend whatever help it can to the families of the affected soldiers and civilians.

Speaker Lord Allan Velasco on Monday vowed to support efforts that will upgrade and modernize the Philippine Air Force (PAF) fleet following one of the country's deadliest military aviation accidents.

Velasco made the commitment as he expressed his condolences to the family and loved ones of the 50 individuals, mostly military personnel, who died in a C-130H plane crash Sunday in Patikul, Sulu.

“There are simply no words that can be said to console those left behind by our brave military personnel, as well as the three civilians who died as a result of this disaster,” Velasco said. “I can only give my word that we in the House of Representatives will include in the 2022 budget the modernization of the PAF’s fleet as well as ensure the proper training of personnel in handling modern equipment."

He said Congress was supposed to include the purchase of more C-130 planes in the 2021 national budget, but there was not enough time to deliberate on the PAF fleet modernization when he took over as Speaker in October last year.

He noted that sessions were suspended at the time, and President Rodrigo Duterte even had to call for a special session to prevent a reenactment of the 2020 national budget.

Velasco urged the Armed Forces of the Philippines to conduct a thorough investigation on the incident with the end in view of preventing such disasters from happening again.

He also called for a review of PAF pilots’ protocols, as well as an inquiry on the safety of runways around the country, especially in the provinces.

“We acknowledge the importance of our uniformed personnel, as our dear President Duterte himself has done so several times,” Velasco said. “The least we can do is to ensure that this never happens again.”

Full assistance, benefits

Majority Leader Martin Romualdez, for his part, said full government assistance and benefits should be extended to the loved ones of the fallen soldiers and survivors at the soonest time possible.

"I grieve with the families of our soldiers who perished in the C-130 plane crash in Sulu. These heroes of our time will be remembered for their great courage and service to our country," Romualdez said.

Romualdez said the House of Representatives will await a full report from Defense Secretary Delfin Lorenzana, who ordered an investigation on this tragic incident.

"After receiving the report, rest assured that we will exhaust all means possible to make sure that our soldiers and men in uniform are safe from harm and their welfare protected," Romualdez said.

Deputy speaker Rufus Rodriguez urged the Department of National Defense (DND) and the military to extend all possible help to soldiers who died or were injured in the C-130 plane crash.

“My deepest sympathies to the DND and the families of our soldiers who died in the plane crash. Please extend all possible assistance from the DND and the Armed Forces of the Philippines (AFP) to our fallen heroes and those injured," Rodriguez said in a text message to Lorenzana.

Rodriguez also requested for a list of victims from Cagayan de Oro, so that his office could give assistance to their families.

“My heartfelt and sincere condolences to the families of the fallen soldiers and crew and civilians, and prayers for the speedy recovery of the injured, all of whom prepared to bravely defend our nation,” he said. “It is with deep sadness that this tragedy took the lives of many young soldiers and injured dozens, most of whom are residents of Cagayan de Oro and Misamis Oriental."

Rodriguez lauded Lorenzana for grounding similar aircraft of the military until an investigation into the Sulu plane crash is finished.

“They have to determine the cause as soon as possible. By most accounts, the C-130 is a safe transport plane,” he said.

Cavite Rep. Elpidio Barzaga condoled with the victims’ families, saying that “I join the Filipino nation in condoling with those who have lost their loved ones in the tragic accident in Sulu. This is very unfortunate."

The plane that crashed was one of the two C-130H acquired through a grant from the US government that arrived in the country last Jan. 29.

The death toll from the crash on Sunday has climbed to 50 -- 47 are military personnel while the three others are civilians who were on the ground when the plane crashed and exploded near their homes in Sitio Amman, Barangay Bangkal, Patikul. Four other civilians were injured.

All passengers, pilots and crew have been retrieved. Meantime, the search for the C-130's black box is ongoing.

Some 49 military personnel and four civilians are undergoing treatment for injuries sustained in the crash.

Senators offered condolences to the families of 47 soldiers who died when a Philippine Air Force (PAF) Lockheed C-130H Hercules transport plane crashed in Patikul, Sulu on Sunday.

Three civilians on the ground were also killed.

At the same, Senator Ronald "Bato" Dela Rosa said in a statement on Monday that the unfortunate incident is a wake-up call to further modernize the Armed Forces of the Philippines.

"I have to wait for the results of the investigation before I lay the blame on our antiquated military aircraft. But perhaps, it is about time that we in the legislature take a second hard look at the reality that lives lost from these so-called flying coffins or widow makers are priceless compared to the foreign debt that we may incur as a result of military modernization," said dela Rosa, who was a police officer based in Mindanao before becoming a lawmaker.

Senator Francis Pangilinan also said an investigation is needed "to find ways to avert another tragedy".

"As they risk their lives in performing their tasks, our soldiers deserve better equipment and hardware to make every flying safe," he said in another statement.

Senator Grace Poe echoed Pangilinan’s call for an inquiry “to see what can be done to avoid a repeat of the tragic crash and to put in place measures to make our military planes safe”.

Senator Koko Pimentel III, who hails from Cagayan de Oro where the aircraft took off en route to Jolo, said in another statement that he is deeply saddened by the crash and thanked the personnel who died "for their service to the nation. May Almighty God bless all of our soldiers and their families".

Senator Risa Hontiveros said "the government should ensure that all benefits due their families will be released without delay and they be accorded the proper military honors upon burial".

Initial reports said the plane with tail number 5125 was carrying 96 passengers. It attempted to land at Jolo Airport, near Camp Teodulfo Bautista, but overshot the runway.

The plane arrived in the Philippines in January and is one of six C-130s operated by the PAF's 222nd Airlift Squadron.

It had been in service since February 1988 with the United States Air Force before being sold to the Philippines through the Defense Security Cooperation Agency.
