Describing it as barbaric and desperate, the Philippine Army (PA) condemned “at the highest level” the terrorist Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP-NPA-NDF) for its continuous use of anti-personnel mines (APMs), especially its recent attack in Jipapad, Eastern Samar that left three persons dead and scores wounded.

“The continuous use by members of the terrorist NPAs of anti-personnel mines that have been banned since 1997 is a blatant violation of International Humanitarian Laws (IHL) and displays the true nature of the CPP-NPA-NDF -- lawless terrorists and cowards who attack unarmed soldiers and off-duty Citizen Armed Force Geographical Unit (CAFGU) active auxiliaries doing non-combat duties,” Maj. Gen. Pio Diñoso III, 8th Infantry Division commander, said in a statement on Thursday.


Diñoso said the CPP-NPA-NDF used APMs in the killing of T/Sgt. Junar Carpila and CAFGU members Mark Donald Lomuntad and Geremias Etcobanas. Six others were also wounded.

He said "these are the latest acts of desperation by the CTGs (Communist Terrorist Groups)" which took place near an under-construction military detachment located at Sitio Cabatas in Barangay 4 on Wednesday.

The military said the wounded -- Edwin Adamero, Francis Legarse, Manny Maestre, Ronilo Porton, Jeffrey Pajanustan and Helbert Pajanustan, are all militiamen.

An undetermined number of communist rebels were also believed killed and wounded in the ensuing firefight.

“This recent attack is a desperate act of these terrorists as the campaign to defeat them has reached an irreversible stage. With their backs against the wall, it is expected they will resort to their old barbaric ways,” he stressed.

He assured the people of Eastern Visayas that the government’s campaign using the whole-of-nation approach to end the communist insurgency is very effective and on track.

“Let this small setback further strengthen our resolve to finally put an end to the CPP-NPA-NDF and make the region attain the just and lasting peace it aspires for. With that, our soldiers' ultimate sacrifices will not be in vain,” Diñoso added.

The use of both manufactured and improvised APMs, including improvised explosive devices (IED), are prohibited under IHL as they do not discriminate between innocent civilians and combatants.

The Armed Forces of the Philippines (AFP) has so far recorded more than 141 incidents involving production, stockpiling, transporting and use of these banned weapons by the NPA, injuring or killing more than 30 civilians.

The NPA earlier categorically admitted to killing university football player Kieth Absalon and a relative last June 6 in Masbate City by detonating an improvised APM while they were biking.

The CPP-NPA is listed as a terrorist organization by the United States, the European Union, the United Kingdom, Australia, Canada, New Zealand, and the Philippines.

Nilantad ng Qurium Media, organisasyon sa cybersecurity na nakabase sa Sweden, sa isang ulat noong Hunyo 22 na ang Armed Forces of the Philippines (AFP) at Department of Science and Technology (DOST) ay nasa likod ng mga distributed denial-of-service (DDoS) attack sa mga grupong Bulatlat, Altermidya at Karapatan. Nagsimula ang mga atake noong kalagitnaan ng Mayo at rumurok noong kalagitnaan ng Hunyo at nagpapatuloy hanggang sa kasalukuyan. Sa DDoS, dinudumog ng ilang milyong pumapasok sa website para bumagal ito.

Kasabay din nito ang mga DDoS attack sa website ng Philippine Revolution Web Central (PRWC sa https://cpp.ph) na nagdulot ng panaka-nakang pagkawala nito. Ginamit naman ng AFP ang mga pekeng akawnt sa Twitter para itulak ang kumpanya na ipasara pansamantala ang akawnt ng PKP (@prwc_info) at tuluyang hadlangan ang upisyal nito sa impormasyon (@marco_cpp).

Ayon sa Qurium, ang mga IP address na ginamit sa mga pag-atake ay direktang nakaugnay sa upisina ng militar sa Taguig City, at sa proyektong Philippine Research, and Government Information Network ng DOST. Pinaiimbestigahan ngayon sa Kongreso ang insidente.

