The camp of dismissed PMA First Class Cadet Aldrin Jeff Cudia on Tuesday asked the Supreme Court to consider and admit the final report of the Commission on Human Rights (CHR) on his case, which would dispute findings of an academy panel that found him guilty of lying,  resulting in his not being allowed to graduate with his “Siklab Diwa” class last March.

In asking the High Court to admit the CHR’s report, Cudia’s mother, Filipina, said her son was deprived of his constitutional right to due process and said his trial was a “sham.”

“Cadet First Class Aldrin Jeff Cudia was given nothing but a sham trial, as members of the investigation team were undoubtedly biased and have respective conflicts of interests against him,” the 12-page motion to admit said.

Mrs. Cudia said the members of the Honor Committee which tried and found guilty her son are the ones who should be held guilty of lying since one of its nine members—Cadet First Class Dalton John Lagura—voted to acquit Cudia, but that the chairman of the Honor Committee, Cadet First Class Mike Anthony Mogol, instead called for a “chambering” in which Lagura was allegedly pressured to change his vote.

Under PMA rules, an accused before the Honor Committee can be acquitted with just one “not guilty” vote.

“The trial of Cadet Cudia by the Committee was a sham. The Honor Committee, with intent and ill motives, violated the human rights of Cadet Cudia - to due process, to education, to dignity, and thereby transgressing even his right to life,” it added.

The CHR report, according to the motion, also did not find Cudia guilty of lying nor of any intention to deceive in the reasons he gave for explaining why he was late for class, the same reasons cited by the Honor Committee in meting the guilty verdict on him.

He was ostracized by classmates after he decided to stay at the Academy while appealing his case, and even after the Honor Committee ordered his dismissal.
