HOT PURSUIT OPERATIONS SA AFP LAMBIGIT SA KAMATAYON SA MGA OTAZA, GISUGAT SA AKSYONG HARASSMENT SA NPA

Duha ka adlaw nga nagsunod ang nahitabong panagsangka tali sa mga nag-combat operation nga mga tropa sa 23rd Infantry Battalion ug mga Pulang manggugubat ubos sa NPA-Western Agusan del Norte – Agusan del Sur Subregional (WANAS) Command sa lungsod sa Buenavista sa Agusan del Norte. Kini nga pwersa ang naggukod sa yunit sa NPA nga nagreyd ug nagsilot sa mayor sa Loreto, Agusan del Sur nga si Dario Otaza ug iyang anak nga si Daryl kaniadtong Oktubre 19.

Bandang alas-sais sa buntag sa Oktubre 24, nabuthan ang usa ka kolum sa 23rd IB nga nag-combat operation sa Sitio Tabon-tabon sa Brgy. Olave. Diha-diha, miresponde dayon ang tulo ka helikopter sa lugar aron mo-rescue sa ilang mga kaswalti.

Pagka-Oktubre 25, sa bandang alas-6:30 sa buntag, nahitabo ang laing panagsangka tali sa usa ka yunit sa NPA-WANAS ug sa mga tropa sa 23rd IB didto sa Sityo Calaitan, Brgy. Sangay sa mao gihapong lungsod. Mga 40 minutos lang human sa hitabo dihang miabot ang duha ka helikopter sa gisangkaan aron sa pagkuha sa ilang kaswalti nga gituntunan lang og pisi kay dili makatugpa sa bakilid nga bungtod. Wala masuta pila gyud ang kaswalti sa mga mersenaryong kasundaluhan tungod kay direkta kining gisakay sa helikopter pabalik sa ilang kampo.

Sa duha ka insidente, usa ka Pulang manggugubat ang nadaplisan gamay. Walay mga himan militar, mga dokumento o bisan unsang kahimanan sa gerilyang hukbo ang nabilin o nakumpiska sa kaaway. Human sa unang panghitabo, nasugatan sa mga tropa sa 23rd IB ang usa ka babayeng mag-uuma kuyog ang duha niya ka anak nga nanagan kay ipalayo unta ang ilang gitigway nga kabaw. Gipaarakan sila sa mga pasistang sundalo sa walay pupangutana. Nabiyaan nila ang ilang bag nga may sulod nga pipila ka nuog-ilisan.

Nahitabo ang panagsangka sa mga hilit nga bahin sa maong mga baryo layo sa mga kabalayan ug busa walay bisan usa ka sibilyan nga personal nga nakasaksi. Ang mga baryuhanon nga nagtapok sa sentro sa Upper Olave niadtong Oktubre 24, nakadungog lang sa buto-buto ug nakabantay sa pag-abot sa tulo ka helikopter nga nagkuha sa mga kaswalti sa reaksyonaryong tropa usa ka kilometro gikan sa ilang nahimutangan. Sa laing bahin, ang panagsangka sa Sityo Calaitan niadtong Oktubre 25, mga upat ka kilometro ang gilay-on gikan sa pinakaduol nga balay sa mga lumulupyo. Unsa man ang mga bersyon sa estorya sa mga tigpamaba sa AFP, ang mga residente sa maong mga lugar ang makasulti unsa ang tinuod.

Gikasuko ug gikaguol sa mga nagharing hut-ong ug sa iyang mga armadong pwersa ang kamatayon sa mga Otaza nga ilang saligando sa kontra-rebolusyonaryong kampanya. Angayan gyud nilang ikaulaw ang ilang kainutil sa pagprotekta kaniya.
Busa nagkara-kara na dayun sila sa paglunsad og combat operation aron gukoron ang mga NPA nga gituohan nilang maoy naglunsad sa maong aksyon.

Aron matabunan ang ilang kaulaw, gi-relieve diha-diha sa mga kadagkoan sa PNP ang duha ka tag-as nga opisyal sa PNP-Region 13 – ang Provincial Director sa Agusan del Sur nga si Senior Supt. Joseph Plaza ug ang City Director nga si Senior Supt. Francisco Dungo sa Butuan.

Revolutionary justice prevailed when the Southern Mindanao Regional Operations Command of the New People’s Army, acting on the decision of the people’s court, authorized the imposition of standing order and punished warlords GPH mayor Dario Otaza and Daryl Otaza to give justice to the thousands of indigenous peoples and peasants terrorized by their despotic tyranny in Loreto and surrounding municipalities of Agusan del Sur.

The NPA Southern Mindanao Regional Command commends the revolutionary fighters and officers of the Comval North Davao South Agusan Subregional Command who, in joint operations with the NPA-Northern Mindanao Regional Operations Command, meted the maximum sentence of death penalty against Loreto Mayor and Bagani paramilitary leaders Dario Otaza and his son, Daryl, on October 19, 2015 in Butuan City.

NPA operatives posing as NBI elements raided the Otaza residence in Brgy. Baan, Butuan City, subdued Otaza’s security details and confiscated 4 bushmaster rifles, 2 .45 cal. pistols and 2 9mm pistols. The NPA operatives found in Otaza’s possession of some PHP 25,000.00 which had been secured and shall be returned to the family through a third party in the soonest possible time.

The people’s court found Dario Otaza guilty of masterminding and ordering the execution of the following heinous crimes against the people and the revolutionary movement:

1. Brutal murder and torture of the Lumad and ordinary civilians, namely, Benjie Planos of Brgy. Kauswagan, killed September 13, 2013; Gabriel Alindao of Brgy, Kauswagan killed October 10, 2013 and Gerry Villamor of Datu Ampunan, killed September 10, 2014, all in Loreto, Agusan Del Sur.

2. Multiple frustrated murder and robbery of some families residing in Km 16, Brgy. Datu Davao, Loreto on September 9, 2014 perpetrated by Bukakang Banggaan and certain Augit and Intoy who are members of the Otaza-created Taptap paramilitary group. (The names of the victims have been withheld for their protection.)

