SIBAGAT, Agusan Del Sur (DWDD) - The Terrorist New People’s Army (NPA0 has again blatantly violated the International Humanitarian Law (IHL) and the Comprehensive Agreement on Respect for Human Rights and IHL (CARHRIHL) with their abduction of two soldiers and 14 CAFGU Active Auxiliaries (CAAs) a...t Sibagat, Agusan del Sur last December 19, 2018.
According to Brigadier General Andres C. Centino, Commander, 401st Infantry Brigade, based on earlier call by the NPAs North Eastern Mindanao Regional Committee (NEMRC), they demanded for the implementation of a ceasefire before they would release their victims. These actions are proof of the CPP-NPAs blatant violation of the CARHRIHL as they are using the soldiers and CAAs as hostages in gaining advantage in their losing cause.
The Local Government of Sibagat, led by Mayor Maria Liza L. Evangelista and the members of the Municipal Legislative Council as representatives of the people, has already declared the CPP-NPA as “Persona Non-Grata” through a Municipal Resolution No. 137-18 dated 21 December 2018. It condemned the atrocious acts of the terrorist CPP-NPA which is a manifestation of betrayal in achieving peace.
Under the provisions of the CARHRIHL, “persons taking no active part in the hostilities, including members of Armed Forces who have laid down their arms and those placed ‘hors de combat’ by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, color, religion or faith, sex, birth or wealth, or any other similar criteria”.
Also stated is that: “persons who do not participate anymore in hostilities shall not be used as hostages by any party.”
The CARHRIHL also protects the victims against “violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture. 401IBde / MCAG
