MAOISTS in the Philippines say that they are foiling the army in its attempts to clear land for a large-scale mining project.
The guerilla New People’s Army (NPA) announced details on Monday of its recent sniping operations against troops — part of its bid to stop the project’s development.
It claimed to have left three soldiers dead and one wounded during its attacks on their camps in Samar province.
According to the NPA, troops have informed residents that they are there to enable the project by Marcventures Holdings, which is seeking to exploit 12,231 hectares of bauxite-rich land.
The NPA is the armed wing of the Communist Party of the Philippines, which promotes Marxism-Leninism-Maoism, and has been engaged in armed conflict with the state since 1969 — the world’s longest communist insurgency.
“In other countries, bauxite mining has caused widespread and irreversible ecological destruction to lands, rivers and communities near the site of the mining operations,” the NPA’s statement said.
It noted the 2015-2016 bauxite-mining disaster in Kuantan, Malaysia, where unregulated activity caused major pollution to the soil and water, leading the government to ban bauxite mining in the area for several years.
The NPA warned that the Samar bauxite project may result in “grave damage” to the lives and livelihoods of thousands of residents.
It said that authoritarian President Rodrigo Duterte is deploying troops to act as “a security force” for the mining company, exposing the government’s “greed and anti-people character.”
“Duterte prioritises the costly and futile counter-insurgency operations to secure income for big capitalists, at the expense of health-care services, education and livelihood assistance that are much more needed by the people now,” its statement said.

Three suspected New People's Army (NPA) rebels were killed during an encounter between communists and police forces on Tuesday in Kalayaan, Laguna.
Information from CALABARZON police on Wednesday identified the killed rebels as Dioscorro "Ka Termo Cello, the supposed platoon leader of Platun Laguna-Quezon, Melito Glor Command; a certain Ka Omar/Efren; and one Ka Danny/Mar/Rey.
Authorities said Cello, who is also the alleged secretary general of Cesar Batrallo Command, was the subject of an arrest order with a P3.8 million reward for anyone who could provide information that will lead to his capture.
Police said the firefight transpired in Sitio Balat Kahoy in Barangay San Antonio. Authorities encountered more or less 40 communist rebels while they were scouting for a sheltering area.
Authorities were able to seize at the encounter site three M16A1 rifles, one M16 baby Armalite with M203 grenade launcher, an improvised explosive device Claymore mine, a 20-meter firing line and blasting cap, 16 long and 12 short M16 magazine with ammunition, a rifle grenade, two improvised explosive device small cylindrical hand grenades, eight large battery series, three jungle bolos, five ammo rigs, a Communist Party of the Philippines flag, one National Democratic Front flag, one NPA flag, a handheld radio with charger, a flashlight, some mobile phones, SIM cards, memory cards, external hard drive, and some subversive documents.
CALABARZON police chief Police Brigadier General Vicente Danao vowed that the police would continue to be persistent in their operations against communist rebels.
Danao also stressed the importance of the Enhanced Comprehensive Local Integration Program (E-CLIP) which aims to give former rebels who will surrender to the government a chance at a better life.
“Take advantage of the programs of our government for the former rebels. Kakampi niyo po kami. Tama na, nawa'y magising na kayo sa mga mali at baluktot na idelohiya na pinapalaganap ng komunistang CPP-NPA," Danao said.
Following the incident, Phiippine National Police chief Police General Archie Francisco Gamboa directed a hot pursuit operation against NPA rebels in Laguna.
"The Philippine National Police condemns in the strongest terms the latest act of hostility of the New People’s Army in Laguna amid the health crisis we are facing right now," Gamboa said.
Gamboa also reminded all police regional offices to be more vigilant and conduct preventive and proactive operations in coordination with the military against communist groups.