Sa Samar, matagumpay na napalayas ng BHB-Northern Samar ang mga tropa ng 20th IB na naglulunsad ng Retooled Community Support Program (RCSP) sa mga barangay ng Epaw at Sag-od sa Las Navas. Noong Hunyo 18 hanggang 19, inisnayp ng mga Pulang mandirigma ang mga sundalong nag-ooperasyon sa Barangay Epaw. Inaresto ng mga pulis noong Hunyo 25 sina Dana Marie Marcellana at Christian Relao sa San Diego, San Pablo, Laguna. Sinampahan ang dalawa ng gawa-gawang kasong rebelyon at illegal possession of firearms.

Sa Agusan del Sur, dinakip ng 8th Special Forces Company ang isang 12-taong gulang na bata sa Sityo Marang, Barangay Mabuhay, Prosperidad noong Hunyo 4. Bago nito, walang patumanggang pinaputukan ng mga sundalo ang mga nag-aani ng mais sa sakahan sa naturang sityo kung saan dalawa ang nasugatan. Kabilang sa mga nag-aani ang 12 bata.

Pananakot. Iligal na hinalughog ng mga sundalo at pulis ang pitong bahay ng mga kasapi ng Trinidad-Talibon Integrated Farmers Association sa Trinidad, Bohol noong Hunyo 27 at Hunyo 28.

Camp Navarro, Calarian, Zamboanga City – Six members of the Bangsamoro Islamic Freedom Fighters laid down their arms and yielded to the military in Cotabato on July 7, 2021.

According to Lt. Gen. Corleto Vinluan, Jr., Commander of Western Mindanao Command, subject personalities handed over one M16 rifle, two M14 rifles, and three rocket-propelled grenades with three ammunition to Brig. Gen. Roberto Capulong, Commander of 602nd Infantry Brigade and Lt. Col. Rommel Mundala, Commander of 90th Infantry Battalion.

Said personalities were subsequently presented to Pagalungan Mayor Salik Mamasabulod. “These six are members of the BIFF-Karialan Faction,” said Lt. Col. Mundala. During the initial debriefing, the six were identified in the following aliases: Alex, Kaliya, Bernie, Nasser, Abdul Adies, and Datu.

Custodial debriefing is currently being conducted to gather more information such as their real names and their reason for surrender. “The surrender of the six is a result of the joint efforts of the 602Bde, 90IB, Pagalungan Municipal Police Station, and the AFP and PNP intelligence units,” said Brig. Gen. Capulong.

Meanwhile, troops of the 34th and 90th Infantry Battalions under the 602nd Infantry Brigade, together with the personnel of the Philippine Drug Enforcement Agency-12 conducted law enforcement operations to serve search and arrest warrants against Ronnie Mangansakan and his cohorts for violation of Section 11 of RA 9165.

While operating troops were approaching the target’s house in Barangay Macasendeg Pikit, Cotabato at about 6 a.m. July 8, 2021, Mangansakan and his cohorts opened fire which prompted the government forces to retaliate. Firefight ensued which lasted for 30 minutes and resulted in the deaths of two personalities identified as Ronnie Mangansakan and Banji Mangansakan. The operation also resulted in the arrest of Gotires Antipolo and Nissan Aliudin Mangansakan.

“Drugs have been an identified culprit that enhances the confidence of its users to commit different kinds of crimes. As long as drug traffickers are active, the drug supply will always be available- and the negativities it brings about will never end. We all know how dangerous illegal drugs are to our society. With the neutralization and capture of these drug operators in today’s LESO, we are not only eliminating the drug supply in our area but also eliminating the security risks that the drug users might commit,” said Brig. Gen. Capulong.

While searching the area, troops recovered one M14 rifle with magazine, five live ammunitions of 7.62 caliber, three fired cartridges of 7.62 caliber, four fired cartridges of 5.56 caliber, one M16 rifle with magazine, one M203 grenade launcher, one caliber 7.62 Barret, and one transparent plastic container with nine large, ten medium, and five small heat-sealed transparent plastic sachets of suspected shabu with a total of more or less 200 grams and DDB value of PhP1, 360,000.00.

Maj. Gen. Juvymax Uy, Commander of Joint Task Force Central lauded the effort of the units involved in the operation.
According to him, illegal drugs are among the primary concerns in the area of central Mindanao. With the consistent and productive effort of the units under his jurisdiction, notorious drug operators are being neutralized and arrested in line with the peace and security goals of Kampilan.