3. Arson and destruction of the homes of the farmers in Brgy. Kauswagan by Otaza’s paramilitary men Mariel Dioganon, Aki Dioganon, Jordan Dioganon, Abdon Dioganon, Abdon Dioganon, Abdon Sinkok, Peping Maamib and Loloy Cedilla in 2013. (The names of the victims have been withheld for their protection.)

4. Intense military operations jointly conducted by Otaza’s Bagani forces and 26th IB under Oplan Bayanihan which resulted to gruesome right abuses against Lumad population:

a. Torture of four minors, two of whom have also been subjected to illegal arrest and illegal detention, all from Brgy. San Isidro, Loreto.

 b. Hamletting and imposition of food and economic blockade in five villages in Brgy. Kauswagan, Loreto

 c. Forced evacuation, which also translated to the economic dislocation of at least 459 indigenous Manobo individuals from Brgy. Kauswagan and other villages of Loreto. Many from among the evacuees have not reclaimed their land to this day as their villages continue to be Otaza’s Bagani war zone.

 d. Divestment and destruction of not less than 100 hectares of agricultural land and upland farms which had been rehabilitated and tilled by the evacuees after typhoon Pablo;

 e. Attacks against and closure of two community based learning centers which constituted violations of the rights of children to development and education.

 Otaza’s Bagani Force and the 26th IB continue their atrocities through forcible arrest, fake surrenders, arbitrary detention, psychological warfare, threat, harassment, threat against the families of NPAs, even after entering an agreement brokered by Davao City Mayor Rodrigo Duterte with the evacuees that no retaliatory attacks will be waged against them upon their return from evacuation.

5. On September 5, 2009, two of Otaza’s intelligence operatives infiltrated an NPA unit based in Loreto bearing poisoned food which rendered NPA troops unconscious and defenceless. Otaza’s operatives then relentlessly fired at the incapacitated NPA troops, resulting to the death of four NPA officers and fighters, capture of one NPA fighter and other casualties.

The elder Otaza, then acting as NCIP provincial chieftain together with Capt. Gusi, Officer of MIB 4th ID, planned and ordered the execution of this carnage which was part of the AFP’s Task Force Gantangan, a major component of Oplan Bantay Laya 2, the centrepiece of which is the perversion of the Lumad Bagani culture for military counter-insurgency and para-militarism. This has been continued by Otaza when he became a mayor of Loreto in 2010 and has since marked his repressive leadership.

6. Dario Otaza established and built intelligence networks within NPA territories in Agusan del Sur for purposes of counter-revolutionary operations of the AFP, including developing, maintaining, directing of assets for infiltration, espionage and sabotage.

7. Coercion and forcible recruitment of Lumads into paramilitary/bagani group, to serve as counter-revolutionary spies, coercing and directing them to commit armed actions against the revolutionary movement and unsparingly, against unarmed civilians.

Over the last four years, the Otazas have strengthened their fascist rule as staunch lapdogs and implementors of the US-Aquino Oplan Bayanihan, despite repeated warnings by the revolutionary movement and appeals by the suffering masses to stop their atrocious acts.

They remained unremorseful, adhered to counter-revolutionary practice and continued to be hostile towards the people while they engaged in land grabbing and plundered the natural resources for their personal wealth by engaging in environmentally destructive logging operations and mining activities in the already denuded residual forests of Agusan. Dario Otaza was also complicit in the sell-out of more than 30,000 hectares of lands in Loreto, Agusan del Sur to a foreign palm oil plantation company.

In refusing to rectify to return to non-violent civilian governance, they continue to employ and arm paramilitary and Bagani troops to secure and fortify their oppressive rule and bureaucrat-capitalist interest. Hence, the Otazas made themselves legitimate targets by the NPA.

In the case of Daryl Otaza, aside from directly participating in the commission of the above-mentioned crimes, he was a notorious drug lord in the town of Loreto and surrounding areas.

In waging the people’s war, the NPA has been pursuing revolutionary justice by meting appropriate capital punishment against war criminals to remove the continuation of the human rights violations and render justice.

 Truly, the masses rejoice in achieving revolutionary justice in the punishment of one of the most despotic anti-Lumad mayors in Mindanao!

Ang nahitabong panagsangka tali sa usa ka yunit sa NPA ug sa 58th IB-CAA sa Mat-I Claveria niadtong September 29 nag-obligar sa custodial unit sa pagdala kaniya ngadto sa relatibong layo ug mas luwas nga lugar. Dugang pa, ang nagapadayong rescue operations sa 58th IB matag karon ug unya mao ang rason sa gamayng kalangan sa iskedyul sa release.

Subli namong ipasalig sa iyang pamilya ug mga kahigalaan nga makapauli siya sa dili na madugay. Mapasalamaton kami sa local third party facilitators ug sa local crisis committee sa ilang paningkamot sulod sa kapin sa tulo ka bulan na karon nga walay paglunga sa pag-abag sa pamilya sa POW alang sa iyang release.

Nahitabo kini niadtong Oktubre 7, 2015, alas 2:30 sa hapon sa Brgy. Camagong, Nasipit, Agusan del Norte. Nakuha gikan kaniya ang usa ka kalibre .45 nga pistola ug personal nga mga gamit.

Usa ka aktibong armadong membro si Sulhayan sa lumad nga bandidong grupo nga Bungkatol Liberation Front – Task Force Gantangan (BULIF-TFG) ug luyo-luyo sa lider sa maong grupo nga si Eddie Ampiyawan, alyas Bawang. Aduna nay taas nga talaan sa mga krimen ang BULIF batok mismo sa ilang mga katribu ug sa katawhan. Gikaintapan kini nga grupo sa pagpangilog sa mga luna sa ubang mga Higaonon aron pasudlan sa logging ug ipamaligya ngadto sa mga lokal ug langyaw nga investor, pagpamatay sa mga lider-lumad ug mga membro sa tribu ug paghasi niadtong dili mopasakop sa ilang grupo. Alang sa pamilya ni Ricardo Sulhayan, gikasubo namo nga namatay ang inyong minahal sa ngalan sa interes sa kontra-katawhang kalihukan sa AFP nga nagtumong sa pagbungkag sa panaghiusa sa mga komunidad sa lumad nga nagadepensa sa ilang yutang kabilin ug mga demokratikong katungod. Kasamtangang anaa sa kostudiya sa usa ka yunit sa NPA ang iyang mga personal nga gamit nga naglakip sa iyang pitaka nga adunay P7,700, sundang, bag ug personal nga mga papeles. Itunol namo kini kaninyo agi sa istasyon sa radyo.