The New People’s Army-South Cotabato carried out a punitive action against the ABU-Gemma Construction Company, a local contractor of major government infrastructure projects in the Far South Mindanao Region. The action took place on June 15,2020 in Purok Pag-asa, Brgy. Veterans, Surallah town. Several company heavy equipments were burned in the said incident. Damages are estimated to cost at least 23 million pesos.
The punishment was enforced to neutralize the firm’s road construction operations directly serving the severely environment destructive large-scale mining and expansion of agribusiness plantations. The US-Duterte regime is perfidiously pushing these projects despite the onslaught of COVID 19 pandemic which is attributed to environmental degradation.
The construction company’s owner also operates over a hundred hectares of banana plantation in T’boli, South Cotabato.
The people of South Cotabato has long been opposed to Tampakan copper-gold project, San Miguel Energy Corporation’s coal mining in Ned, Lake Sebu, and the multinationals Dole Philippines and Sumifru’s aggressive expansion of its pineapple and banana plantations and use of aerial spraying which has adverse effects to the people’s health and the environment.
Road constructions linking even the remotest of communities in the province are all disguised as “development projects” but are actually made for easy transport of these companies’ products and heavy equipments.
In this time of a pandemic crisis, the US-Duterte regime should focus on building more hospitals, medical facilities and schools. It must concentrate more on allocating bigger budget to health programs and services that directly benefit the people – not on road constructions funded through the graft-laden Build! Build! Build program that only the bureaucrat capitalists and their favored contractors profit through kickbacks and cuts in overpriced government infrastructure projects.#

Yesterday at dawn (04 August) the platoon leader of NPA terrorists moving to the province of Laguna and Quezon. He died with his vice platoon leader and another one of those who encounter the forces of RMFB 4 A in Sitio Balatkahoy, Brgy San Antonio, Freedom, Laguna.

Ipil, ZSP — An 18 year old, female member of the Communist NPA Terrorist (CNT) was rescued by the Army’s 97th Infantry KALASAGLAHI Battalion (97IB) after being wounded during an armed clash at Sitio Kasong, Barangay Midatag, Leon B Postigo, Zamboanga del Norte, August 5, 2020.
The female CNT was identified as alias Jekjek, a Medic and Political Instructor of HQ KALAW, of the Western Mindanao Regional Party Committee (WMRPC).
She was hit by a bullet in her left gluteal area (buttocks) during a ten-minute firefight after residents of the Sitio reported that armed group stole a pig and food stuffs.
There were no casualties incurred on the government side during the armed clash.
“The troops immediately rescued Jekjek after the clash, provided medical first aid and immediately brought her to the nearest hospital“, Lt. Col. Manaros M Boransing, Commanding Officer, 97th IB said on his statement.
“Jekjek was recruited when she was 14 years, brainwashed by the leaders and legal fronts of the Communist Terrorist Groups (CTGs), used and abused during her time with the group and eventually abandoned when she was wounded. That is how they (CNT) treat their members” Lt. Col. Boransing added.
On his part, Brigadier General Leonel M. Nicolas, the Commander of the Army’s 102nd Infantry IGSOON Brigade, who has operational control of 97th IB called on the remaining members of the WMRPC to return to the community by laying down their weapons and taking advantage of the government’s Enhanced Comprehensive Local Integration Program (E-CLIP).
“The Army will not stop until ultimate peace is attained in the Province of Zamboanga del Norte and the whole Zamboanga Peninsula. Terrorism and armed rebellion has no place in our community, and in our country” Brigadier General Nicolas said.
It can be recalled that alias Lando, another CNT member was also rescued by the Army last May 6 and have recovered from the wounds sustained after he was abandoned by his comrades.
Alias Lando as of today is benefiting the assistance and programs provided by the government.
Maj. Gen. Gene Ponio, Commander, 1st Infantry Division, commended the troops for demonstrating a great respect to human rights to the adversaries.
“This is a manefistation that our troops on the ground have high regards in the protection of human rights to include the lives of our enemies,” Maj. Gen. Ponio said.
“Rest assured that the Tabak Division in close coordination with the Local Government Units will provide necessary medical assistance to the rescued CNT,” Maj. Gen. Ponio added.
As of this posting, troops are still conducting pursuit operations against the fleeing CNT members.

