OPAPP sets transitional justice, reconciliation recommendations in motion

From the  Philippine News Agency (Mar 18): OPAPP sets transitional justice, reconciliation recommendations in motion

Presidential Adviser on the Peace Process (OPAPP) Sec. Teresita Deles has assured recommendations made by the Transitional Justice and Reconciliation Commission (TJRC) to forward the Bangsamoro peace process will be operationalized.

The recommendations were included in a report launched to the public on March 15 in Cotabato City.

During the launch, Deles said Executive Secretary Paquito Ochoa, Jr. issued a memorandum of instructions to OPAPP to put in motion the recommendations in the report.

The TJRC conducted various consultations across the country on what would be an important component to promote healing and reconciliation among the communities affected by the decades-long armed conflict in Mindanao.

Deles outlined concrete actions on how the TJRC report could be implemented.

“We will seek at the earliest possible time to draw up Memoranda of Agreements to institutionalize the partnership along these different tasks with selected government agencies,” she said.

The government agencies are the National Commission on Muslim Filipinos (NCMF); the National Commission on Indigenous Peoples (NCIP); the Department of Education (DepEd); the National Historical Commission (NHC); the Claims Board for Human Rights Victims of Martial Law; the Autonomous Region in Muslim Mindanao (ARMM) regional government; and the Department of Environment and Natural Resources (DENR).

Deles said that those agencies “have already initiated relevant processes and reforms on which the work of truth-telling, memorialization, redress, and reconciliation can build.”

“As well, we will try to expand our efforts by tapping the expertise and knowledge base of the academic community and civil society,” she added.

Despite setbacks, Deles called on everyone "not to give up" on the peace process.

“This Bangsamoro opportunity is one we ignore at our own peril. And we take heart in seeing that the parties in this peace process are not ignoring this opportunity and are in fact doing all they can to make sure we take it and make the most of it. Despite setbacks and difficulties along the way, no one is backing out. No one is giving up—not the MILF, not the government. And we ask you not to give up as well,” Deles said.

The TJRC finished drafting its report in December 2015 and subsequently submitted to the Philippine government (GPH) and the Moro Islamic Liberation Front (MILF) negotiating panels during their meeting in Kuala Lumpur, Malaysia held on Feb. 10 to 11, 2016.

BBL passage still best solution to end Mindanao armed conflict – TJRC report

From the  Philippine News Agency (Mar 18): BBL passage still best solution to end Mindanao armed conflict – TJRC report

The enactment into law of the proposed Bangsamoro Basic Law (BBL) remains the top recommended action as a means to close the decades-old Bangsamoro armed struggle, according to a report released by the Swiss-led Transitional Justice and Reconciliation Commission (TJRC).

In the public launch held at the city yesterday, the TJRC report stated that the legislation of a Bangsamoro law that provides for a political and institutional infrastructure pursuant to the Comprehensive Agreement on the Bangsamoro (CAB) could guarantee the non-recurrence of the Mindanao armed conflict.

“The TJRC recommendations cannot replace a durable peace agreement and its legal framework,” TJRC chairperson Mô Bleeker said. “Solving the Bangsamoro situation in a durable manner offers a unique opportunity for a modern State to manage the diversity inherent in any modern democracy in a constructive manner.”

“Similarly, the Bangsamoro aspire to a political framework, which will enable them to practice good governance, to develop their region and their people, to proudly assert their identity, and to ensure a constructive engagement with their own multiethnic constituency.”

The TJRC also stressed that the implementation of the CAB “is a unique and extraordinary opportunity not only for Bangsamoro, but also for the whole Filipino nation”.

“It offers an opportunity for the historical and cultural resilience of the Bangsamoro and indigenous peoples to be recognized as a vibrant and constructive part of the Philippines, based on the acknowledgement of plural identities. This is indeed a historical opportunity for the Bangsamoro and that this is indeed a historical opportunity for the Philippines,” the report stated.

The report was first launched publicly in Cotabato City earlier this week in an event that was attended by Secretary Teresita Quintos-Deles, Government of the Philippines (GPH) chief negotiator Professor Miriam Coronel-Ferrer and Moro Islamic Liberation Front (MILF) chief negotiator Mohagher Iqbal, together with more than 200 individuals, organizations, and representatives from local, regional, national, and international entities.

As stipulated in the CAB, the TJRC was mandated to undertake a study and to make recommendations, based on consultations and expert’s studies, with a view to promote healing and reconciliation among the conflict-affected communities in the Bangsamoro. The said TJRC report was a product of consultations with more than 210 Moro, indigenous, and settler communities in Mindanao and the Sulu archipelago, involving some 3,000 community members and local officials.

On her remarks delivered at the Cotabato City launched, Deles revealed that Executive Secretary Paquito Ochoa, Jr. issued a memorandum of instruction to the OPAPP to put the recommendations in the TJRC report in motion.

According to Deles, the memorandum included the following instructions: “(1) endorse the TJRC Report to the relevant agencies for the agencies’ review and assessment; (2) convene and coordinate with the agencies to work towards the adoption and implementation of the recommendations; and (3) identify and mobilize resources to support the programs that may be implemented. In addition the PAPP is likewise mandated to encourage and initiate activities towards the mainstreaming and popularization of the framework for transitional justice and reconciliation. Finally, the PAPP is required to present a report to the Executive Secretary on her compliance with these instructions.”

Swiss Ambassador to the Philippines Andrea Reichlin lauded the TJRC for its significant contribution to the Bangsamoro peace process. “The TJRC makes a number of recommendations that are implementable as of today. But prompt action initiated by the national body is essential to sustain the peace process and mitigate the rising conflicts,” she said.