Seized and confiscated items were turned over to PDEA-12, the cadavers to the barangay officials of Macasendeg, and the arrested personalities to Pikit Municipal Police Station for proper disposition. Lt. Gen. Vinluan, Jr. commended the troops of the Joint Task Force Central for the job well done.

“We relentlessly support our partners in the conduct of law enforcement operations particularly in the war against illegal drugs in support of the government’s campaign,” said Lt. Gen. Vinluan, Jr. “I enjoin all the troops to remain steadfast in fulfilling our mandate for our fellow Filipinos and our country,” he added.

CAMP ELIAS ANGELES, Pili, Camarines Sur-Upon witnessing the heinous crimes committed by the Communist Terrorist Group (CTG) against their fellow Masbateños, members and supporters of the terrorist group in Masbate continue to surrender in droves.

In Barangay Balete, Aroroy, another five regular NPA members yielded to the Army and PNP on Tuesday, July 6, bringing with them one high-powered and two low-powered firearms as well as six anti-personnel mines.

The influx of surrenderers in the island province started after the CTG’s gruesome killing of the FEU’s football player, Kieth Absalon and his cousin, Nolven last June 6.

From June 18-28, a whopping 505 CTG members and supporters surrendered followed by another 16 last July 2 who also turned in assorted firearms including a KG9 submachine gun.

Lt. Col. Siegfried Felipe Awichen welcomed the non-stop snowballing of surrenderers in the province.

“This unstoppable surrender of CTG members and supporters proves that the communist insurgency in Masbate is on the verge of collapse. The Army troops in Masbate, particularly the 2nd Infantry (Second to None) Battalion will be relentless in its combat operations to hunt the remnants of the terrorist group.” Lt. Col. Awichen said.

Col. Aldwine Almase, Brigade Commander of 903rd Infantry Brigade, on the other hand, said that while the surrenderers continues to surge, stringent measures are being implemented by security forces in Masbate to prevent the CTG from recruiting and deceiving new members.

“For sure, they will try to look for new members. But it is unfortunate for them because Masbateños have seen their true color and they can no longer be deceived by this terrorist group’s falsehood,” Col. Almase said.

MGEN HENRY A ROBINSON JR PA, Commander of Joint Task Force (JTF) Bicolandia underscored that the improved delivery of basic services and promotion of good governance in communities insulate the local populace from communist infiltration.

“The reason why the CTG will never win this fight is because the issues that they usually exploit to discredit the government are now being addressed through the localized implementation of the Whole-of-Nation Approach. Services and development projects are brought to the communities including those in far-flung and vulnerable areas. Ibig sabihin, wala ng puwang sa lipunan ang CTG at laos na rin ang kanilang mga black propaganda kaya hindi tayo titigil sa ating kampanyang tuluyang puksain ang insurhensya,” MGen. Robinson added.

It can be recalled that mass uprising against the CTG is also gaining ground in Masbate while there is also a steady increase in the number of barangays and municipalities declaring them as persona non-grata.

Camp Navarro, Calarian, Zamboanga City – July 8, 2021

The Western Mindanao Command attained substantial gains in the campaign against terrorism and lawlessness in its area of operation.

This was proven true during the 1st-semester campaign assessment and command conference held at the conference room in Camp Navarro, Calarian, this city on July 7, 2021.

Said conference was presided by WestMinCom Commander Lt. Gen. Corleto Vinluan, Jr., and was participated in, either physically or virtually, by the JTFs and OPCON unit commanders.

Based on the summary report of the campaign against the local terrorist groups (LTGs), the command has neutralized a total of 114 Abu Sayyaf Group members and seized 72 firearms during the 1st semester covering the period from January to June 2021.

Likewise, 104 members of the Bangsamoro Islamic Freedom Fighters were neutralized and 77 firearms were seized. 11 of the neutralized LTG personalities are high-value targets (HVT).

Meanwhile, on the campaign against the communist terrorist group, the command has neutralized a total of 64 members and seized 69 firearms.

Overall, through the sustained efforts of the command and the neutralization of its key leaders, the manpower and capabilities of the terrorist groups have totally degraded.

In the campaign against the proliferation of loose firearms, a total of 305 high-powered and 101 low-powered firearms were voluntarily turned over to the different units under WestMinCom during the 1st and 2nd quarters of 2021.