BUENAVISTA, Agusan del Norte – The troopers of 23rd Infantry Battalion joined the National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) and other line agencies of the government in a visitation and consultation activity with the Indigenous Peoples (IPs) on August 3, 2020 at Barangay Simbalan, Buenavista town.
The activity was graced by Secretary Allen Capuyan, chair of the National Commission on Indigenous People (NCIP) and Head of NTF-ELCAC and was attended by nearly two hundred (200) tribal leaders and members from the towns of Las Nieves, Buenavista, Nasipit and Carmen in Agusan del Norte.
Lt. Col. Julius Cesar C. Paulo, the Acting Commander of 23rd IB said the activity is important and very timely considering that the IPs in the said four (4) towns in Agusan del Norte are greatly affected not only by the health threats of the coronavirus disease 2019 (COVID-19) pandemic but also from the intimidations and extortions of the remaining Communist New People’s Army Terrorists (CNTs) in their communities.
The towns of Las Nieves, Buenavista, Nasipit and Carmen are under the operational jurisdiction of the 23rd IB.
“Many innocent lives of ordinary IPs and their leaders were lost here in the province of Agusan del Norte and the rest of Caraga Region due to the continued terroristic activities of the CNTs,” Paulo said.
He took note of the IP killings perpetrated by the CNTs even when the people of Caraga Region are battling against the spread of COVID-19.
“CNT manipulations are the real threat to the IPs which destroy their future by deceiving them to join their useless ideology. The IP communities, their families and children continue to suffer and the CNTs continue to sow fear and chaos, not only in communities in Agusan del Norte but also in the rest of the region,” Paulo said.
He added that the consultation on Monday served as a venue for the Higaonon tribal leaders to ventilate the situations in their communities.
The activity gathered the tribal leaders from Higaonon tribe in the four towns of Agusan del Norte for consultation and discussion on the situation inside their ancestral domains, most of which are situated in Conflict-Affected Areas (CAAs) and Geographically Isolated and Disadvantaged Areas (GIDAs) in the province.
Sec. Allen Capuyan and the representatives from different line agencies heeded to the accounts made by IP leaders that dwelled most on the security, peace and order situation in their respective communities and ancestral domains. The tribal leaders also raised the issue on the issuance of the Certificate of Ancestral Domain Title (CADT) which they regard as an important document to establish ownership of their ancestral domain claims. According to them, the lack of CADT impedes the plan of every tribal community to further develop their ancestral lands. They added that left-leaning groups with links to the Communist New People’s Army Terrorists (CNTs) also exploit the lack of CADTs in communities and use the issue to recruit more IP members to join their movement.
During the consultation, Sec. Capuyan emphasized the salient provisions on the Indigenous Peoples Rights Act (IPRA) as the basis to pursue the efforts of tribal communities for the issuance of CADT for their ancestral domains. The NCIP chair also emphasized IPRA provisions that ensure the rights of the IPs to their ancestral domains.
The tribal leaders also expressed optimism on the issues and concerns they raised on their ancestral domain will be addressed with the presence of Sec. Capuyan and the other agencies of the government. Among the IP leaders who joined the activity was Datu Eddie Ampiyawan, the Indigenous People Mandatory Representative (IPMR) of Agusan del Norte who urged the leaders of Higaonon tribe to support the efforts of the government and cooperate with the moves of the NCIP and other line agencies in the processing of the issuance of CADTs for their ancestral domains.
“The efforts of the government will remain futile if we do not cooperate,” Ampiyawan said, as he assured Sec. Capuyan and the representatives of the line agencies of the continuing support of the Higaonon tribe to the efforts of the government to bring peace and development in the province. “As a tribal leader of Agusan del Norte, I can assure the continued support of the Higaonon and Manobo tribes to the government. We will strengthen our support through our unity to oppose the leftist groups that cause all the disorders and troubles in our communities,” Ampiyawan said.
The activity was also joined by the Technical Education and Skills Development Authority (TESDA), Commission on Human Rights (CHR), Department of Agriculture (DA), the Department of Social Welfare and Development (DSWD), Philippine Information Agency (PIA), National Intelligence Coordinating Agency (NICA), the 402nd Infantry Brigade, and the Police Regional Office (PRO-13).
A total of two hundred (200) hygiene kits were also distributed to the tribe leaders and members present in the said activity.
“Your government servants, especially your army will never cease to extend help, bring programs, projects and services and always willing to hear the voices of our beloved IPs. We will protect and safeguard you from the CNTs and uphold your human rights as we look forward to ending the insurgency in your communities to attain long-lasting peace and sustainable development,” Paulo said.
He added that the Army, as an active part of NTF-ELCAC, will continue to encourage the IPs to help the government fight insurgency that has caused poverty, hunger and conflicts in IP communities.
“Let us help each other to end armed struggle to improve the lives of the IPs and to fasten the development in the identified Conflict-Affected Areas and Geographically Isolated and Disadvantaged Areas in Caraga Region,” Paulo said.

