CPP/News: Getting away with murder: Before Jennifer Laude, US visiting troops face 10 cases

Propaganda news story posted to the Communist Party of the Philippines (CPP) Website (Sep 11, 2020): Getting away with murder: Before Jennifer Laude, US visiting troops face 10 cases

NEWS STORIES
SEPTEMBER 11, 2020

Rodrigo Duterte’s absolute pardon to US Marine Joseph Scott Pemberton for killing Jennifer Laude in 2014 is only the latest in the string of injustices suffered by Filipinos in the past 22 years in the hands of US visiting troops under the Visiting Forces Agreement. The crimes they have committed against Filipinos have gone unpunished.

Prior to Laude’s murder, at least ten cases against American soldiers who were in the country courtesy of the VFA, have been reported. Most of the perpetrators remain free and those apprehended did not stay a single night in a Filipino cell.

“The VFA gives US military personnel extraordinary rights while in the Philippines which by default exempts them from coverage of local laws,” said Marco Valbuena, public information officer of the CPP. Prior to Pemberton’s pardon, another US soldier, Lance Corporal Daniel Smith was convicted for the rape of a Filipina in Subic, Zambales in 2005. Despite being ordered imprisoned in Makati City Jail, US personnel whisked him to the US embassy in Manila. There was nothing local police officers could do. He remained under US custody until they could arrange for the withdrawal of charges.

“The lack of justice in the Laude killing demonstrates in no uncertain terms why the US-Philippine VFA of 1998 violates Philippine sovereignty and why it must be abrogated,” added Valbuena.

There were at least four cases of shooting involving American soldiers in 2008. These included a massacre of eight individuals in Ipil, Maimbung, Sulu in February in the same year. Among the victims were two children and a pregnant woman.

In 2000, a grenade exploded after US Navy Seals gave a secret training to their Philippine Navy counterparts in Toledo, Cebu. Two boys were killed and another was wounded.

In 2002, a farmer in Tuburan, Basilan was shot by an American soldier participating in combat operations. Indiscriminate shellings and firing also injured residents in Zamboanga City and Indanan, Sulu in 2004 and 2006, respectively. There was no record that the Philippine government filed cases against the perpertrators. The VFA is explicit in prohibiting the trial of American soldiers in the sharia’h courts.

In 2010, Filipino translator Gregan Cardeño was killed inside a facility of the US Joint Special Operation Task Force in Marawi City. US military officials covered up the crime, declaring it a suicide, despite the victim’s body bearing signs of torture and sexual abuse.

The VFA-protected US servicemen are exempted from laws and regulations regarding passports and visa, driver’s license and vehicle registration. These privileges grant them unchecked arrogance on Philippine roads. Locals have been known to complain of abuses by US soldiers as reported in 2007 in Zamboanga City, when, despite being on the wrong for hitting a passenger vehicle, the Americans brandished their weapons and threatened the riders. In March 2000, three US soldiers were reported for mauling a taxi driver.

US soldiers also displayed arrogance and disrespect when they ordered the closure of Panamao District Hospital in Sulu for a month in December 2007. They threatened to shoot anyone who defied the order. .

Duterte, Lorenzana and Chinese defense chief tackle stronger PH-China defense cooperation

From Rappler (Sep 12, 2020): Duterte, Lorenzana and Chinese defense chief tackle stronger PH-China defense cooperation (By PIA RANADA)

General Wei Fenghe's visit to Malacañang comes nearly 3 weeks after the Philippines protested China's confication of Filipinos' fishing equipment near Panatag Shoal

Philippine President Rodrigo Duterte met with China's Defense Minister General Wei Fenghe on Friday, September 11, in the Malacañang Golf Clubhouse to strengthen defense cooperation between their two countries and discuss the South China Sea.

With Duterte during the meeting was Philippine Defense Secretary Delfin Lorenzana who held his own meeting with Wei earlier that day in Camp Aguinaldo in Quezon City. Wei was accompanied by Chinese Ambassador Huang Xilian to Malacañang.

Wei's visit comes nearly 3 weeks after Lorenzana slammed China for confiscating fishing equipment of Filipino fishermen near the Panatag (Scarborough) Shoal. The shoal, a rich fishing ground, belongs to the Philippines' exclusive economic zone but is occupied by China.

The Philippines lodged a diplomatic protest over the incident.

But Wei's September 11 visit highlighted China's assistance to the Philippines' defense establishment.