Sa laing bahin, usa ka lumad nga gihinganlang Serino Bustillo nga lumulupyo sa Sityo Malahoni, sa Barangay Camagong ang wala na igkita hangtud karon. Nawala siya sukad niadtong Oktubre 8. Padayon pang ginaimbestigahan ang mga sirkumstansya sa iyang pagkawala. Kini nga kaso dili makatarunganong gipasangil nga binuhatan sa NPA.

Sa susamang panghitabo, gipatay sila Eunilo Pitogo ug Cresencia Pitogo, mga sibilyang mamaligyaay og pan, sa mga sakop sa bandidong pundok ni Calpit Egwa ug Romeo Banusan sa Sitio Inagawan, Brgy. La Purisima, Prosperidad, Agusan del Sur ni adtong Oktubre 1, 2015. Gani, hangtud karon wala pa gihapon nakuha ang ilang lawas tungod kay mismo ang mga pulis nagpanagana pagsulod sa erya nga kontrolado sa army ug sa bandidong grupo ni Calpit. Sama sa nahitabo kang Serino Bustillo, gipasangil usab kini nga krimen sa NPA.

BTC Socio-Economic Office QIP turns-over two multi-purpose hall buildings in Zamboanga Sibugay

The Bangsamoro Transition Commission (BTC) Socio-Economic Office-Quick Impact Project (QIP) led the turnover ceremony of two multipurpose hall buildings in the Barangays of Pamintayan in Buug and Datu Tumanggong in Tungawan, Zamboanga Sibugay province on October 22 and 23, 2015, respectively. 

The project is under the Comprehensive Capacity Development Project for the Bangsamoro (CCDP-B) Public Service Delivery component, a partnership program of Japan International Cooperation Agency (JICA), BTC and the Bangsamoro Development Agency (BDA) in coordination with the Moro Islamic Liberation Front (MILF). 

In a turnover ceremony held at Datu Tumanggong, Engr. Muharin Ali, BTC-SEO CCDP-B Project Director said “This is the first in the Bangsamoro history that a project was endorsed by the MILF leadership that makes our constituents; the Bangsamoro people feel that the peace process is moving.”

“Hopefully if BBL is passed and eventually we will have our own government, there shall be more projects in all the Bangsamoro communities,” he added. 

Engr. Ali also assured communities outside the proposed Bangsamoro area not to lose hope as the Philippine Government as well as the proposed Bangsamoro government are committed to help them.

Engr. Ali is hoping that the Bangsamoro Basic Law (BBL) will be passed this year. “The government under President PNoy have not given up in pushing for the passage of BBL,” he pointed out.

Engr. Ali was accompanied by CCDP-B Project Manager Dr Norodin Salam and this writer, who is the Project Coordinators for Human Resource Development, Public Service Delivery, Bangsamoro Development Plan, and Institutional and Organizational Building.

Meantime, the BDA was represented by Project Management Officer Engineer Aida Silongan who talked on the QIP background and objectives during the brief ceremony. 

“These Quick Impact Projects are results of a meeting between the MILF Chair Al-hadj Murad Ebrahim and JICA President Akihiko Tanaka after the signing of Comprehensive Agreement on the Bangsamoro (CAB) on March 28, 2014 where they agreed to implement this kind of project for the Bangsamoro community so that they can to feel the dividends of peace,” Engr. Silongan disclosed.

Engr. Silongan said that on April 21, 2014, the JICA Headquarters and BTC signed a Memorandum of Understanding (MoU) in Manila to come up with implementing arrangement in coordination and collaboration with BTC, JICA-Cotabato Project Office and BDA.  

She requested the residents and the assigned peoples’ organization to take care of the building and use it for community activities. Engr. Silongan is also with BDA Zamboanga Peninsula (ZamboPen) staff.

JICA representative and QIP project officer Kasan “Jun” Usop Jr read the message of JICA President Tanaka and JICA-CPO head and chief leader Naoyuki Ochiai.

In the said message, JICA reiterated its commitment to help and support the Bangsamoro communities even without the BBL. 



The local government units of the municipality of Buug and Tungawan expressed their thanks and appreciations to the BTC, JICA and other stakeholders for identifying their communities as among the recipients of the Quick Impact Projects of the CCDP-B.  

Public Service Delivery Project Coordinator Nomaire Mustapaha said that other infrastructure projects under QIP will be turned-over in the next succeeding months. He also thanks the Dawing Construction who constructed the multi-purpose building in Zamboanga Sibugay, the LGUs, PNP, Military, CCCH and the MILF.

Last August 24, a 2-clasroom school building was also turned-over to residents and teachers of Kibleg, North Upi, Maguindanao where JICA President Tanaka and BTC Chairman, MILF peace panel Chief Mohagher Iqbal graced the event.

As part of confidence building, the JICA poured-in1.2 Billion Yen for the QIPs under the Comprehensive Capacity Development Project for the Bangsamoro.

UN Resident Coordinator Almgren pays visit to MILF leadership

Mr. Ola Almgren, the new United Nations Resident Coordinator for the Philippines made a courtesy call to leaders of the Moro Islamic Liberation Front (MILF) at their Administrative Headquarters in Camp Darapanan, Sultan Kudarat, Maguindanao on October 26. 

MILF Chairman Al Haj Murad Ebrahim , 1st Vice Chairman Ghazali Jaafar and members of the Central Committee gladly welcomed Almgren and his delegation who  travelled via Davao City to catch up with the mid-morning meeting. 

Mr. Almgren in his introductory statement said that, “I’m here to make a courtesy call and begin to understand the complexities of the area, and how U.N. can best serve the area”.

On behalf of the MILF Central Committee, Chairman Al Haj Murad expressed thanks and gratitude for the United Nations’ continued commitment of support to the GPH-MILF Peace Process. 

Moreover, he said, “The assistance that the different agencies of United Nations being provided to the Bangsamoro people are very worthy and meaningful. They (UN) have engaged in the Bangsamoro since the early stage of the peace process, and for these, we are very grateful”. 