To incorporate the whole-of-nation approach in its campaign, Western Mindanao Command continuously bolsters its civil-military operations. The platform of Task Force to End Local Communist Armed Conflict (TF-ELCAC) and Task Force to End Local Armed Conflict is maximized particularly in delivering basic services to the target communities.

“Our accomplishments have proven our fellow countrymen that we are doing our job right. For this, I commend each and every soldier, sailor, airmen, and marines for your contributions in our goal to attain peace, security, and development in our areas of operation,” said Lt. Gen. Vinluan, Jr.

He also reminded the ground commanders and the soldiers that the people of western and central Mindanao are relying heavily on the armed forces hence best efforts must be exerted towards a more secured Mindanao.

With regard to the ill-fated C-130 flight in Sulu on July 4, Lt. Gen. Vinluan, Jr. assured that the command will provide all the necessary support needed by the victims and their families.

Davao City, Davao Oriental – These former rebels, who were members of the New People’s Army (NPA), are beneficiaries under the Enhanced Comprehensive Local Integration Program (E-CLIP) in 2016-2020.

No less than Governor Nelson Dayanghirang handed over the assistance together with DSWD Regional Director Raquel Nuñez and Provincial Social Welfare and Development Office Head Ms. Sarah Gudes during a turnover ceremony held at the Provincial Capital Covered Court this morning.

The assistance hopes to help these former rebels sustain their livelihood, as well as further entice active members of the NPA to surrender as the government bids to end the long-running Communist Insurgency in the country.

Present in the ceremony are 701st Deputy Brigade Commander Colonel Edgar Delos Reyes representing Colonel Oliver Maquiling, and DILG Provincial Director Orle Cabaobao.

IMPASUGONG, BUKIDNON – The New People’s Army Terrorists continue to flee after series of encounters with the troops of the 8th Infantry (Dependable) Battalion, Philippine Army in the hinterlands of Agusan del Sur-Bukidnon boundaries last June 30, 2021.

Concerned citizens in the area continue to report to the soldiers the whereabouts of the NPAs conducting extortion activities. While patrolling, the government troops encountered the NPAs and were able to seize one M16 rifle and two backpacks with personal belongings.

LTC Edgardo Talaroc Jr, Commander 8IB said that, “Padayon ang operasyon sa kasundaluhan human nga nadiskubrehan ang daghang dugo sa nahitaboan sa panagsangka. Wala nay laing padulngan ang mga NPA tungod wala na silay baseng masa. Padayon silang magutom sa bukid ug makapoy tungod sa armadong pakigbisog nga walay padulngan.” (We continue our pursuit after discovering bloodstains in the encounter site. CAMP ELIAS ANGELES, Pili, Camarines Sur-From being outlaws, sixteen members of the Communist Terrorist Group (CTG) are now included in the skyrocketing number of Former Rebels (FRs) who abandoned the armed struggle to work hand in hand with the government in eradicating communist insurgency.

In a ceremony held at Tico Maristela Sports and Cultural Center in Aroroy, Masbate around 10 o’clock in the morning, Tuesday, July 6, the new batch of surrenderers were presented to the Aroroy Local Peace Engagement Team headed by Hon. Mayor Arturo Virtucio.

Seeing the hopeless and useless cause of the terrorist group that has endangered the lives of innocent civilians including their own families, the said surrenderers composed of three regular NPA members and 13 Militiang Bayan (MB) members yielded to the government last July 2, bringing along various firearms, including a KG9 submachine gun which they symbolically turned-over to the committee during the event.

Afterwards, the group took an oath of allegiance as a sign of their denouncement of CTG’s terrorism and false ideologies.

Lt. Col. Siegfried Felipe Awichen, Battalion Commander of 2nd Infantry Battalion (2IB), congratulated the FRs for making the wise decision of withdrawing their membership and support from the CPP-NPA-NDF which, in return, will lead them to a new and more peaceful life.

The now considered FRs will receive complete set of benefits upon finishing the E-CLIP process.They will also avail various programs from different government agencies on top of the E-CLIP which will grant them financial, livelihood, educational, medical, and housing assistance.

On the other hand, Col. Aldwine Almase, Brigade Commander of 903rd Infantry Brigade, underscored that the Army together with the PNP will continue its intensified security operations and peace initiatives until Masbate finally becomes an armed conflict-free province.

