From ANC/ABS-CBN (Aug 13): Video: Senate version of BBL 'no longer recognizable': Jaafar
[Video report: Interview with Ghadzali Jafaar, MILF vice chairman for political affairs]
The Moro Islamic Liberation Front is still willing to work with senators towards an acceptable version of the proposed Bangsamoro Basic Law.
MILF vice-chairman for political affairs Ghazali Jaafar admitted while the Senate version of the BBL is in accordance with the Constitution, the measure was changed drastically and is no longer recognizable from the Bangsamoro Transition Commission's draft.
But Jaafar said the MILF still hopes to see the passage of a measure that will be an effective vehicle for lasting peace and development in Mindanao.
"It may be constitutional but will it serve the purpose why BBL was created? The other concern is - will it be accepted by the people? Yan ang mahalagang katanungan."
"Pagsisikapan namin na mabago ang ibang provisions na binago na. At the end of the day, kung bigo ang mga Muslims at least ginawa namin ang lahat," he said.

AFP apologizes to UN Special Rapporteur, officer resigns
ABS-CBN (Aug 13): AFP apologizes to UN Special Rapporteur, officer resigns
The head of the Eastern Mindanao Command of the Armed Forces of the Philippines (AFP) has accepted the resignation of its spokesperson, Col. Eduardo B Gubat.
Gubat announced this in a press statement that also apologized to UN Special Rapporteur for Internally Displaced Persons Chaloka Beyani.
"This pertains to the press release dated 07 August 2015 entitled 'Lumad in Haran are Manipulated: Not Evacuees but Victims of Trafficking.' The description of Haran Lumads as trafficked persons was the assessment of the AFP's Eastern Mindanao Command and not of the UN Special Rapporteur Cheloka Beyani," the statement said.
"The effect of the statement was not intentional. I, the Spokesperson of the Eastern Mindanao Command, Colonel Eduardo B Gubat INF (GSC) PA, humbly apologizes to UN Rapporteur Cheloka Beyani for such oversight and for the inconvenience it has brought to the UN Rapporteur. By reason of such statement, Lt. Gen. Aurelio B. Baladad, AFP, Commander of Eastern Mindanao Command, AFP has approved of my resignation as spokesperson."
The announcement came hours after Beyani sent Philippine journalists a personal statement, accusing the AFP of "incorrect, unacceptable, and represents a gross distortion of my views." The UN official's statement followed the EastMinCom's release that claimed Beyani said lumad evacuees in Davao City are victims of "human trafficking."
The AFP used one quote by Beyani to bolster its standing claim that church and militant groups were forcibly keeping lumad from Davao del Norte and Bukidnon at the Haran sanctuary of the United Church of Christ of the Philippines. It quoted Beyani as saying the lumad had been manipulated by rights groups.
Despite the apology, the military statement states: "However, the Eastern Mindanao Command maintains that Dr. Beyani in his exit briefing described that the Indigenous People in Haran are manipulated. "
Beyani's latest statement says: : My reference to their being 'manipulated' related to the attempt to forcibly move them out of the UCCP facility without proper and adequate consultation with them. He was referring to the July 23 "rescue" attempt by North Cotabato Rep. Nancy Catamco, who brought along more than 500 cops, troops and paramilitary forces. Fifteen lumad and church workers and four cops were injured before Davao City officials intervened and restored peace.
The EastMinCon said it takes the UN official's remarks "constructively as guide in pursuing its mandate of protecting the Indigenous Peoples from the manipulation of unscrupulous individuals and organizations and help alleviate their sufferings and achieve the self determination they are working for."

Humanitarian and civic missions highlight US Navy partnership with Pangasinan
From the Philippine Information Agency (Aug 11): Humanitarian and civic missions highlight US Navy partnership with Pangasinan
LINGAYEN, Pangasinan, Aug 11 (PIA) – Humanitarian and civic missions highlight the three-day stay of the United States Navy servicemen in Pangasinan for the Pacific Partnership 2015 with the provincial government.