Chairman Al Haj Murad gave some updates on the peace process, particularly mentioned were the challenges being faced in the implementation of the signed peace agreements due to the delayed passage of the Bangsamoro Basic Law (BBL) in Congress. 

Despite all the challenges, the MILF leadership is still optimistic that finally, a true and meaningful resolution of the Bangsamoro Question will be arrived at. Unmindful of the uncertainties of the BBL, the MILF is committed to continue with the peace process 

Updates on the status of Normalization process were also taken up.  UN’s experts and technical assistance in the aspect of normalization were humbly requested to Almgren. 

The necessity to make the people feel that something is happening on the ground brought about by the peace process were well-explained by the MILF Chairman. 

He told the U.N. Coordinator that even before the signing of the Comprehensive Agreement on Bangsamoro (CAB), the MILF had already agreed to the implementation of Socio-Economic programs in the conflict- affected areas.

After hearing those words from the MILF chairman, Mr Almgren commended the MILF for their sincerity in pursuing peace, for their patience and determination to remain in the right direction. “Another commendable thing is the support and coordination of MILF in the program of UNICEF for children”, he added.

1st Vice Chairman Ghazali Jaafar aired his personal opinion on the challenges posed by the peace process. Frankly he said, “If there is no implementation of the CAB, there will be no solution to the Mindanao problem”.

As the meeting winds up, happy for being in the area, Mr. Almgren thanked the MILF for their expression of confidence in the UN. Five persons were killed, including a 4-year-old girl, and two others were wounded in an ambush by unidentified gunmen in Barangay Dulangan, Datu Odin Sinsuat (DOS), Maguindanao on Monday afternoon, police said.

Chief Inspector Lindsy Sinsuat, DOS town police chief, said manhunt is still ongoing.

He identified the fatalities as Hajda Bai Lilang Ayunan, 50; Pinky Rose Ayunan, 28; a 4-year-old baby girl; Baby Boy Pasawilan, 21; all residents of Barangay Kalanganan Mother, Cotabato City and Kago Kasan, 30, driver of Matanog, Maguindanao.

“The relatives who claimed the victims’ remains told police it was triggered by a rido (family feud),” Sinsuat told reporters.

Two other relatives, Manawir Ayunan, 27 and Norhan Ayunan, 19, were wounded in the 4:30 p.m. ambush.

All the seven victims were on board a brand new red Toyota Innova (YS3539) from Gen. Santos City and heading back to Cotabato City when the suspects, on board a pick-up vehicle, overtook the Innova and opened fire using M-16 armalite rifle and cal. 45 pistol.

Police recovered empty shells for cal. 45 pistol and armalite rifle at the crime scene.

Quoting witnesses, Sinsuat said the suspects were allegedly tailing the Innova from Barangay Dalican, DOS until it reached Barangay Dulangan.

Police said all the five fatalities were killed on the spot.

Passersby rushed the two wounded persons to the hospital.

Witnesses also said that after the first gun bursts, the suspects alighted from the vehicle and fired more shots.

Sinsuat said police investigators are also looking at other possible motive aside from family feud.

The Pentagon confirmed on Monday its plans to patrol the South China Sea amid rising tensions between Washington and Beijing.

The US Navy will take the aggressive action of sailing within 12 nautical miles of Chinese territory.

Last month, a number of Pentagon officials floated the idea of sending naval ships into the South China Sea.

To protest Beijing’s construction of artificial islands in the Spratly archipelago, the US Navy said it would sail within the 12-mile territorial limit of those features.

"The United States will fly, sail, and operate wherever international law allows," US Defense Secretary Ash Carter said in a news conference last month.

On Monday, a US defense official confirmed to Reuters that such a plan will, in fact, take place – and soon.

Within the next 24 hours, the USS Lassen destroyer will be sent to patrol Chinese territorial waters near the islands and could also patrol artificial islands built by other nations.

"This is something that will be a regular occurrence, not a one-off event," the official said. "It's not something that's unique to China."

According to the official, the ship will likely be accompanied by a P-8A, the Pentagon’s most advanced spy plane, which has already been operating in the region to monitor Beijing’s construction progress.

China has repeatedly warned the US about aggressive action. Earlier this month, the Foreign Ministry urged "related parties not to take any provocative actions, and genuinely take a responsible stance on regional peace and stability."

"We will never allow any country to violate China’s territorial waters and airspace in the Spratly Islands, in the name of protecting freedom of navigation and overflight, ministry spokeswoman Hua Chunying said during a news briefing.

With nearly USD5 trillion in trade passing through its waters annually, the South China Sea is a highly contested region.

While China claims most of the sea, there are overlapping claims from Vietnam, Brunei, the Philippines, Malaysia, and Taiwan.

While the United States lays no claim in the region, it has criticized China’s land reclamation projects as a breach of international law.

"There are billions of dollars of commerce that float through that region of the world," White House spokesman Josh Earnest told reporters. "Ensuring the free flow of commerce…is critical to the global economy."

Beijing maintains that it has every right to build within its own territory, and that the islands will be used primarily for humanitarian purposes.

This isn’t the first time the US has sought to influence the region through naval patrols.

Both Vietnam and the Philippines have also built islands atop reefs in the Spratly archipelago in the past, and these too resulted in aggressive patrols by the US Navy.

A United States naval destroyer was approaching waters near the Spratly Islands in the South China Sea late Monday, the Pentagon said, directly challenging China’s claims that the artificial island chain is within its territorial borders.

 
The Lassen, a guided missile destroyer, was preparing to sail within 12 nautical miles of the islands, making a long-anticipated entry into the disputed waters, officials said. American officials did not inform their Chinese counterparts as they planned the provocative maneuver, saying that to do so would have undercut their message.
 
“You don’t need to consult with any nation when you are exercising the right of freedom of navigation in international waters,” John Kirby, the State Department spokesman, said at a news conference.
 
Mr. Kirby said that such a challenge to what he called a questionable sovereignty claim was “one of the reasons you have a navy — to be able to exert influence and defend freedom of navigation on international waters.”
 
