From the Philippine News Agency (Dec 17): DOJ summons 30 PNP-SAF members to appear at Mamasapano probe

Thirty members of the Philippine National Police-Special Action Force (PNP-SAF) were summoned to appear before the Department of Justice's hearing of the Mamasapano encounter that claimed the lives of 44 SAF troopers last Jan. 25.

The 30 PNP-SAF members, who were earlier probed by the PNP Board of Inquiry, failed to appear at the preliminary hearing on Thursday.

During the hearing headed by Sr. Asst. State Prosecutor Rose Anne Balauag, it appeared that they have failed to send the subpoena for the 30 PNP-SAF members to subscribe to their sworn affidavits.

Only four PNP-SAF officials, headed by Chief Supt. Noli Talino, appeared before the hearing to execute their affidavits.

Majority of the 30 members of the 84th Searborne Company were already transferred to another unit, Talino said.

Hence, Talino suggested that a subpoena be sent through the PNP Directorate for personnel and records.

Meanwhile, only three of the more than 90 respondents in the case of complex crime of direct assault with murder and theft have submitted, through their lawyers, their respective counter-affidavits on Thursday.

The case was for the death of 35 PNP-SAF commandos who were killed in a cornfield in Tucanalipao, Mamasapano, Maguindanao on Jan. 25 this year.

However, the case for the death of the nine PNP-SAF troopers who were killed in the nipa hut, where international terrorist Zulkifli Binhir alias "Marwan" was killed, was not filed because the National Bureau of Investigation-National Prosecution Service (NBI-NPS) special investigating team found no witnesses in the area.

Another three respondents, who would like to be furnished a copy of the complaint may file their respective counter-affidavits.

Aside from the six respondents, the complaint against the other remaining respondents is now submitted for resolution.

Because of this, the DOJ panel is expected to rule whether there is probable cause to file the case in court.