The 70-member team is set to do a series of surgical missions, hospital engagements, disaster and risk reduction management, veterinary mission, public health and environmental sanitation visits that started Monday, August 10 until August 12.
Commander Greg Montalto, director for Medical Operations of the US Navy, said the Pacific Partnership 2015 personnel will work and train side-by-side with the Pangasinan community adding that collaboration strengthens international partnership.
“The mission’s emphasis is the transfer of knowledge and also the friendships that we will undoubtedly make. This is far more long lasting than any other equipment,” Montalto told Pangasinan media during a press conference held at the Capitol compound.
Gov. Amado Espino, Jr. expressed his gratitude to the US Navy team for including Pangasinan in their partnership itinerary.
“This is a wonderful opportunity for our medical team because they can teach us techniques especially on disaster response and on the responses to various diseases such as tuberculosis, leprosy, leptospirosis and dengue that worsen during disasters,” Espino said.
Provincial Health Officer Anna Theresa De Guzman said the province has arranged hospital engagements for the team particularly at the Pangasinan Provincial Hospital (PPH) and Region I Medical Center where emergency protocols will be observed.
“We have Philippine guidelines but it is also good to know the international standards so we can compare and know how far we are coping,” De Guzman said adding that the Philippines is bent on its campaign to become a medical tourism destination.
Now on its tenth iteration, Pacific Partnership 2015 is said to be the largest annual multilateral humanitarian-assistance and disaster-relief preparedness mission in the Indo-Asia-Pacific region. Under the program, a hospital ship, USNS Mercy, and a support vessel, USNS Millinocket, are main components of the operation. The missions have provided medical care to approximately 270,000 patients and veterinary services to more than 38,000 animals.
PP15 personnel for the Philippine mission include eight Filipino personnel, with four of them tracing their roots from Pangasinan.

NPA perpetrator in killing captured, charged
From the Philippine Information Agency (Aug 11): NPA perpetrator in killing captured, charged
CAMP EVANGELISTA, Cagayan de Oro City – The joint elements from the Philippine National Police (PNP) and 58th Infantry “Dimalulupig” Battalion successfully apprehended the two New People’s Army (NPA) members who are perpetrators of attacking Medina PNP Station last August 27, 2011 that left one PNP personnel and a rebel killed and responsible in murdering the three un-armed and off-duty CAFGU Active Auxiliary (CAA) members assigned with Hindangon Patrol Base in Barangay Hindangon, Gingoog City on July 19, this year.
The two NPAs identified as Danilo Lampusay a.k.a Dan-Dan and Ejohn Lampusay were both apprehended last August 3, 2015 at Purok 2, Barangay Minalwang, Claveria, Misamis Oriental by virtue of warrant of arrest and with the help of a former rebel who pinpointed their location.
Based on the revelation from their former comrades, the two are regular members of Sangay sa Partido Pampropaganda 3, Guerilla Front 4B, North Central Mindanao Regional Committee (SPP3, GF4B, NCMRC) under Open Hangadon a.k.a Tingcas who led the recent attack at Hindangon CAA Patrol Base and murdered the three CAA members.
The two individuals were also found to be implicated in the attack of Medina PNP Station of Medina town in Misamis Oriental.
Major General Oscar T Lactao, commander of the 4th Infantry Division said, “While the two are on the hot seat, their leader, who is the brain behind the attack remains at large. This is the consequence when you join the NPA. There will be nobody, not even your leaders, will come to your aid when you are put in a situation that warrants you to justify your unlawful actions. You are on your own to tend the charges against you. Soon the long arms of the law will reach their leaders and will face all the crimes they’ve committed against humanity.”