“Ang patuloy na tagumpay ng ating kasundaluhan at kapulisan kasama ang iba’t ibang ahensya ng ating pamahalaan laban sa terorismo ay lalong magpapaigting ng ating kampanya upang wakasan ang karahasan, tulungan ang mga gustong magbalik-loob sa pamahalaan at tuluyan ng tuldukan ang walang kabuluhang ipinaglalaban ng mga teroristang komunista,” Col. Almase said.

Meanwhile, MGEN HENRY A ROBINSON JR PA, Commander of Joint Task Force Bicolandia (JTFB), lauded the Masbateños for sustaining the momentum against the CTG.

“These continuous gains in Masbate is not the work of the government alone, we have the Masbateños to be thankful for. Had it not been for their overwhelming support, our campaigns will be futile. To the surrenderers, aside from the E-CLIP Committee, you also have the Regional Task Force to End Local Communist Armed Conflict (RTF-ELCAC) to assist you as you all start anew. Thank you for heeding the call and setting an example to your former comrades and for proving them that even when you were once deceived by the CTG, there’s still hope for you,” MGen. Robinson said.

Also attending the event were PCol. Joriz Cantoria, Provincial Director of Masbate Police Provincial Office and Mayor Arturo Virtucio Jr. of Aroroy.

It can be recalled that just last month, particularly from June 18-28, 505 CTG members and supporters returned to the folds of the law–the biggest number of surrenderer in Masbate weeks after the tragic death of Kieth and Nolven Absalon in the hands of ruthless communist terrorists.

Isang magsasaka ang pinatay at 19 sibilyan ang inaresto sa iba’t ibang operasyong militar sa Bicol nitong nagdaang dalawang linggo. Nakapailalim pa rin sa okupasyong militar ang maraming bahagi ng rehiyon.

Binaril at napatay ng mga pwersa ng Regional Mobile Force Battalion si Alex Llabres, magsasaka at residente ng Barangay San Roque Heights, Bula, Camarines Sur, sa kanyang bahay noong Hunyo 24.

Sa Sorsogon, iligal na inaresto ng 22nd IB ang 13 na indibidwal, kabilang ang anim na menor de edad, sa Bulan noong Hunyo 28. Unang dinukot ang magsasakang si Alvin Mapula kasama ang kanyang mga pamangkin na sina Althea Mapula, 2-taong gulang, at Janrex Mapula, 13, mga residente ng Barangay Bulawan.

Iligal ding ibinimbin ang mga kamag-anak na naghanap sa tatlo. Hanggang ngayon, nakapiit pa rin sina Editha Mapula, 43; Mary Ann Mapula, 29; Angel Mapula, 12; Rey Mapula, 4; RJ Mapula, 7; Renz Guelas, 13; Sunny Preconcillo, 48; Emy Preconcillo, 39 at Dante Bandola, 50.

Sa parehong araw, inaresto si Laurente Gestole, residente ng Barangay Cadandanan. Tinakot at pinagbantaan naman ng mga berdugo sina Regine Graida at Geraldine Gestole, mga residente ng Barangay Calpi. Sa bayan ng Donsol, binaril at iligal na inaresto si Jesus Macenas, isang magsasaka, noong Hunyo 17.

Sa Masbate, inaresto sina Mariel Suson, 22, titser, Jennifer Dollison Nuñez, myembro ng Amihan Bicol at Sano Arendain ng Kilusang Magbubukid ng Bicol noong Hunyo 22 at 23 sa Barangay San Jose, Uson.

Noong Hunyo 18, dinakip ng 2nd IB sina Joseph Delara, 18, residente ng Candelaria, Uson at si Jude Serafin ng Tuburan, Cawayan. Nasa kustodiya pa ng pulis si Serafin.

Samantala, 23 sa 44 barangay sa Tinambac, tatlo sa Lagonoy at dalawa sa Goa, Camarines Sur ang hinahalihaw ngayon ng mga tropa ng 83rd IB. Mula pa Mayo nakakampo ang mga sundalo sa mga bayan na ito sa tabing ng Retooled Community Support Program.