China has been reclaiming land in the South China and East China Seas for several years, and the projects in the vicinity of the Spratlys have come under increasing criticism from the United States and its regional allies, including the Philippines. The United States and several Asian nations dispute the legitimacy of the islands built by China.
 
The Obama administration did not make an immediate announcement of the naval maneuver, and Pentagon officials would only confirm that it was planned, as they had forecast weeks ago.
 
The White House declined to share any details about the operation, referring questions to the Defense Department. But Josh Earnest, the press secretary, noted that President Obama had stood next to President Xi Jinping of China at a Rose Garden news conference last month and said that the United States would operate, fly or sail anywhere that international law allowed.
 
“That certainly includes the ability of our Navy to operate in international waters,” Mr. Earnest said. “This is a critically important principle, particularly in the South China Sea, because there are billions of dollars of commerce that flow through that region of the world every year — maybe even more than that — and ensuring the free flow of this commerce, and that freedom of navigation of those vessels is protected, is critically important to the global economy.”
 
 
American officials had said for the last month that the Navy would send a surface ship inside the waters claimed by China, a vow widely viewed as a signal to the Chinese that most of the rest of the world does not recognize its claim on the island chain. Mr. Obama approved the move this month, administration officials said.
 
The president signaled the Navy maneuver last month at the annual meeting of the United Nations General Assembly, when he said that the United States had an “interest in upholding the basic principles of freedom of navigation and the free flow of commerce and in resolving disputes through international law, not the law of force.”
 
Defense Secretary Ashton B. Carter has said repeatedly that the United States military will operate where international law allows.
 
China, in what some Asia analysts interpreted as a gesture to pre-empt the American naval maneuver, sent warships into United States territorial waters in August. Five Chinese ships came within 12 miles of the coast of Alaska while Mr. Obama was visiting the state.

But American military officials said that the two maneuvers were not comparable, citing international maritime laws that allow passage such as the Chinese transit near Alaska if there was no other passageway for a ship to reach its destination.
 
In the case of the Spratly Islands, one American military official said, there were several other routes that the United States destroyer could have used, but the military deliberately chose to enter the waters that China claims as its territory.
 
In recent years, China has been claiming large parts of the strategic waterway by enlarging rocks and submerged reefs into islands big enough for military airstrips, radar equipment and lodging for soldiers, American officials said.
 
Although China claims much of the South China Sea as sovereign territory, the 12-mile zone around the new islands is particularly delicate because international law says that artificial islands do not have sovereign rights up to the 12-mile limit.
 
The United States has not traveled close to the Chinese-occupied islands in the South China Sea since at least 2012. In May, a United States Navy surveillance plane flew near three of China’s five artificial islands but did not go within the 12-mile zones.
Chinese Navy radio operators warned the Americans to leave the area.

THE MORO Islamic Liberation Front (MILF) in an editorial chided Congress for the delay in the passage of the proposed Bangsamoro Basic Law (BBL).



“If we say, it is Congress’ responsibility, we mean it as a body or collectively. We know that there are many lawmakers in both chambers of Congress who are pushing for the passage of the BBL, especially Speaker Feliciano Belmonte, Jr. and Senate President Franklin Drilon. But so far, their collective efforts are not enough to pass the BBL in three previous attempts,” said the editorial titled, “Congress Has BBL’s Destiny” posted on the MILF Web site, Luwaran.net.

“This is not a finger-pointing exercise. Except those clearly spoiling the BBL in the House and in the Senate, we are not faulting anyone. But whatever is the reason, if the BBL does not pass Congress, it is Congress that did not deliver,” the editorial also said.

“If we examine closely why the BBL is not moving fast in Congress, the main reasons for this, borrowing the view of Cardinal Orlando Quevedo, are the fears, prejudices, hatred, and even paranoia of the majority population of the Moros in Mindanao.”

“These negative views or perceptions by the majority are not only felt by these lawmakers who are deliberating the BBL but also shared by some of them,” the editorial added.

Congressional hearings on the proposed law, setting up the mechanisms for autonomy in Mindanao on the MILF’s watch, started in September last year. But the draft BBL became mired in the aftermath of the Jan. 25 police operation in Mamasapano, Maguindanao, which led to the deaths of 44 members of the Special Action Force in the hands of fighters of the MILF and the Bangsamoro Islamic Freedom Fighters.

This incident turned into the biggest controversy to rock the administration of President Benigno S. C. Aquino III, of whom the editorial, without any reference to Mamasapano, also said: “We still firmly believe that the BBL can still be pass under his close watch. He still has our trust and confidence safely intact.”

Both the Senate and House versions of the proposed law -- a departure in many areas from the original draft by the MILF and the Office of the President -- are pending second reading.

The latest deadline by Congress to pass the BBL is Dec. 16. Congress will resume sessions on Nov. 3.

The military on Monday tightened security in areas vulnerable to attacks by bandits following Saturday's harassment of an Army detachment in Mamasapano that left three soldiers wounded.

The victims belong to the Army's 34th Infantry Battalion, which has jurisdiction over Mamasapano town in the second district of Maguindanao.

They were inside their roadside detachment in Barangay Linantangan in Mamasapano, which suspected motorcycle-riding members of the Bangsamoro Islamic Freedom Fighters (BIFF) fired with assault rifles and shoulder-fire, 40-millimeter grenades.

Police investigators are still trying to establish the exact identities of the bandits responsible for the attack.

Barangay officials said the culprits are henchmen of the BIFF's new figurehead, Imam Bongos.

Bongos assumed the group's leadership following the demise early this year of its founder, Imam Ameril Ombra Kato, after a long bout with complicated illnesses.

Saturday's harassment by the BIFF of an Army detachment in Mamasapano came less than a week after bandits attacked from different directions a military outpost in nearby Barangay Sambulawan in Salibo town, also in Maguindanao.

Two innocent villagers were hurt when BIFF bandits crawled near the detachment of the 21st Mechanized Company of the Army's 2nd Mechanized Battalion in Barangay Sambulawan and opened fire with assault rifles.

A measure providing members of the Armed Forces of the Philippines (AFP) and the Philippine National Polyice (PNP) free legal assistance has been filed at the House of Representatives.