“Let this serve as a lesson to all members of NPAs and to those who are planning to join the armed struggle. NPA leaders are not concerned about your welfare, they are only using you to pursue their vested interest and in destroying the hopes and dreams of Filipinos in achieving peace and development. I urge you to contemplate and come to a decision of leaving the armed struggle and return to mainstream society and live a normal life with your love ones”, said MGen Lactao. (4ID PA)

Palace: Philippines focused on diplomatic approach to settle South China Sea row
From the Philippine News Agency (Aug 13): Palace: Philippines focused on diplomatic approach to settle South China Sea row
http://www.pna.gov.ph/index.php?idn=1&sid=&nid=1&rid=793163
The Philippines
is focused on pushing for a peaceful solution to its territorial row with China ,
a Malacañang official said on Thursday.
While there may be a reasonable basis for arms build-up, as
projected by Supreme Court Associate Justice Antonio Carpio, the Philippine
government’s diplomatic approach remains, Communications Secretary Herminio
Coloma Jr. told reporters during the daily press briefing.
“Mayroong makatuwirang batayan si Justice Carpio para
maglatag ng sitwasyon na maaaring maganap ‘yung tinatawag na arms build-up or
defense build-up, pero ang focus po natin diyan ay hinggil doon sa rules-based,
diplomatic approach to achieving a peaceful solution,” Secretary Coloma
explained.
Justice Carpio said that unless the South
China Sea issue is resolved, countries involved in the territorial
dispute will boost their respective navies and air forces.
"Ang nabatid natin hinggil sa pakikipag-talakayan ni
Justice Carpio sa mga miyembro ng Senado ay ito: Sinabi niya na mahalaga 'yung
pagkakaisa ng mga bansa sa ASEAN para makabuo ng isang unified stand at batid
natin na nagsisikap ang mga bansa sa ASEAN na bigyan ng sustansiya ang Declaration
on the Conduct of Parties in the South China Sea sa pamamagitan ng pagbubuo ng
isang legally binding code of conduct. Iyan ang focus ng ating atensyon,” said
Coloma.
On Tuesday, Chinese envoy Zhao Jianhua said China will
start building facilities to support freedom of navigation, search and rescue
efforts, and scientific research on the reclaimed islands.
Coloma said China should stop the construction work in the
disputed waters, reiterating the Philippines’ position that was presented by

Charges filed vs military officers
From the Mindanao Times (Aug 13): Charges filed vs military officers
LT. GENERAL Eduardo Año, Commanding General of the Philippine Army, and two military officials are facing charges filed before the City Prosecution Office yesterday afternoon for their alleged involvement in the death of three people in Purok 7, Barangay Paradise Embac in Paquibato District.
Año, former commander of the 10th Infantry Division, Lt. Col. Rodney Intal, commander of 69th Infantry Battalion and 1st Lt. Christopher Santos, operations officer of the 69th Infantry Battalion, are facing charges for three counts of murder, six counts of frustrated murder, robbery, serious physical injury, grave threats and grave coercion.
The complaints were lodged by Aida Seisa, Rosita P. Sanduanan and Nestor Flores all residents of Paradise Embac, Paquibato District.
Initial reports said that the incident happened at 12:05 a.m. of June 14, 2015, when Datu Ruben Enlog, tribal leader and chair of Nagkapul; Ramil Enlog and Randy Carnasa were killed on the spot.
The filing of charges was assisted by progressive group Karapatan.
Seisa, in her signed affidavit, said that on the night of July 13 they were having an advanced wedding anniversary and birthday celebration of their daughter because her husband, will be going away for two months.
Seisa’s 12-year-old daughter was wounded during the attack.
Seisa is a leader of Paquibato District Peasant Alliance and secretary general of Sabokahan, an organization of Lumad women.
Lt. Col. Intal earlier said the military operation was legitimate as they acted on a report from local residents who complained of extortion from armed groups in the area.
Capt. Alberto Caber, information officer of Eastern Mindanao Command, also claimed that soldiers recovered one M14 rifle, two unexploded improvised explosive devices (IEDs) and backpacks at the area.
The city council on Tuesday passed a resolution requesting the 69th Infantry Battalion to pull out the detachment in Paradise Embac, Paquibato District.