Layon ng pagkakampo na ihanda ang lugar para sa pagpasok ng dambuhalang mga kumpanya sa pagmimina, quarry at ekoturismo sa distrito na tinaguriang “Partido.” Target pangunahin ng mga ito na dambungin ang Tinambac na nagsisilbing pinakamalaking water reservoir sa Camarines Sur. Mayaman sa mineral at punong kahoy ang kabundukan ng lugar.

Balon ng korapsyon ang bilyun-bilyong pisong inilaan ng rehimeng Duterte sa tugong nito sa pandemyang Covid-19. Sa ulat ng mga ahensya ng estado noong Hunyo 25, tinatayang aabot pa sa ₱168.7-bilyong pondo o 25.43% ng kabuuang ₱665.7 bilyong inilaan para rito ang hindi nagastos ng iba’t ibang ahensya ng gubyernong Duterte simula pa Marso sa nakaraang taon sa di maipaliwanag na mga dahilan.

Nagmula ang pinagsama-samang pondong ito sa mga batas na Bayanihan 1 (₱393.63 bilyon) at Bayanihan 2 (₱205.12 bilyon) at sa inilaang pondo sa mga ahensya sa pambansang badyet ngayong 2021 (₱66.97 bilyon).

Pinakamalaking bulto ng hindi nagamit na pondo ay nasa Department of Health (DOH). Sa pondong ₱157.4 bilyon, ₱51.4 bilyon pa lamang ang ginamit ng ahensya para sa pagbili ng bakuna, suporta sa mga manggagawang pangkalusugan, at iba pa.

Sa inilaang ₱5.26 bilyon para sa mga bakuna, ₱1.12 bilyon pa lamang ang nagagastos ng DOH. Ang ₱9-bilyong pondo naman para sa special risk allowance ng mga manggagawa sa kalusugan ay noon lamang Hunyo 29 nirelis mula sa pambansang pondo.

Ang ₱16.24 milyon na para naman sa mga manggagawang pangkalusugan ng University of the Philippines-Philippine General Hospital ay hindi pa rin nagagalaw. Sa kabila ito ng makailang-ulit na paggigiit ng sektor sa pangunguna ng Alliance of Health Workers.

Pagtatapos ng Bayanihan 2

Kabilang sa mga kagawarang mayroong hindi nagamit na pondo ang Department of Social Welfare and Development (DSWD) (₱1.3 bilyon), Department of Public Works and Highways (₱1 bilyon), Department of Agriculture (₱658.3 milyon), Department of the Interior and Local Government (₱580.471 milyon), DOH (₱266.2 milyon), at Department of Labor and Employment (₱224 milyon.)

Babalik sa National Treasury ang anumang pondong hindi naipamahagi sa ilalim ng pinalawig na Bayanihan 2 matapos napaso ang batas noong Hunyo 30. Tinatayang nasa 4.6% o ₱6.5 bilyon ng kabuuang ₱141.6 bilyon ng pinalawig na Bayanihan 2 ang hindi nagastos ng iba’t ibang kagawaran ng gubyerno.

Kinastigo ng iba’t ibang personalidad at grupo ang kapabayaang ito ng rehimen. Ayon kay Rep. Edcel Lagman, kinatawan sa prubinsya ng Albay, “seryosong pagsasakdal” sa kapabayaan at kabiguan ng rehimen sa pagharap sa pandemya ang pagkakaroon ng mga hindi nagamit na pondo.

Kinundena naman ng Alliance of Concerned Teachers ang Department of Education matapos bigong gamitin ng ahensya ang aabot sa ₱1.7 bilyong pondong para sana sa distance learning. Nakalaan ang naturang pondo para sa pag-iimprenta ng mga modyul, ayuda sa mga guro at iba pa.

Natigil na rin ang programang libreng pasakay ng rehimen matapos magwakas ang Bayanihan 2. Sa harap ito ng nagpapatuloy na kakulangan ng pampublikong transportasyon laluna sa Metro Manila.

Paghihimay sa gastos

Ayon kay Sen. Sonny Angara, pinuno ng komite sa pinansya ng Senado, hihimayin nito ang gastos ng bawat ahensya ng gubyerno para malaman ang dahilan ng mabagal na paglalabas ng mga pondo.