House Bill 6026 or “an act providing free legal assistance to any officer or enlisted personnel of the AFP and the PNP on any charge before the prosecutor’s office, court, administrative or any competent body arising from an incident or incidents related to the performance of official duty and appropriating funds therefor,” authored by Nationalist People’s Coalition Rep. Felix William B. Fuentebella of Camarines Sur, had been referred to the Committee on National Defense for appropriate action.

Under HB 6026, the Secretary of Department of Justice (DOJ), the chief of staff of the AFP, the chairperson of the National Police Commission (Napolcom) or the chief of the PNP shall authorize any lawyer or lawyers of their respective agencies to provide free legal assistance to any officer or enlisted personnel,” Fuentebella said.

The proposal also provides the cost of implementing the measure shall be charged against the appropriation of the DOJ, AFP, Napolcom and PNP the year following its enactment into law and thereafter.

The DOJ, in coordination with the AFP, Napolcom and the PNP, shall issue the necessary rules and regulations to implement the proposed statute.

In filing the bill, Fuentebella said that like any other sector of society, the ordinary members of the military and police, officers and enlisted personnel, should not be denied access to legal assistance.
“In our country, most people may construe the law as favoring the rich over the poor,” he said.

The author also said ordinary citizens, like some officers and enlisted personnel of the AFP and the PNP, are often unable to engage the services of a lawyer due to the prohibitive cost of legal services and defend themselves against charges related to the performance of their official duties.

“Without justice, no one can feel secure.  Without security, there can be no faith.  Without faith, there can be no peace.  And without peace, this nation may perish,” said Fuentebella, quoting former Vice President Salvador P. Laurel.

A young Philippine Army officer, a graduate of the Philippine Military Academy (PMA), was killed in a clash with New People’s Army rebels in San Jose, Occidental Mindoro on Sunday, the Armed Forces of the Philippines Southern Luzon Command (Solcom) reported on Monday.

Maj. Angelo Guzman, spokesperson of Solcom, based in Camp Nakar here, identified the slain soldier as Lt. Mike Nollora, commander of Company B of the Philippine Army’s 4th Infantry Battalion based in Occidental Mindoro.

Nollora, 28, belongs to PMA class 2009, according to Lt. Col. Randolf Cabangbang, spokesman of the Army’s 2nd Infantry Division.

The slain officer was married and had two young children and hailed from Panabo City, Davao del Norte, he said.

Guzman said the slain Army officer was leading his men in a security patrol when the soldiers encountered the group of rebels.

Guzman said Nollora sustained severe gunshot wounds on his left thigh while his troops were engaged in a fierce fight with a group of about ten rebels sometime around 9:30 a.m. in the remote village of Batasan in San Jose town.

Nollora was given first aid but died one and half hour later.

“He was extricated from the battle site but he did not make it before the arrival of the helicopter that would take him to the nearest hospital,” Guzman said.

His body was airlifted to the Army’s general headquarters in Fort Bonifacio in Taguig City and was later brought to the mortuary of the Libingan ng mga Bayani, said Cabangbang.

Solcom commander Lieutenant General Ricardo Visaya, in a statement, paid tribute to the bravery of the slain Army officer.

“It is saddening that we lost a young commander and good officer while serving and protecting the people of Occidental Mindoro,” Visaya said.

Visaya vowed to continue staging military operations in Occidental Mindoro to bring peace to the island.

It was only on Oct. 8 when the other half of Mindoro Island, the province of Oriental Mindoro, was declared by the military and local officials as “Conflict Manageable and Ready for Further Development” (CMRFD) due to dwindling number of communist rebels operating in the area.

Guzman has then said there were only 36 armed guerillas now left operating, mostly in Occidental Mindoro, due to the continuous police and military operations.

On Oct. 14, five suspected NPA rebels believed to be from Mindoro were killed in an encounter with government troopers in Nasugbo, Batangas.

The slain rebels were believed to be part of a guerilla unit from the island that had moved to Batangas in preparation for the collection of the so-called “permit to campaign” fee from local candidates in the 2016 elections.

Three days later, the NPA retaliated and killed two soldiers in an ambush in Calaca town, also in Batangas province.

There is still hope that the Bangsamoro Basic Law will be passed by Congress in December, so that a plebiscite may be held in February next year.

Miriam Coronel-Ferrer said that even though the Comelec is busy preparing for the May 2016 national and local elections, the members of peace panel are in constant communication with the poll body to ensure that once the Bangsamoro Basic Law is passed, the plebiscite will be held in the soonest time possible  “probably in February 2016 if BBL is passed in December.”

Signed on 27 March 2014, the CAB is the final political settlement that consolidates all the agreements by the Government of the Philippines (GPH) and the Moro Islamic Liberation Front (MILF) and effectively puts an end to the 17 years of negotiations and conflict between both parties.

The fate of the envisioned region now hangs in the balance as the Senate and the House of Representatives have set December 16 as their new deadline for the passage of the proposed BBL.

She said delay in the passage of the proposed Bangsamoro Basic Law (BBL) will impede some of the targets in the Comprehensive Agreement on the Bangsamoro (CAB), including the holding of a plebiscite to determine the geographical scope of the Bangsamoro.

Ferrer said the components of the CAB are interrelated so that a delay in the legislative track will also affect the implementation of its other integral elements.

“Halimbawa, bagama’t matagal na nating pinaghahandaan at nakausap na rin natin ang Comelec (Commission on Elections) para sa paghahanda sa plebisito, di ka naman pwedeng mag-plebisito kung wala ka pang batas,” Ferrer said.

(For example, a plebiscite on the BBL cannot be held without legislation even as we continue to prepare for this and hold talks with the Comelec.)

In the meantime, both panels are busy with other activities related to the peace agreement. “Dahil ang ating peace agreement naman ay comprehensive, marami pang ibang aspeto yan, lalo na kaugnay nung normalization (process),” she said.

(Our peace agreement is comprehensive, and includes other aspects, especially with regards the normalization process.)

Among these activities are the convening last week of the independent decomissioning body that oversees the process of decommissioning the weapons and combatants of the MILF, according to Ferrer.

She said socio-economic programs are also being laid down or rolled out in anticipation of the eventual passage into law of the proposed BBL.