The Commission on Human Rights (CHR) on June 16 has started their independent investigation on the deaths of three people in Paquibato District. CHR-Davao chief investigator Emiliano Cajes earlier said that the evaluation would focus on the human rights aspects of the incident.
However, the CHR is yet to issue a resolution on the incident.

THE CITY council yesterday passed a resolution requesting the 69th Infantry Battalion to pull out the detachment in Paradise Embac, Paquibato District following the deaths of three Lumads during a reported clash last month.
Army detachment told to leave barangay over deaths of 3 Lumads
THE CITY council yesterday passed a resolution requesting the 69th Infantry Battalion to pull out the detachment in Paradise Embac, Paquibato District following the deaths of three Lumads during a reported clash last month.
The resolution, passed yesterday at the regular session of the Sangguniang Panlungsod, also urged the Commission on Human Rights to investigate the incident.
Singled out by the resolution was 1Lt. Christopher Santos and his unit, whom Councilor Karlo Bello said may have “caused terror” on the residents of Paradise Embac.
Bello chairs the city council committee on human rights.
Councilors Danilo Dayanghirang and Elias Lopez initially abstained from supporting the resolution, citing due process and the body’s lack of authority to recommend any military action or pullout.
Last month, Bello requested the CHR to study the possibility of filing murder charge against military officials liable for killing three people in the area.
An earlier copy of the committee report quotes Bello as saying the CHR should look into the allegations against Lt. Christopher Santos and the soldiers under his command over the death of Datu Ruben Enlog, tribal leader and chair of Nagkapul; Ramil Enlog and Randy Carnasa.
The report read, “The council reiterates the disbelief that the military should respect and recognize the right of the individuals to exercise their freedom of expression, a basic and fundamental pillar of democracy, even if what is expressed is anti-government or undemocratic as long as they do not take up arms or pose danger to others, without branding them as ‘communist’ and unduly isolating them from the community.”
The CHR, for its part, said it had already conducted an investigation immediately after the incident.
Progressive group Karapatan earlier accused the military of lying when it said the casualties were members of the New People’s Army who reportedly shot at a soldier of the 69th Infantry Battalion.
But 69th IB commander, Lt. Col. Rodney Intal, said it was a legitimate operation as they acted on a report from local residents who complained of extortion from armed groups in the area.
Bello, on the other hand, said the committee is “not fully convinced that a legitimate encounter actually took place and the deceased were members of NPA.”
The AFP, in supporting documents submitted to the city council last week, said they were serving a warrant of arrest for fallen rebel leader Leoncio Pitao alias Parago, who was sighted in the area during the incident.
Military, police won’t budge on Haran case
From the Mindanao Times (Aug 13): Military, police won’t budge on Haran case
THE POLICE and military refused to withdraw the case they have filed against the militant leaders in Haran as demanded by the New People’s Army in exchange for the release of the four tribal leaders abducted in Talaingod, Davao del Norte last August 1.
Speaking in yesterday’s AFP-PNP press conference held at Mandaya Hotel, Sr. Supt. Aaron Aquino, Deputy Regional Director for Operations in Police Regional Office XI, told reporters that they will not withdraw the case.
Aquino said that cases of human trafficking, illegal detention and serious phjysical injuries have been filed against the militants.
”We will not withdraw the case that we filed in court. In fact, we have filed appropriate charges on the abduction of the tribal leaders,” Aquino said.
He suggested that a consultative meeting should be done involving the NCIP, AFP, PNP and other concerned agencies to look into the release of the Datus.
Lt. Col. Eduardo Gubat, spokesperson of Eastern Mindanao Command, also denied the allegations of the militant groups that the Datus were on their hands .
In an interview with Datu Nestor Apas of Langilan-Manobo Tribe, he said that there was an unidentified person who contacted him asking for the withdrawal of the case filed against the militant leaders in Haran.
“I was called Monday morning to withdraw the case but I told them that I cannot withdraw because I was not the one who filed the case,” Apas said.
