From the Philippine Information Agency (Aug 29): NAPOLCOM requests presidential clearance for admin case vs. two PNP generals
The National
Police Commission (NAPOLCOM) requested a presidential clearance to conduct
formal hearing against two Police Generals Joel Duldulao Pagdilao and Edgardo
Gonzales Tinio who are among the five generals named by President Rodrigo
Duterte to have an alleged link to illegal drug trade.
The Commission’s request was made through a letter submitted by its
Vice-Chairman and Executive Officer, Atty. Rogelio T. Casurao, to the Office of
the President (OP) through Executive Secretary Atty. Salvador C. Medialdea.
Casurao stated that the Commission, after conducting pre-charge investigation,
found probable cause to warrant the filing of a formal charge against the respondents.
Pagdilao and Tinio will face the administrative complaint before the Commission
En Banc on the grounds of serious neglect of duty, serious irregularity in the
performance of duty, and conduct unbecoming of a police officer.
Under the law, a respondent who is a presidential appointee can only be
subjected to summary proceeding after a clearance for such purpose is obtained
from the OP.
The filing of complaint was approved through a resolution of the Commission En
Banc signed by DILG Secretary Ismael D. Sueno, Casurao and four commissioners
Felizardo M. Serapio, Jr., Job M. Mangente, Zenonida F. Brosas, and Police
Director General Ronald M. Dela Rosa.
In a press briefing, Atty. Johnson G. Reyes, the Commission’s Acting Staff
Service Chief of its Inspection Monitoring and Investigation Service (IMIS),
said that possible penalty of the aforesaid grave offenses is suspension to
dismissal from service with accessory penalties such as removal of eligibility
and benefits.
Reyes clarified that the Commission has no hand in criminal case. Retired
Generals Marcelo Garbo Jr., Bernardo Diaz, and retired General and now
Daanbantayan Mayor Vicente Loot, who are among named by the President as
“narco-generals”, are thereby outside the jurisdiction of the Commission and
under the purview of the Department of Justice (DOJ).
Specific evidence were not divulged in the press briefing but he assured there
is enough, circumstantial, and direct evidence for the administrative
complaints.
In July, the Bureau of Immigration (BI) has placed the five generals on its
watch list in response to the lookout bulletin order (LBO) issued by the DOJ