ISABELA CITY, Basilan – A total of six Abu Sayyaf Group returnees and six high-powered firearms were presented to Colonel B. Domingo Gobway, the Commander of 101st Infantry (Three Red Arrows) Brigade and Joint Task Force Basilan, during his visit at the Headquarters of the 4th Special Forces Battalion in Barangay Cabunbata, Isabela City, Basilan Province this Monday morning, 03 August 2020.
The surrendered firearms include five (5) M16A1 rifle, one (1) M1 US carbine, magazines, and ammunitions which were handed over by the ASG returnees who voluntarily surrendered to the “Dolphin Warriors” since the assumption of Colonel Gobway as the Commander of 101st Infantry Brigade last 09 July 2020.
This activity was also the first visit of the newly installed Brigade Commander to this unit as he was warmly welcomed by the troops. In the same manner, Colonel Gobway talked to the men and women of 4SFBn and expressed his support to the attainment of the unit’s mission.
“Sama-sama tayo, magtrabaho tayo. Hindi natin tatantanan ang mga kalaban.” Col. Gobway said.
He also encouraged the troops to never let their guard down in this fight against Covid-19 pandemic here in Basilan Province. “Salamat sa sakripisyo ng bawat isa…Mag-ingat sa lahat ng ginagawa na di mahawaan ng Covid, at palakasin ang resistensya ng katawan.”, Col. Gobway added.
Lieutenant Colonel Alex Ampati, the Commanding Officer of 4SFBn, likewise expressed his deepest appreciation for the Commander’s visit and affirmed his commitment to support the JTF Basilan mission as the unit perform its tasks for the overall peace and development of Basilan Province.

'The anti-terror law threatens to legalize clearly abhorrent state actions' against the Bangsamoro people
The Supreme Court en banc has so far just been consolidating petitions and asking government to answer them. The anti-terror law took effect on July 18 according to the government, although some petitioners say it took effect only on July 22.
Long history of discrimination
The first Moro petition, filed July 23 by a group led by former human rights regional chair Algamar Latiph, discussed in detail Bangsamoro's longtime struggle for freedom and liberty.
Their 79-page petition told stories of Moros oppressed by government forces just because they are "others," saying that "othering influenced the use of potent military force."
The Latiph petition attached a list of 44 Moros wrongfully charged, arrested and jailed, including children, for over a year because of suspicion of their ties to the group behind the 2013 Zamboanga siege.
The cases of mistaken identity have been repetitive, said the petitioners, calling law enforcers simply reckless or guided by policies shaped by historical prejudice.
The Latiph petition cited surveys – 55% of Filipinos think Muslims are probably more prone to run amok, 47% believe that Muslims are probably terrorists or extremists.
"Our apprehensions on abuse and arbitrariness of the enforcement of vague law are not premised on empty facts. We have cases of mistaken identity involving Bangsamoro. And we have concluded that such mistaken identity victimization shows pattern, widespread, and systemic in singling out the Muslims, Bangsamoro," said the Latiph petition.
Freedom of religion
Not only does the Constitution protect the freedom of expression, it also protects the "free exercise and enjoyment" of religion.
The Hataman petition fears that their Islamic practices and expressions may be taken as inciting to terrorism.