During the visit, he and Lorenzana signed implementing guidelines for China's grant of 130 million renminbi worth of equipment to the Armed Forces of the Philippines. This amount translates to over P920 million or $19 million worth of equipment, which, according to a DND press release, is mostly for humanitarian assistance and disaster relief.
It is formally called the "Protocol between the Department of National Defense of the Republic of the Philippines and the Ministry of National Defense of the People's Republic of China on China's Provision of Military Assistance Gratis to the Philippines."

Duterte welcomed the signing of the document and acknowledged China's support for the Philippines' defense modernization since 2017, according to a Malacañang press release.

Renewal of 2004 defense pact

Lorenzana and Wei also agreed to "continue working on revisiting the 2004 Philippines-China Memorandum of Understanding (MOU) on Defense Cooperation" to make it more "responsive to current situations," said the DND.

This relatively unknown 2004 agreement binds the Philippines and China as defense partners.

It was signed during the last China-friendly Philippine presidency – that of Gloria Macapagal Arroyo, a known ally of Duterte.

That is it being revisited during the Duterte administration is significant and consistent with the Chief Executive's thrust of strengthening ties with the Asian power, despite concerns from many sectors that China is not doing its part to honor international commitments on the South China Sea.

China has been putting up military bases in illegally-built islands inside the Philippines' exclusive economic zone, in violation of Philippine sovereignty and the United Nations Convention on the Law of the Sea (UNCLOS).

A 2016 international court ruling struck down China's activities as illegal yet Beijing has refused to acknowledge this. Critics say Duterte has done nothing to use the Hague ruling to pressure China into respecting Philippine maritime rights.

South China Sea code, pandemic

Duterte, in his meeting with Wei, repeated his longstanding call for the completion of a South China Sea Code of Conduct, a protocol for Southeast Asian countries and China to follow in order to avoid conflicts in the critical sea lane.

Wei, meanwhile, said China is ready to advance negotiations on the Code.

Lorenzana and Wei "discussed the issues on the South China Sea (SCS), how to avoid misunderstanding, and to resolve differences amicably," according to the DND.

"Both agreed that peace and stability in the SCS should be maintained," the DND said in its press release.

Aside from maritime issues, Lorenzana and Wei exchanged "best practices" in managing the COVID-19 pandemic.

Last May, China's Defense Ministry donated 2 million renminbi ($293,000 or P14 million) worth of medical supplies and personal protective equipment to the DND.

Wei's Philippine visit is part of his tour of ASEAN countries, said Malacañang.

Flight Plan 2028 is a 14-year transformational response master plan to keep up with the “growing and increasingly complex demands of the air defense power” that has increased expectations on PAF.

On Wednesday, the TOW West’ MSAB held its first assembly meeting at the Rizal Reef Hall inside the Western Command (WESCOM) to orient its multi-stakeholder members about the master plan and acquaint them about their responsibilities as members of the body.

Troops lead outreach in 2 isolated Lanao Sur villages

From the Philippine News Agency (Sep 12, 2020): Troops lead outreach in 2 isolated Lanao Sur villages (By Teofilo Garcia, Jr.)

OUTREACH. Military and local government officials conduct outreach to residents of barangays Liangan Uno and Basak in Madalum town, Lanao del Sur on Tuesday (Sept. 8, 2020). Both communities are identified as vulnerable to the threat of the Islamic State-inspired Dawlah Islamiya terror group. (Photo courtesy of the Army's 103rd Infantry Brigade)

Military and local government officials of Madalum, Lanao del Sur conducted outreach in two villages identified as "vulnerable" to the threat of the Islamic State-inspired Dawlah Islamiya (DI) terror group.

In a statement on Saturday, the Army’s 1st Infantry Division said Tuesday's outreach was led by Col. Nolie Anquillano, deputy commander of the 103rd Infantry Brigade, and Vice Mayor Sultan Usman Sarangani Sr. of Madalaum town.

They visited barangays Liangan Uno and Basak and delivered 20 sacks of fertilizer as initial support to both communities.

Agriculture is the residents' primary means of income.

The Army division said the two barangays have been identified as geographically isolated and disadvantaged areas (GIDA), making them priority areas for the "clearing and development" initiatives of the Philippine Army, particularly the 55th Infantry Battalion (IB).

It said the visit was a follow-up to the deployment of the Community Support Program (CSP) of the 55IB’s Alpha Company to protect the residents from terrorist threats and recruitment by resolving social issues, which are reportedly exploited by DI recruiters.

The outreach also aimed to assess the situation in the area to determine the necessary interventions and approaches to resolve existing issues, according to the 1ID.