Meanwhile, GPH peace panel member Secretary Senen Bacani maintained that the BBL is still of primary importance in continuing the peace roadmap which was stalled due to Congress’ failure to enact the Bangsamoro law last February. “We admit that our roadmap to peace has been adversely affected by the non-passage of the BBL in this Congress. Despite this, however, President Aquino himself has made clear that the BBL remains the most suitable path to peace and development in Mindanao.

“And so, we continue to work and hope for the early passage of the bill in the next Congress, so we can move full steam ahead in implementing fully the CAB at the soonest possible time,” Bacani added.

MILF peace panel Abhoud Syed Lingga also noted that there could be a challenge in implementing the recommendations of the TJRC because the BBL, which was a pre-requisite in the execution of the CAB, was not passed. “Although implementation of other provisions of the agreement, including that of the recommendations of the [TJRC] report, cannot replace the BBL. [I]t will be useful in pursuing the peace process that the report’s recommendations will be carried out,” Lingga said.

DND starts construction of inter-agency building, PN detachment in Batanes

From the  Philippine News Agency (Mar 18): DND starts construction of inter-agency building, PN detachment in Batanes

Construction of an inter-agency building and Philippine Navy (PN) detachment in Mahatao, Batanes formally started on Thursday.

The groundbreaking ceremonies were spearheaded by Department of National Defense (DND) Secretary Voltaire Gazmin, Batanes Rep. Henedina Razon-Abad and Vice Gov. Ronald A. Aguto.

The project, initiated and proposed by Rep. Razon-Abad in 2014, is included in the 2016 General Appropriations Act budget of the PN and amounts to Php166.519 million.

It includes a naval logistics facility, wharf and beaching areas, small craft facility, and communications and electronics facilities.

“We envision a naval base that shall have accessible naval installations which could provide logistics, training and others support services in the conduct of prompt and sustained fleet and marine operation,” Gazmin said.

Aside from the PN, the inter-agency building will also be utilized by the Philippine Coast Guard and the Bureau of Fisheries and Aquatic Resources of the Department of Agriculture.

With the construction, the PN aims to improve the existing capability and infrastructures of the current Mahatao Boat Shelter to be utilized for training exercises, combat, and humanitarian assistance and disaster response operations.

“This place is chosen as the most strategic area as testified by historical facts during World War II. It has also naturally protected and safer harbor spaces for our naval vessels, considering that the province of Batanes has been the frequent route of storms and typhoons, especially during the rainy season,” Gazmin said.

Hataman rallies Bangsamoro never to forget Jabidah Massacre

From the Philippine News Agency (Mar 18): Hataman rallies Bangsamoro never to forget Jabidah Massacre

Regional Gov. Mujiv Hataman of the Autonomous Region in Muslim Mindanao (ARMM) on Friday reminded the Bangsamoro people not to forget the lives offered in the name of peace in Mindanao.

"Today we continue this difficult task of remembering, a task that is necessary in the greater struggle for our rights as Bangsamoros, a struggle that we wage for lasting peace and genuine justice," Hataman said in his message in commemoration of the 48th Jabidah Massacre in Corregidor.

He said it has been almost five decades since the Jabidah Massacre left its mark on the Bangsamoro consciousness, a mark "akin to a wound that has never fully healed as its scab is picked over and over again with every other act of injustice committed against our people."

The regional governor said for Bangsamoro people, the story of Jabidah needs no introduction. "In our minds and hearts, there is no question that it happened and that it is true. In our history, there is no question about its rightful place in the long narrative of our struggle for self-determination."

The infamous Jabidah Massacre refers to the mass killing of about 60 Moro recruits trained by Marcos government allegedly to invade Sabah, Malaysia on March 18, 1968.

Hataman said for many other Filipinos, the reality of the Jabidah Massacre remains either unknown or denied.

"In the midst of all the unknowns and denials, this is what we know: During the Marcos regime, Bangsamoro men were taken to Corregidor from the island provinces of Basilan, Sulu, and Tawi-tawi, and were recruited to be part of an elite commando group called Jabidah. This group has been tasked to carry out Operation Merdeka, an operation that involved destabilizing Sabah, allowing the Philippines to take over the area."

Hataman recalled the incident by narrating: "One night, their military handlers began to take them by the dozen to a remote airstrip. Here our brothers were executed as they were shot with machine guns, making sure not one of them survived. They were indiscriminately shot at and summarily executed, after being treated unfairly throughout the duration of their supposed training."

"The number of Bangsamoro men killed ranges from eleven to the thousands. No one knows for sure. This is because our history knows not the exact numbers or dates, because our history has always been subjected to denial and erasure," he added.

He said that incident triggered a series of atrocities by the Marcos military to Moro communities in southern Philippines, triggering Moro uprising the years that followed.

"After so many of our communities have been burned down, so many of our families torn apart by war, and so many of our children growing up while fighting injustice, the murder of our brothers who wanted only to fight for our country was the final straw. Jabidah became the spark which started the flames of our struggle," he said.

"It is our history that speaks of our pain and healing, of conflict and survival, of losing and seeking our rightful place in this country. It is a history that has been seared onto our minds and our hearts by the fire of our long and difficult struggle, because no there is no other way for us to remember," the regional governor said as he declared a non-working holiday in the five provinces of ARMM.

"Never again will we allow our people be hidden by the shadows of the past, and we will never forget our people whose lives depend so much on peace and whose deaths strongly demand justice," he said.

ARMM is composed of the provinces of Maguindanao, Lanao del Sur, Basilan, Sulu and Tawi-Tawi.