The Hataman petition discussed how, because of atrocities committed by extremists, the word jihad had come to be associated with terrorism.
"In its most general meaning, jihad refers to the obligation incument on all Muslims to follow and realize God's will: to lead a virtuous life and to extend the islamic community through preaching, education, example, writing," said the Hataman petition.
The Hataman petition said that ever since the 9-11 attack in the United States, Muslims had been deterred even from just discussing jihad academically.
"This labelling and the way it has been connected to Islam has prevented Muslims from openly expressing their belief in Jihad to avoid suspicion of inciting or proposal to commit terrorism," said the Hataman petition.
The Hataman petition also said that before they can freely exclaim "Allahu Akbar" when hearing good news or praising Allah.
"Now we have to be first conscious of the place and of our surroundings," said the petition.
The Hataman petition ties their struggles to freely exercise their religion to the overarching legal argument against the anti terror law – that it violates the constitutional right to free speech.
"[The] anti-terror law clearly constitutes a prior restraint on free expression because it compels Muslim preachers and fathers from freely and publicly discussing their religious beliefs," said the petition.
In the Latiph petition, the Moros said they are one in seeking to uphold the constitutional protection of freedom and liberty of all – but one thing hits close to home: that "the enforcement of the law will likely victimize Bangsamoro people."

There are so far 22 petitions against the anti-terror law, but a Moro petition is deeply personal and revisits the wounds of a long persecuted community that's now asking the Supreme Court to get rid of a law seen to victimize them even more.
Anak Mindanao Representative Amihilda Sangcopan and Basilan Representative Mujiv Hataman led a group of Moros composed of lawyers, artists, and preachers, in filing on Tuesday, August 4, the 22nd petition against the anti-terror law, the 2nd Moro group to do so.
Their premise is simple: Muslims and Moros alike have long been victims of cultural and religious discrimination, not least at the hands of government forces who have arrested and jailed many of them for mistaken identity.
"In Mindanao, especially in Muslim communities, it is a frequent occurrence that mosque-goers, Quran reciters, prayer-callers, even simple market vendors and truck drivers are dragged away by law enforcers – simply on suspicion that they are supporters, relatives, co-conspirators or active participants in acts of rebellion, kidnapping and what now constitutes terrorism," said the Hataman petition.
"The anti-terror law threatens to legalize these clearly abhorrent state actions," said their 83-page petition that seeks to declare the anti-terror law unconstitutional, and asks the Court to immediately stop its implementation by way of a Temporary Restraining Order (TRO).

This was the cry of the more than 200 former members and supporters of the New People’s Army (NPA) and Militia ng Bayan (MB) during the Peace Rally in Maco on Friday.
The peace rally was the culmination activity of the four-day Peace Building Seminar participated by 11 people’s organizations composed of the communist group’s former members and supporters.
One of the participants in the rally was Alias Nanay Lora, who claimed to be a former speaker in the mass demonstrations of the CPP-NPA in Tagum City and Davao City.
Started supporting the communist movement since 1985, she said she was being fed and guided by the communist leaders on what she will say during the rallies.
Nanay Lora decided to surrender as she emphasized that she was already awaken from the lies and deception of the movement.
“Nalipay ko nga ning abot mi sa ingon ani nga panahon kay kung wala pa mo (goberno), wala mi kabalo kung asa mi padung. Karon kay nia man mo nagpahigmata namo, naghatag pud og dan nga naa dinha ang tinuod nga goberno nga motanaw sa mga kabos nganong amo manang balibaran.” (I am so happy that we reached this kind of period because if you (government) are not here, we will not know where we will be going. Now that you are here opening our eyes, you also made a way for us to be aware that the true government will look over us, who are poor, so who are we refuse it.)
Nanay Lora also stressed that even on her old age, she still has dreams for her grandchildren. She bared that the local government unit of Maco provided her a job that helped her family in their daily needs.

Governor Uy accepted it saying that he will meet with the different organizations soon to hear from them one by one their plans and programs.