Kinwestyon din ng Senado noong nakaraang buwan ang mabagal na paglalabas ng pondo ng DBM sa kabila ng pagkakaroon ng Anti-Red Tape Authority (Arta) na itinalaga para pabilisin ang paggulong ng mga ito.

Pebrero at Mayo pa lamang nitong taon, naghain na ng mga resolusyon sa Senado sina Sen. Francis Pangilinan at Sen. Risa Hontiveros para busisiin ang paglalabas ng mga pondo. Sa Mababang Kapulungan, nagsumite rin ng resolusyon ang 37 mambabatas.

Isiniwalat naman ni Sen. Manny Pacquiao noong Hulyo 3 ang nawawalang ₱10.4 bilyong pondo ng Social Amelioration Program (SAP) sa ilalim ng DSWD. Ayon sa kanya, sa ginamit na aplikasyong Starpay, nasa 500,000 lamang ang nakatanggap ng SAP sa kabuuang 1.8 milyong benepisyaryo. Tumataginting na ₱14 bilyon ang hindi naipamahagi sa mga benepisyaryo.

Liban pa sa DSWD, inakusahan din ng senador ng korapsyon ang DOH at Department of Energy. Bumibili umano ang DOH ng mga malapit nang ma-expire na mga gamot sa regular na presyo sa halip na mas mura.

“Kung walang maayos na pag-aakawnt, hindi natin masisisi ang taumbayan kung iisipin nilang gagamitin ito ng administrasyon para sa darating na eleksyong 2022,” ayon kay Bayan Muna Partylist Rep. Carlos Zarate.

The Philippine military is in the process of identifying soldiers who died so that remains could be brought back to their families.

The United States offered to help the Philippines identify soldiers who died in Sunday’s fatal C-130 Hercules crash in Patikul, Sulu, the worst aviation disaster in Philippine military history.

The US Department of Defense said on Wednesday, July 7, that the offer was extended to the Philippines in a phone call between Philippine Defense Secretary Delfin Lorenzana and US Defense Secretary Lloyd Austin III on Tuesday, July 6.

In a summary of the conversation, the US defense department said, “Austin offered to provide any additional assistance that is possible, including for the crash response and potential identification of victims.”

The C-130 carried 84 Army troopers and 12 Air Force personnel, with most of the passengers trainees from the 4th Infantry Division in Cagayan de Oro City. The crash killed at least at least 52 and injured 46 others, including three civilians who died, and four others who were injured.

The Philippine military earlier said on July 5 that it was in the process of identifying soldiers who died in the crash so that their remains could be brought back to their families.

As of Tuesday, at least six were identified, with their bodies were flown from Zamboanga City to Cagayan de Oro, where they were given full military honors.

The Philippines and US have been closely coordinating on response to the crash.

Western Mindanao Command (Wesmincom) chief Lieutenant General Corleto Vinluan earlier said the Philippines would send the C-130’s black box or flight recorder to the US for examination. American personnel also provided medical evacuation support for victims of the crash.

The ill-fated plane was acquired from the US just in January 2021, for only about P1.54 billion or $32 million under a Foreign Military Financing grant. The “workhorse” aircraft was supposed to be used by the Philippines for years.

When Cabinet members unilaterally designate a person or a group as a terrorist, not even a court that disagrees with them can change it.

The Philippine government also told the Supreme Court (SC) that any damage to the reputation of a person or group tagged as a terrorist is the fault of no one else but the person himself or the group itself.

This was explained by the Office of the Solicitor General (OSG) in four volumes' worth of memoranda submitted to the SC on June 25. In total, the submissions, containing 812 pages, pertained to Supreme Court deliberations on whether the anti-terror law violated the Constitution and other existing laws.

The High Court grouped the 37 petitioners opposing the anti-terror law into six clusters so that it would have to review only six memoranda from them.

Designation as a terrorist is a highly contentious power under Section 25 of the anti-terror law. The law empowers the executive anti-terror council (ATC) to decide by itself to designate people and groups as terrorists without hearing their defense.

This is distinct from the proscription power of the court which goes through due process and which judicially declares a group a terrorist only after examining evidence.

The Supreme Court asked the government: If the Court of Appeals (CA) eventually finds no probable cause to issue the proscription order, will the said organization be automatically delisted by the ATC?

The OSG replied: "No, it is not automatic."