Based on reports that they have received, the Datus who were abducted are in the boundary of Talaingod, Davao del Norte and San Fernando, Bukidnon held by the Guerilla Front 55 of New People’s Army.
In a press conference held at the Executive Building in San Fernando, Bukidnon last Tuesday, Municipal Mayor Hon. Levi C. Edma told reporters that he is asking the support of the military to intensify their intelligence monitoring to be able to rescue the four tribal leaders.
However he assured that their families will be given assistance from the local municipality of San Fernando.
Barangay Captain Jan Jose Baon also told reporters that prior to the abduction, the Datus were about to settle a tribal feud that happened in Talaingod when they were blocked by armed men along the way.
“When we learned about what happened, we immediately reported it to police and the military,” he said in the dialect.
According to Baon, they are worried about the families of the four Datus.
“We are worried and concerned because one of the Datus abducted adopted the children of the Lito Lundia, a lumad who committed suicide,” Datu Jimmy Lacubay, Indigenous People Mandatory Representative (IPMR) at the Sangguniang Barangay, said.
Sr. Inspector Rham Camelotes, Commander of San Fernando Police, said they immediately conducted an investigation and coordinated with Talaingod Police to verify the incident in the area.
“As of now, we are looking at what case we will file against the NPA’s,” he said.
karon amo nang ginatan aw kung unsa ang kaso na ma file namo sa NPA’s,” he said.
Lt. Col. Francis Carter Sibal, Civil Miltary Operations(CMO) Battalion Commander, asked cooperation from the community to report immediately to them the situation so they can monitor and secure the residents.
Pangayaw
Meanwhile, Datu Apas said that they have set a timeline for the rebels to release the tribal leaders on Monday noon since their Bagani (warriors) are already preparing for a tribal war or “Pangayaw”.
“We made a ritual with our spiritual leader asking for the spirit’s consent for a Pangayaw where the camp of the rebels and the tribes are located,” he said.
“We ask the military not to join us because this is the affair of the tribe and our warriors will take charge,” Apas said.
Caber says Karapatan’s claim is just ‘malicious propaganda’
From the Mindanao Times (Aug 13): Caber says Karapatan’s claim is just ‘malicious propaganda’
THE MILITARY decried as “malicious propaganda” the claim of progressive groups that they are coercing the lumads to join protests in Tagum and Davao City.
Capt. Alberto Caber, information officer of the Eastern Mindanao Command, told TIMES yesterday that “it is a clear black propaganda against us to hinder our operations.”
Caber said that Karapatan has never said anything good about the government and that all the rallies here have been instigated by the group especially the one at the Haran compound of the UCCP Church.
Karapatan on Wednesday morning issued a statement saying some lumads from Sitio Laslasakan, Talaingod, Davao del Norte reported that they have been forced by the military to join protests in Tagum and Davao City.
“Nino, whose name was held for security purposes, said that he and his companions in Sitio Laslasakan were harassed by the military, and then coerced to falsely admit that they were NPA,” the statement read.
The statement added that after a few days, Nino was brought to Talaingod, where he and some other people were presented as rebel returnees to the public.
Then, they boarded trucks and were sent to the Radyo ni Juan station in Tagum City, where they were told to rally against the said station on June 12.
Nino said that they were told by the soldiers to shout to Radio ni Juan that they should do their reportage properly and not hit on the military.
After their protest in Tagum they were brought to Camp Panacan in Davao City to protest and call for the return of PDAF, for the removal of the Salugpungan schools, and for the military to remain in Talaingod.
Meanwhile, Hanimay Suazo, secretary-general of Karapatan-SMR, said that the case of Nino and several others are again another glaring example of the military’s tactic of pitting the lumads against each other.
“Lt.Col. Zosimo Oliveros of the 68th IB and Col. Harold Cabreros of the 1003rd have been making puppets of the Talaingod Manobos. It is clear that their presence and hand in Talaingod bring nothing more but even greater hardships for the people,” she added.