DAVAO DE ORO, August 4 (PIA) - Ibagsak ang CPP-NPA-NDF!
This was the cry of the more than 200 former members and supporters of the New People’s Army (NPA) and Militia ng Bayan (MB) during the Peace Rally in Maco on Friday.
The peace rally was the culmination activity of the four-day Peace Building Seminar participated by 11 people’s organizations composed of the communist group’s former members and supporters.
One of the participants in the rally was Alias Nanay Lora, who claimed to be a former speaker in the mass demonstrations of the CPP-NPA in Tagum City and Davao City.
Started supporting the communist movement since 1985, she said she was being fed and guided by the communist leaders on what she will say during the rallies.
Nanay Lora decided to surrender as she emphasized that she was already awaken from the lies and deception of the movement.
“Nalipay ko nga ning abot mi sa ingon ani nga panahon kay kung wala pa mo (goberno), wala mi kabalo kung asa mi padung. Karon kay nia man mo nagpahigmata namo, naghatag pud og dan nga naa dinha ang tinuod nga goberno nga motanaw sa mga kabos nganong amo manang balibaran.” (I am so happy that we reached this kind of period because if you (government) are not here, we will not know where we will be going. Now that you are here opening our eyes, you also made a way for us to be aware that the true government will look over us, who are poor, so who are we refuse it.)
Nanay Lora also stressed that even on her old age, she still has dreams for her grandchildren. She bared that the local government unit of Maco provided her a job that helped her family in their daily needs.

CALOOCAN CITY, Aug. 5 (PIA) – Lt. Gen. Cirilito E. Sobejana, a Medal for Valor awardee formally assumed leadership of the Philippine Army on Tuesday, August 4, 2020.
In a Change of Command Ceremony, National Defense Secretary Delfin N. Lorenzana, led the turnover of leadership from newly-installed Armed Forces of the Philippines Chief of Staff Lt. Gen. Gilbert I. Gapay to Sobejana.
“We are gathered here to witness this event, the changing of the guard of the Philippine Army, the premiere service of the AFP,” Lorenzana said during the ceremony.
“Expectations will be high on both. The Command will be looking at the new Commander for leadership and inspiration. The Commander on the other hand will be expecting no less than full cooperation from his men,” he added.
Known for his combat exploits, Sobejana started his military career in 1983 and graduated as a member of the Philippine Military Academy “Hinirang” Class of 1987.
He is considered as one of the country’s living heroes, being a recipient of the Medal of Valor, the highest military honor bestowed for demonstrating bravery and sacrifice above and beyond the call of duty when he fought Abu Sayyaf terrorists in 1995.
He commanded different units of the Army most notably the 1st Scout Ranger Company and the 3rd Scout Ranger Battalion where both units were adjudged as Best Company and Best Battalion, respectively during his stint.
He also served as the Commandant of the Scout Ranger Training School, First Scout Ranger Regiment (FSRR); and as Commander of the Civil-Military Operations Group. He later served as Assistant Chief of Staff for Operations, G3, PA and then commanded the 601st Infantry Brigade, the Joint Task Force “Sulu”, and the 6th Infantry “Kampilan” Division.
In 2013, he was sent in the truce line between Syria and Israel as the first Filipino to become the Chief of Staff of the United Nations Disengagement Observer Force. Prior to his assumption as Army Commanding General, he served as Commander of the Western Mindanao Command since June 2019.
In May 2019, President Rodrigo Duterte bestowed him the award of Philippine Legion of Honor (Degree of Officer), for exceptionally meritorious conduct in the performance of outstanding service rendered to the Philippine government, particularly to the Armed Forces of The Philippines. And in July 2019, the first parliament of Bangsamoro Transition Authority of the Bangsamoro Autonomous Region In Muslim Mindanao (BARMM) passed resolution NR 18, commending Sobejana for his unwavering support in the peace process and commitment in bringing peace in the Bangsamoro Homeland.
Sobejana emphasized the Army’s key role in maintaining peace and hampering terrorism through the Anti-Terrorism Law.
“The attainment of peace is a collaborative people-empowered undertaking. It must involve the commitment and support of the community, the government, the private sector, including our stakeholders and other members of the uniformed service, all working to attain the common good and interest and service of others,” Sobejana said.
“As soldiers of the Republic of the Philippines, we are public servants; the protector of the Filipino people and defenders of our territory. We must do our job,” he added.