Ferrer was the guest on Friday at the Kapihan sa Media ng Bayan held at the Philippine Information Agency (PIA) building. Media ng Bayan comprises government media including Philippine Broadcasting System-Radyo ng Bayan, People’s Television, Philippines News Agency and PIA.

Police Regional Office 13 officials assured a fair and deeper probe on the death of two Special Counter-insurgency Operation Unit Training (SCOUT) trainees who collapsed during their road run at 4:45 p.m. on Thursday, last week.

According to the reports reaching the regional headquarters here on Monday from the Regional Special Training Unit (RSTU) 13, based in Barangay Poblacion 2, Santiago town in Agusan del Norte, the two trainees were identified as PO1 Dan Angelo C. Manpatilan, 22; a resident of Purok 2, Barangay Taligaman, this city and PO1 Ernesto R. Bajado, Jr., 26; a resident of Purok 1, Barangay Taligaman Patin-ay, Prosperidad, in Agusan del Sur.

The trainees, according to the said report, belonged to SCOUT Class 56-2015 undergoing training at the said regional special training unit camp.

PO1 Bajado and Manpatilan were rushed to Santiago Rural Health Unit after first aid were administered to them. Thereafter, they were referred to Cabadbaran District Hospital, Cabadbaran City and were later transferred to MJ Hospital, this city.

Both were confined at the intensified care unit (ICU) of the said hospital, but PO1 Bajado was declared dead at 1:25 a.m. due accordingly to “heatstroke” by the attending physician Dr. Janet Santiago on October 23. His remains now lie at a funeral home in Patin-ay, Prosperidad in Agusan del Sur. The police report said that PO1 Manpatilan remained at the ICU, for the same findings.

On Sunday, 5:30 p.m. PO1 Manpatilan was transferred to Polymedic Medical Plaza at Cagayan de Oro City with his parents and medical team led by Dr. Angel Antonette Devocion on board an ambulance. Unfortunately, the said policeman also passed away at 5:00 a.m. Monday.

Police Regional Office 13 formed a team composed of personnel from the Regional Investigation and Detective Management, Legal Officer and Medical personnel, who are now at RSTU conducting further investigation on the incident.

Eight personnel from the Regional Public Safety Battalion who were members of the training staff were relieved and restricted at the battalion headquarters while the investigation is going on.

Police Regional Office 13 leadership assures the families of the two casualties of a fair investigation. If it will be found that there are lapses on the part of the concerned training staff, they will be held accountable for their actions and will be charged accordingly, the police report said.

Around 886 families were displaced in a two-hour fire that hit Sunday afternoon downtown Jolo, the capital of Sulu, a top military official said.

Brigadier General Alan Arrojado, Joint Task Group Sulu commander, disclosed the fire broke out around 2:15 p.m. Sunday at the Serrantes public market in Barangay Walled City.

Arrojado said the fire razed 886 houses as it rapidly spread to the nearby residential area of Barangay Chinese Pier.

However, he said that the public market was not affected by the fire.

Arrojado said the fire was contained two hours later by firefighters of the Bureau of Fire Protection (BFP) backed by policemen, soldiers, civilians and Air Transportation Office personnel.

He said the origin of the fire is still being determined by BFP investigator.

Meanwhile, Arrojado said Sulu Governor Abdusakur Tan II has distributed on Monday sacks of rice to each of the 886 displaced families.

He said relief goods were also distributed to the affected families by the Sulu Provincial Women's Council (SPWC).

CAMP GEN MATEO CAPINPIN, Tanay -- The 2nd Infantry Division (2ID) of the Armed Forces of the Philippines (AFP) announced today the death of a soldier in an encounter with Communist terrorists while on security patrol in San Jose, Occidental Mindoro on Sunday.

According to official statement of the 2nd Infantry Division the victim was 1st Lt. Mike Nollora of the 4th Infantry Battalion, 2ID.

It said the platoon led by the victim was conducting security patrol in at Dayaga Area, Batasan Village, San Jose when fired upon by more or less 10 Communist terrorists and a firefight ensued for some 10 minutes before the rebels escaped.

The remains of Nollora was already transported to the mortuary of the Libingan ng mga Bayani in Fort Andres Bonifacio, Taguig City.

Major General Romeo Gan, commander of the 2ID, extended his deepest sympathy and condolences to the bereaved family and assured that all benefits will be accorded to the dependents the soonest possible time.

Gan also condemned the act of terrorism as he ordered to conduct massive operation to get the perpetrators.

Malacanang welcomes and supports calls by local government units (LGUs) in the National Capital Region (NCR) to stop the violence against Lumads in Mindanao, Communications Secretary Herminio Coloma Jr. said on Sunday.

The Palace official issued the statement during an interview over government-run Radio ng Bayan, saying he was informed that some LGUs in Metro Manila have passed resolutions regarding the situation of the indigenous people in the south.

“Nakikiisa ang ating pamahalaan sa lahat ng panawagan sa pagpigil sa karahasan laban sa ating mga kapatid na Lumad sa Mindanao. Ipinagpapatuloy ng pamahalaan ang pagtataguyod ng kaunlaran at kapayapaan sa lahat ng mga lugar na apektado upang matiyak ang patuloy na paghahatid ng serbisyo publiko ng ating mga lingkod-bayan,” said Coloma.

“Maaalalang noong nakaraang linggo, mariing kinondena ng pamahalaan ang pagpaslang kay Mayor Dario Otaza ng Loreto, Agusan del Sur, isa sa mga matibay na nagtataguyod sa prosesong pangkapayapaan at pangkaunlaran ng mga Lumad at Manobo communities,” he further said.

Coloma also stressed that the national government is using its resources to ensure peace and order in indigenous communities.

“Gusto natin na mabatid at maunawaan ng mga lokal na pamahalaan sa iba’t ibang bahagi ng ating bansa na ang buong pamahalaan ay ginagamit ang mga resources nito para itaguyod ang katahimikan, kaayusan at kapakanan ng ating mga kapatid na katutubo o indigenous peoples o Lumad communities sa Mindanao,” he added.

Marikina City is the first LGU in Metro Manila to urge the government to stop the attacks against Lumads through Resolution No. 15-235, which was approved by the 14-member city council on Oct. 14.

Principally sponsored by Councilor Joseph Banzon, the resolution condemns the series of Lumad killings in Mindanao and the destruction of their indigenous culture.