"Rule 6.9 of the Implementing Rules and Regulations (IRR) provides that the denial of an application for proscription shall not be a bar to filing of another application against the same group of persons, organization or association if the subsequent application is grounded on new evidence," added the OSG in its memoranda.

The OSG said it can file a new proscription case after 6 months with new evidence.

Communists

The law's IRR also allowed the ATC to post on its website the names of those it designated as terror groups or members of terror groups. The ATC has already done this to 19 people, including four peace consultants, whom it accused of being communists.

The Communist Party of the Philippines-New People's Army (CPP-NPA) has also been designated as a terror group, along with the Maute Group and individuals associated with the Abu Sayyaf.

The peace consultants have vehemently denied being members of the CPP-NPA.

The OSG said designation is an administrative act which "does not require prior notice and opportunity to be heard."

"When one is engaged in acts of terrorism, such person cannot insist on the protection of his/her reputation. The person has no one to blame but himself/herself for the measures that will be taken by the State to protect the public, one of which being designation," said the OSG.

A year after its passage and a year since petitions were filed against it, the law still remains in effect. The submission of the memoranda starts the countdown for the Supreme Court to decide on the law's constitutionality.

There is no hard and fast rule on how long it could take.

Freezing of assets

The OSG confirmed in the memoranda that "several bank accounts" under the names of the 19 accused communists have been frozen.


Families of the peace consultants have slammed this move by the ATC. Among them is the family of Vicente Ladlad who said that the only significant source of income he had was his compensation for being a Martial Law victim.

Still the OSG claimed that freezing of assets was not an automatic penalty of designation, even though the law and the IRR both say "assets of the designated individual, group of persons, organization, or association under the Act shall be subject to the authority of the Anti-Money Laundering Council to freeze."

"To be clear, designation by the ATC does not automatically result in the freezing of assets," said the OSG. But in the same memorandum, the OSG said: "Designation is a preventive measure intended to trigger the issuance of a freeze order and the conduct of a bank inquiry."

The OSG insisted that the freezing of assets made sure the government stopped the financing of terrorism, which it said, was an integral part of combating the problem – stopping it in its preparatory phase.

Murky areas

There are fears that designation could go beyond frozen assets. For example, it could be used as a short-cut to convicting activists on trial in different courts for various offenses – such as the usual murder and illegal possession of firearms and explosives.

Another concern of the SC was this – even if the group was neither designated nor proscribed, other individuals could still be prosecuted since membership in a terror group is considered a crime under the law.

The justices asked: How do you punish a group's member if that group is neither designated nor proscribed? The OSG said that this was still possible as long as the group was found to be committing any of the acts specified in the law – among others, facilitating, providing material support, or inciting to terrorism.

And what was the standard to classify such acts, especially acts of protest, as terror acts? "Ultimately, the interpretation of what act or acts is/are intended to cause death or serious physical harm to a person, to endanger a person's life, or to create serious risk to public safety ultimately rests on the judiciary based on facts," said the OSG.

Because as the OSG said, even the ATC "does not resolve questions of fact."

The ATC's basis would be "a reasonable ground of suspicion supported by circumstances warranting a cautious person to believe that the proposed designee meets the requirements for designation."

Nowhere to go

And if those designated as terror groups or individuals want to challenge this, they must go to the President, the OSG said.

"The correct remedy from the ATC's decision is an appeal before the Office of the President," said the OSG.

The OSG, however, said those who feel they were unfairly labeled as terror groups or persons could still always avail of a judicial remedy, a petition for certiorari, or a petition seeking to void an action.

Cluster 2 of the petitioners against the anti-terror law said in a memorandum submitted to the High Court: How can this be an effective remedy when "the finding of probable cause [by the ATC] will be based primarily on intelligence and classified information, which may likely be of the hearsay, polluted, or inadmissible kind."

They also insisted that the text of the law makes it possible for designation to lead to arrest and detention.

And if the arrested or detained person based on designation files for an extraordinary writ, the writs will still fail because, according to the memorandum submitted by Cluster 5 petitioners, the language of the law "legitimized [the] arrest and detention of a person suspected of committing acts of terrorism without a judicial warrant of arrest."

All in all, "the Anti Terror Act mentions the right to effective judicial protection although it renders that right meaningless," said Cluster 3 petitioners in their memorandum.
