From the Star Online (Jun 7): Another Sulu gunman charged for waging war against the King
KOTA KINABALU: Another member of the Sulu gunmen involved in the Lahad Datu intrusion in February was charged in the High Court in Tawau on Friday with waging war against the Yang di-Pertuan Agong.
Totoh Hismullah was charged under Section 121 of the Penal Code for waging a war against the Agong and Section 130(A) of the Penal Code for his involvement in terrorist activities before Justice P. Ravinthran.
With the charging of Totoh, a total of 31 people, including Malaysian Special Branch policemen Kpl Hassan Ali Basri, have been charged for various offences in connection with the Feb 12 Sulu intrusion that was put down in early April.
Attorney-General Tan Sri Ghani Patail, who headed the prosecution team, told reporters that all suspects have appointed lawyers save one, who will have a lawyer appointed by the court soon.
He said Totoh's case will be transferred to the High Court in Kota Kinabalu High Court, as with the prevoious cases.
He said the case involving Kpl Hassan will be heard on June 24 while cases for the rest of the suspects will be brought up from June 27.
Meanwhile, defence lawyer James Tsai, who was appointed to represent the Philippines government, said they are representing 24 accused.
Tsai also said an application by lawyer Datuk N.Sivananthan to join the team would be heard by the Kota Kinabalu High Court on June 12.