Other LGUs which are taking action on the plight of the Lumads are Quezon City and Caloocan City.

An Army lieutenant was killed during an encounter with 10 New People's Army (NPA) rebels in Barangay Batasan, San Jose town, Occidental Mindoro on Sunday morning.

Southern Luzon Command spokesperson Major Angelo Guzman identified the slain officer as 1st Lt. Mike G. Nollora, commander of Bravo Company of the 4th Infantry Battalion.

The clash took place 9:30 a.m. Nollora was wounded in the left thigh during the 10-minute encounter.

The victim and his men were conducting a security patrol when the encounter took place.

Guzman said first aid was given to Nollora prior his transport to casualty collection point.

However, the victim expired of his wounds at 11 a.m.

203rd Infantry Battalion commander Col. Gevin Edjawan directed pursuit operations.

"It is saddening that we lost a young commander and a good officer while serving and protecting the people of Occidental Mindoro," Southern Luzon Command head Lt. Gen. Ricardo R. Visaya said.

He added that they will continue its focused military operations in Occidental Mindoro to win the peace in the island.

The Cagayan De Oro-based 4th Infantry Division is questioning the presence of an International Fact Finding Mission (IFFM) in Surigao Del Sur who will allegedly look into the killing of three people in Lianga town of the above-mentioned province.

The IFFM visit started Oct. 26 and will end on the 30th.

"It came to our attention that there is an IFFM in the area of Surigao Del Sur this October 26 until the 30th of October.

"Accordingly, the activity is supposed to validate, strengthen and amplify the issues regarding the killing of three people in Sitio Han-ayan, Brgy Diatagon, Lianga, Surigao Del Sur last September 1, 2015 and the forced evacuation of around 3,000 people in parts of four municipalities to the Provincial Sports Complex in Tandag, Surigao Del Sur," the 4th Infantry Division said in a statement.

"We question the motives of this activity. We know for a fact that our government has already made its probe on the issues. The Senate Committee on Peace, Unification and Reconciliation and Senate Committee on Justice and Human Rights chaired respectively by Senator Teofisto Guingona III and Senator Aquilino Pimentel III have already conducted its inquiry in aid of legislation. Currently, the National Prosecutorial Service-National Bureau of Investigation Task Force on Extra Judicial Killing is also conducting its investigation. On our part, the Armed Forces of the Philippines support the Law Enforcement Operations of the Philippine National Police through Joint Task Force “Bangkaw” on apprehending the perpetrators. This proves that our government is doing everything to give justice to the victims and bring back the normalcy in Surigao Del Sur.

"Hence, we question the intent of the International Fact Finding Mission. First, we are questioning the legality of its mandate of investigating. Does this body have the authority for this inquiry? More particularly, do representatives from other countries or international organizations who will take part in this body have sought clearance or gain approval from the Department of Foreign Affairs.

"No matter what country the representatives of this mission came from, we are one with you on calling for justice for the victims of this incident. But it must be place on the context of respect for our country’s sovereignty and laws.

"If this is not respected, then, we are allowing them to disregard our sovereignty, make a mockery of our laws and to disrepute our government institution.

"Second, why does this international fact finding mission limits its supposed investigation on the incident in Lianga, particularly the killing of three people at Sitio Han-ayan.

"Why not include the other 357 Lumads who lost their lives on the hand of NPA atrocities. Why did they not include investigating the brutal killing of Mayor Dario Otaza, Datu Cadoy Sulhayan of Imbahandi, Nasipit and Datu Sandigan of Talaandig Tribe of La Paz, Agusan del Sur, who are also Lumads," the statement added.

The Philippine National Police on Monday assured it is in the thick of preparations to ensure safety of the delegates of the Asia Pacific Economic Cooperation Summit (APEC) in November.

”The final preparation for security and peace and order is underway. This week, there will be a series of activities once more making sure all areas -- maritime, air, and road security, billet, venues are properly secured,” PNP Chief Director General Ricardo Marquez Marquez told reporters.

He noted that APEC security preparations are similar to those laid out during the visit of Pope Francis in the country early this year.

”May mga similarities ang gagawin natin. When we move heads of state, normally we close the road that we will use, unlike the Pope when he was the only VIP,” he said.

He added that security preparations, which started late last year, is now in full swing as the APEC Economic Leaders Meeting, set on November 17-20, 2015, is fast approaching.

Marquez said there is no plan to cut off the cellphone signals but the PNP has increased their target hardening measures in places frequented by foreign tourists to secure and protect everyone during their stay.

”No plan yet… So the restrictions on the road, restrictions on road travel, restriction on communication are still being studied. We'd like to make sure that it costs least convenience to our citizens at the same time making sure our visitors, our VVIPs, seven thousand of them are also well secured,” he said.

Marquez said they also coordinate with their foreign counterparts for the security preparations.

”Since three months ago, coordination with our foreign counterparts are ongoing to make sure that they know what to do when they are here. To make them feel that their principals are secured when they visit our country come November week,” said Marquez.

Asked if there are special concerns aired by foreign counterparts, Marquez said that there is none so far.

"When we do security operations for APEC, there are standards implemented in other countries hosted. APEC would be the same standards that we are going to do here (and) there is a special group, the diplomatic security group that attends to special concerns,” he said.

”Those APEC leaders are our visitors. I would like to appeal once again, just like what we did during the arrival of the Pope last January, that we are all supposed to be hosts here and make sure we show our best side when the 21 heads of economies come,” he added.

The APEC Summit, to be attended by world leaders, is an important platform to showcase Manila and the Philippines as a viable economic, financial, and investment hub for foreign visitors.

APEC consists of 21 member-economies including developed and developing countries namely: Australia, Brunei Darussalam, Indonesia, Japan, South Korea, Malaysia, New Zealand, the Philippines, Singapore, Thailand, Canada, United States, Chinese Taipei, People’s Republic of China, Hong Kong, Mexico, Papua New Guinea, Chile, Peru, Russia, and Vietnam.

Member economies aim to provide an avenue in creating and maintaining sustainable economic growth and prosperity in the region by providing the stakeholders an arena to exchange ideas, opinions, concerns, and plans.
