Private prosecutors in the Jeffrey “Jennifer” Laude murder case are set to elevate before the Supreme Court on Thursday two motions which were earlier dismissed by the Olongapo Regional Trial Court.

In the motion asking permission from the court to allow media coverage of the trial proper of the case, lawyer Virgie Suarez, legal counsel for the family of the victim, insisted that the trial of Private First Class Joseph Scott Pemberton should be made open to the public.

Citing the strictness of Olongapo RTC Judge Roline Ginez Jabalde who is presiding over the case, Suarez said it was unconstitutional for the judge to suppress freedom of speech and freedom of information.

The Laude family cited the public's right to know and be informed of happenings inside the court since they said their matriarch, Julita Laude, and other relatives cannot attend every trial of the case due to financial constraints since they reside in the province of Leyte.

The other motion seeks for the transfer of Pemberton from his present detention at Camp Aguinaldo military general headquarters in Quezon City to the Olongapo City jail.

After five witnesses finished presenting their testimonies, the court confirmed that it had issued a gag order on both camps, saying that lawyers are not permitted to discuss merits of the case as well as the testimonies of witnesses.