Currently, 1ID CSP personnel from the 55IB’s Alpha Company, headed by 1Lt. Rodwin Biloza, are assisting the leaders of the two barangays to attain better governance.
It said Biloza’s team is also organizing the farmers and linking them to appropriate agencies so they could benefit from the agriculture-based programs of the government.

Meanwhile, Sarangani encouraged the residents of the two villages to cooperate and support the CSP being conducted by the military in the area.

He also persuaded the Moro Islamic Liberation Front (MILF) members who reside in barangays Liangan Uno and Basak to support government initiatives for peace and development and abide by the normalization process being implemented by both the MILF and the government.

Earlier, the MILF said it has agreed to convince the DI members to return to the fold of the law and play their part in society as law-abiding citizens.

The agreement was reached during the meeting on Tuesday of Lt. Col. Franco Raphael Alano, 55IB commander, and Abdullah Macapaar, alias Commander Bravo, of the North-Western Mindanao Front - Bangsamoro Islamic Armed Forces - MILF (NWMF-BIAF-MILF), who is also a member of the Bangsamoro Transition Authority of the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM).

Johary Malindato and Saiba Ali, barangay chairpersons of Liangan Uno and Basak, respectively, thanked the military’s development initiatives in their communities and pledged their support and cooperation to the effort.

Anquillano persuaded the residents of the two barangays to cooperate with the CSP teams so that necessary government programs could be implemented soon.

He said the youth should be protected from terrorist recruitment and this can be addressed by education and "since education is free these days, there should be no excuse for illiteracy in their communities."

Regional police augments security forces in Zambo City

From the Philippine News Agency (Sep 12, 2020): Regional police augments security forces in Zambo City (By Teofilo Garcia, Jr.)

The Police Regional Office (PRO) 9 (Zamboanga Peninsula) has deployed 196 policemen to augment the security forces here, officials said.

Brig. Gen. Jesus Cambay Jr., PRO-9 director, said the additional forces have been placed under the command of the Zamboanga City Police Office’s (ZCPO) Station 11, which has jurisdiction over the city proper and its periphery.

Cambay said the deployment of additional police personnel is part of security measures to thwart terror attacks.

Mayor Maria Isabelle Climaco-Salazar, who chairs the Regional Peace and Order Council (RPOC), disclosed that intelligence reports indicated that three suicide bombers have escaped from the province of Sulu following the two successive bombings in downtown Jolo on August 24 that killed 10 people and injured dozens of others.

She said the terrorists were reportedly planning to carry out bombings here and in other parts of the Zamboanga Peninsula.

Meanwhile, Maj. Elmer Solon, ZCPO’s Station 11 chief, on Saturday urged the public to remain calm but vigilant to assist the security forces in guarding the city.

At least 150 members of the communist rebel movement's underground mass organization (UGMO) and regulars of the New People's Army (NPA) surrendered to government forces in the Davao de Oro town of Mawab on Friday, the military said.

In a statement on Saturday, the Army's 71st Infantry Battalion (71IB) said
of the 150 surrenderers, 10 were former NPA combatants, 40 were previously affiliated with the communist rebels' Sangay ng Partido sa Lokalidad, 30 were former rebel militiamen, and 70 were former mass supporters from barangays Andili, Concepcion, Sawangan, and Malinawon, all in Mawab municipality.

During the surrender ceremony, 71IB quoted the testimony of Joy (not her real name), a former medic of the Sandatahang Yunit Pampropaganda of the NPA's Southern Regional Committee 2, who said she was convinced to join the NPA after being assured of financial support for her two children.

"I have seen that it is a big help since I am a single mother. I joined because they promised monthly financial support of PHP800 each for my two children,” the 71IB quoted Joy as saying in the vernacular.

However, she said she later found out that the support was cut off several months after she joined the NPA, prompting her to return to the fold of the law.

Mayor Ruperto Gonzaga III said he was elated with the participants' positive response to the government's call for them to start anew and live a peaceful life with their families.

Rep. Ruwell Peter S. Gonzaga, congressman of the province's 2nd District, asked the surrenderers to contribute to the peace-building efforts of the government and to "stay loyal to the government."

Lt. Col. Sonny Gonzales, 71IB commander, said peace and order is not just an obligation of men in uniform but is also a shared responsibility of the community.

"Denouncing the CPP (Communist Party of the Philippines) - NPA and reassuring the government of your loyalty is a good start in attaining genuine peace where the next of our generation will be the ones to benefit," Gonzales said.
